CHAPTER 8

RESIDENTIAL ZONES

10-8A-1: PURPOSE:

The purpose of this zone is to permit the necessary development of identified mountain areas for recreation, seasonal residential living and other activities to the extent compatible with the protection of the natural and scenic resources of the areas for the benefit of present and future generations. 10-8A-2: PERMITTED USES:

Uses permitted in this zone are as follows:
   Accessory buildings and uses after a building permit has been issued for a permanent dwelling.
   Accessory dwelling unit (ADU).
   "Agriculture", as defined in section 10-4-1 of this title, for personal use only.
   Home occupations (County business license required).
   Keeping of animals shall be limited to those allowed in the definition of "animal size" in section 10-4-1 of this title.
   Residential facility for persons with a disability (see section 10-13-21 of this title for supplementary information).
   Short term rental (STR) (when compliant with County Ord. 10-13-23).

10-8A-3: CONDITIONAL USES:

Uses requiring a conditional use permit in this zone are as follows:
   Accessory dwelling unit.
   Campgrounds.
   Lodges and dude ranches in any FR-5 or FR-10 District.
   Pavilion.
   Public buildings.
   Public utilities.
   Other uses similar to the above and judged by the Planning Commission to be in harmony with the character and intent of this zone. 10-8B-1: PURPOSE:

The purpose of this zone is to permit the necessary development of identified mountain areas for seasonal recreational residential development and other activities to the extent that they are compatible with the protection of the natural and scenic resources of the area for the benefit of present and future generations. 10-8B-2: DEFINITION OF SEASONAL:

"Seasonal" is defined as May 15 through November 15. (Ord. 2018-1120-O, 8-21-2018)

10-8B-3: PERMITTED USES:

Uses permitted in this zone are as follows:
Accessory buildings; allowed after a permit for a dwelling has been issued.
Accessory dwelling unit (ADU).
Dwelling for seasonal occupancy.
Fishing; subject to all State and local requirements.
Home occupations (County business license required).
Hunting; subject to all State and local requirements.
Keeping of animals shall be limited to those allowed in the definition of "animal size" in section 10-4-1 of this title.
Livestock grazing.
Recreational vehicles; permitted May 15 through November 15.

10-8B-4: CONDITIONAL USES:

Uses requiring a conditional use permit in this zone are as follows:
Pavilion.
Private lodges.

10-8B-5: HEIGHT REGULATIONS:

10-8B-7: MODIFYING REGULATIONS:

   A.   Keeping Of Animals: The keeping of animals shall be limited to those allowed in the definition of "animal size" in section 10-4-1 of this title.
   B.   Dwelling Square Footage: (Rep. by Ord. 2016-1069-O, 7-19-2016)
   C.   Recreational Vehicles Removed: All recreational vehicles shall be removed from the SFR zone no later than November 15 of each calendar year.
   D.   Septic Tanks And Bathroom Facilities: Septic tanks and bathroom facilities will be required to be constructed along with any building permit. Separate bathroom facilities, if detached from a main dwelling, shall also require a building permit.
      1.   No dumping. Wastewater shall be disposed of according to state and federal law, to include sewage disposal or approved on site wastewater disposal system.

10-8C-1: PURPOSE:

The purpose of this zone is to provide permanent areas for small farms, hobby farms and small agricultural developments. (Ord. 2018-1120-O, 8-21-2018)

10-8C-2: PERMITTED USES:

Uses permitted in this zone are as follows:
Accessory buildings and uses, following issuance of a building permit for a permanent dwelling.
Accessory dwelling unit (ADU).
Home occupations (County business license required).
Household pets; provided that they are not kept, bred or maintained for commercial purposes.
Keeping of animals shall be limited to those allowed in the definition of "animal size" in section 10-4-1 of this title.
Raising of crops, horticulture and gardening.
Residential facilities for persons with a disability (RA-1, RA-2.5 and RA-5 Districts) (see section 10-13-21 of this title for supplementary information).
Short term rental (STR) (when compliant with County Ord. 10-13-23).
Single-family dwellings.

