CHAPTER 17

30 PC PLANNED COMMUNITY DISTRICT

§ 17.30.010 Purpose.

The purpose of the Planned Community zone is to encourage creative and efficient land uses, to encourage mixed or multiple use projects, to permit variations from the density, height and other standards in the various zones and to permit development based on a high standard of performance and design.

§ 17.30.020 Procedure.

PC district zoning shall be adopted or changed in the same manner as prescribed by this title concerning zoning district amendments. No PC district shall be adopted unless a development plan and development schedule has been approved for the area.

§ 17.30.030 Permitted uses.

All uses, when consistent with the general plan