10-8C-6: MODIFYING REGULATIONS:

   A.   Minimum Acreage For Specific Uses: Public riding stables, kennels, rural recreation grounds and facilities, livestock feeding operations, poultry coops for commercial use, or the keeping of exotic animals, may not be approved in districts less than ten (10) acres.
   B.   Commercial Uses Within Distance Of Dwelling: No corral, stable, coop or kennel for commercial use may be located within five hundred feet (500') of any dwelling on a residential building lot.
   C.   Keeping Of Animals: The keeping of animals shall be limited to those allowed in the definition of "animal size" in section 10-4-1 of this title.
   D.   Location Of Corral Or Stable: No corral or stable shall be located closer than one hundred feet (100') from any dwelling unit. (Ord. 2016-1069-O, 7-19-2016)

10-8D-1: PURPOSE:

10-8D-6: MODIFYING REGULATIONS:

   A.   Side Yards: The side yard setback on a "street side" yard shall be the same as a front yard setback. Accessory buildings located at least ten feet (10') away from the main building may have a three foot (3') side or rear property setback on interior lot lines.
   B.   Distance Between Buildings: No building, structure or run housing animals or fowl shall be constructed closer to a dwelling unit on an adjacent lot than fifty feet (50').
   C.   Combustible Material: No trash, rubbish, weeds or other combustible material shall be allowed to remain on any lot outside of approved containers in any residential zone. No junk, debris, or junk cars shall be stored or allowed to remain on any lot in any residential zone.
   D.   Housing Of Weaner Pigs: The housing of weaner pigs may be approved by conditional use permit, subject to the following requirements:
      1.   "Weaner pigs" shall be defined as pigs that will be one year of age or less and do not weigh more than three hundred fifty (350) pounds at the end of the five (5) month period in which the weaner pig is kept.
      2.   All weaner pigs shall be kept only during the months of December through April, or for a different five (5) month period of time if approved by the planning commission.
      3.   Setbacks for pens for weaner pigs shall be the same as required for other animals.
      4.   No weaner pig shall be allowed to run loose (not in a restricted environment, such as a pen) unless attended by the owner or keeper of the pig.
      5.   All pens shall be cleaned regularly, a minimum of three (3) times weekly.
      6.   No mud bogs shall be allowed in the pens. All pens shall have drainage to keep water from pooling within the pen.
      7.   Other conditions as may be imposed by the planning commission relative to specific sites and/or conditional use applications.
   E.   Keeping Of Animals: The keeping of animals shall be limited to those allowed in the definition of "animal size" in section 10-4-1 of this title. (Ord. 2016-1069-O, 7-19-2016; amd. Ord. 2021-1196-O, 10-5-2021)

10-8E-1: PURPOSE:

The purpose of this zone is to provide appropriate locations where low density residential neighborhoods may be established, maintained and protected. The regulations also permit the establishment, with proper controls, of public and semipublic uses such as churches, schools, libraries, parks and playgrounds which serve the requirements of families. The regulations are intended to prohibit uses that would be harmful to a single-family residential neighborhood. (Ord. 2018-1120-O, 8-21-2018; amd. Ord. 2024-1251-O, 2-25-2024)

10-8E-2: PERMITTED USES:

Uses permitted in this zone are as follows:
   Accessory uses and buildings; permitted after obtaining a building permit for a residential dwelling.
   Accessory dwelling unit (ADU).
   Home gardens and fruit trees.
   Home occupations (County business license required).
   Household pets; provided that they are not kept, bred or maintained for any commercial purposes.
   Keeping of animals shall be limited to those allowed in the definition of "animal size" in section 10-4-1 of this title.
   Residential facility for persons with a disability (see section 10-13-21 of this title for supplementary information).

10-8E-3: CONDITIONAL USES:

Uses requiring a conditional use permit in this zone are as follows:
   "Child nursery", as defined in section 10-4-1 of this title.

   "Home occupation", as defined in section 10-4-1 of this title.
   Park or playground.
   Public buildings.
   Public utilities.
   School.

   C.   Private Garages And Accessory Buildings: Private garages and accessory buildings located at least ten feet (10') behind the main dwelling may have a side yard of three feet (3'); provided, that all corner lots shall maintain twenty five feet (25') on the street side.
   D.   Prohibited Materials: No trash, rubbish, weeds or other combustible material shall be allowed to remain on any lot outside of approved containers in any residential zone. No junk, debris, or junk cars shall be stored or allowed to remain on any lot in a residential zone.

10-8F-1: PURPOSE:

The purpose of this zone is to provide appropriate locations where medium to high density residential neighborhoods on lots of not less than twenty thousand (20,000) square feet may be established, maintained and protected. The regulations also permit the establishment of, with proper controls, the public and semipublic uses such as churches, schools, libraries, parks and playgrounds, etc., which serve the requirements of families. The regulations are intended to prohibit those uses that would be harmful to a medium to high density residential neighborhood. (Ord. 2018-1120-O, 8-21-2018; amd. Ord. 2024-1251-O, 2-25-2024)

   Accessory buildings and uses, following issuance of a building permit for a permanent dwelling.

   Keeping of animals shall be limited to those allowed in the definition of "animal size" in section 10-4-1 of this title.
   Multiple-family dwellings. All new construction required unless otherwise approved by the Planning Commission.
   Residential facilities for persons with a disability (see section 10-13-21 of this title for supplementary information).

10-8F-7: MODIFYING REGULATIONS:

   A.   Side Yard: The side yard setback on a "street" side yard shall be the same as for the front yard setback.
   B.   Private Garages And Accessory Buildings: Private garages and accessory buildings located at least ten feet (10') behind the main dwelling may have a side yard of three feet (3'); provided, that all corner lots shall maintain twenty five feet (25') on the street side.
   C.   Zero Side Yard: A "zero" side yard setback may be used for all two-family lots in a planned subdivision or development. In such cases, the opposite side yard shall not be less than a combination of the side yards otherwise required.
   D.   Fractional Square Footage Left Over: Any "fractional" amount of square footage left over in calculating density may not be considered toward an additional dwelling unit unless the full required amount of land is available.
   E.   Less Than Required Front Yard Setback: In zoned areas where the front yard setback has been less than twenty five feet (25') on adjacent property, new construction may be constructed at the lesser front yard setback requirement but in no case shall the setback be less than twenty feet (20').
   F.   Maximum Dwelling Units In R-2 Zone: In the R-2 zone, no multiple-family dwelling shall contain more than two (2) dwelling units.
   G.   Location Of Parking: Parking shall not be located in the front yard setback area.
   H.   Garbage Receptacles: If a dumpster is used for garbage collection, the dumpster must be kept in a dumpster surround constructed of masonry and include a sight obscuring gate. (Ord. 2016-1069-O, 7-19-2016; amd. Ord. 2024-1251-O, 2-25-2024)

10-8G-1: PURPOSE:

The purpose of this zone is to provide for the development of manufactured home parks and recreational vehicle parks in a quality environment. Manufactured home parks and recreational vehicle parks are not intended for the isolated lot, but shall be for use in areas where larger tracts of land are available for development, and can be developed to a high standard of quality with landscaping, recreation facilities, etc., and are designed and intended from the beginning of development as manufactured homes only. The minimum zone size shall be approximately five (5) acres. (Ord. 2018-1120-O, 8-21-2018)

10-8G-2: PERMITTED USES:

Uses permitted in this zone are as follows:
Accessory buildings and uses.
Home occupations.
Horticulture and gardening for personal use.
Household pets, provided that they are not kept, bred or maintained for any commercial purposes.
Keeping of animals shall be limited to those allowed in the definition of "animal size" in section 10-4-1 of this title.
Manufactured homes.

10-8G-3: CONDITIONAL USES:

Uses requiring a conditional use permit in this zone are as follows:
Manufactured home parks.
Park or playground.
Public utilities.
Recreational vehicle parks.
Other uses approved by the Planning Commission as being in harmony with the intent of the zone and similar in nature to the above listed uses. (Ord. 2018-1120-O, 8-21-2018)

10-8G-4: HEIGHT REGULATIONS:

10-8G-5: MANUFACTURED HOME PARK DEVELOPMENT STANDARDS:

   A.   Density: The maximum density for a manufactured home park shall not exceed six (6) units per acre.
   B.   Access Roads: Each manufactured home park shall be provided with hard surface (concrete or asphalt) roadways of at least twenty five feet (25') in width to serve each manufactured home space and parking area.
   C.   Park Access: Access to all manufactured home parks shall be from a dedicated and approved public street at an approved access point or points. No manufactured home space shall have direct access from a public street. Any access road connecting two (2) or more public streets shall be arranged to prohibit or discourage through traffic.
   D.   Off Street Parking: Parking spaces shall be provided for the parking of motor vehicles in the ratio of at least two (2) parking spaces for each manufactured home space. (Ord. 2001-815-O, 12-17-2001, eff. 12-17-2001)
   E.   Recreation Space: Recreation space shall be provided for each manufactured home park. A minimum usable area of five thousand (5,000) square feet shall be set aside and developed for each manufactured home park having at least ten (10) units and one hundred (100) square feet additional space for each unit above ten (10) units.
   F.   Manufactured Home Space: Each manufactured home space shall have a minimum of five thousand (5,000) square feet and a minimum width of fifty feet (50'). (Ord. 2001-815-O, 12-17-2001, eff. 12-17-2001; amd. 2004 Code)
   G.   Stand Or Pad: A manufactured home stand or pad shall be provided for each manufactured home unit. Said pad shall be free from weeds or debris, and soil shall be sterilized prior to locating manufactured home on pad.
   H.   Minimum Yard Clearances For Manufactured Home Park: Each manufactured home shall have the following minimum yard clearances:
      1.   Front or side yard on a public street, twenty five feet (25').
      2.   Side yard bordering adjacent property, ten feet (10').

      4.   A six foot (6') sight obscuring fence shall be erected along all side and rear property lines, unless otherwise approved by the planning commission.
   I.   Minimum Yard Clearances For Manufactured Home Space: Each manufactured home shall have the following minimum yard clearance which may also be included in and a part of the setbacks required in subsection H of this section:
      1.   Front yard on a private street or access road, fifteen feet (15') in back of curb.
      2.   Side yard on main door side of manufactured home, fifteen feet (15').
      3.   Side yard on "no access" side of manufactured home, ten feet (10').
      4.   Rear yard, ten feet (10').
      5.   No two (2) manufactured homes shall be closer than twenty feet (20').
   J.   Utilities Required: All sewage and water proposals shall be required to have approval from the Utah state department of environmental quality. All buildings, electrical, plumbing and fire protection construction shall comply with state and county requirements and codes, including applicable standards found in the county subdivision ordinance (including, but not limited to, fire protection), the building code, and this title. 10-8G-6: MODIFYING REGULATIONS:

   A.   Perimeter Fence: Unless otherwise approved by the planning commission, each manufactured home park shall be fenced at the perimeter with a six foot (6') high sight obscuring fence. (Ord. 2001-815-O, 12-17-2001, eff. 12-17-2001; amd. 2004 Code)
   B.   Building Code; Permit: Installation of any manufactured unit shall be done in conformance with the requirements of the current edition of the building code following approval of the building department, and the issuance of a building permit.
   C.   Street Construction: All streets in a manufactured home park shall be paved according to the construction standards of the county and shall be bounded by curb and gutter approved by the planning commission. (2004 Code)

10-8G-7: RECREATIONAL VEHICLE PARK DEVELOPMENT STANDARDS:

   A.   Minimum Size: Each recreational vehicle park shall have a minimum size of five (5) acres.
   B.   Roads:
      1.   Width: Each recreational vehicle park shall be provided with roadways of at least twenty five feet (25') in width.
      2.   Construction Specifications: All recreational vehicle parks shall be served by paved roads constructed to county standards and bounded by curb and gutter approved by the county.
   C.   Park Access: Access to all recreational vehicle parks shall be from a dedicated and approved public street at an approved point or points. No RV space shall have direct access from a public street.
   D.   Off Street Parking: Parking spaces shall be provided for the parking of each recreational vehicle, towed vehicle, or vehicle being towed which is located in the RV park.
   E.   Recreation Space: Recreation space shall be provided for each recreational vehicle park having ten (10) or more units and shall be maintained for such use. A minimum usable area of five thousand (5,000) square feet shall be set aside and developed for each such park and an additional one hundred (100) square feet shall be provided for each unit above ten (10) units.
   F.   Density: The maximum density for a recreational vehicle park shall not exceed ten (10) units per gross acre.
   G.   Space Width: Each recreational vehicle space shall have a minimum width of thirty feet (30') and all recreational vehicles shall be able to park in designated spaces and no portion of a driveway or roadway may be used for recreational vehicle parking.
   H.   Distance Of Units: No RV space shall be designed to allow RV units to be parked closer than twenty feet (20'). This requirement shall apply to overnight, extended stay and park model units. No unit in an RV park shall be located closer than the distance required herein.
   I.   Minimum Yard Clearances For Recreational Vehicle Park:
      1.   Front or side yard on a public street, twenty five feet (25').
      2.   Side yard bordering adjacent property, ten feet (10').
      3.   Rear yard bordering adjacent property, ten feet (10').
      4.   A six foot (6') sight obscuring fence shall be erected along all side and rear property lines unless otherwise approved by the planning commission.
   J.   Utilities Required: Each recreational vehicle parking space shall have connections available for water, sewer and electricity. All utility connections shall be located underground. Water and sewer plans shall be approved by the Utah state department of environmental quality, and the county public works department.
   K.   Waste Disposal: All recreational vehicle parks shall provide for connection to waste disposal facilities approved by the planning commission and the state department of environmental quality (DEQ), and shall comply with applicable standards of the subdivision ordinance.
   L.   Outdoor Living Space: Each recreational vehicle parking space shall be provided with a minimum of three hundred (300) square feet of "outdoor living" space located adjacent to the vehicle parking space. Said outdoor living space shall be maintained in a clean and weed free manner and shall be kept free from garbage or debris of any kind.
   M.   Landscape Plan: A detailed landscape plan shall be submitted for each recreational vehicle park, and shall be approved by the planning commission. (Ord. 2001-815-O, 12-17-2001, eff. 12-17-2001; amd. 2004 Code)

10-8G-8: SUBDIVISION REQUIREMENTS:

Any use approved in the MH zone in which the sale of any lot or parking space is proposed, shall be subject to all applicable requirements of the county subdivision ordinance. (Ord. 2001-815-O, 12-17-2001, eff. 12-17-2001)
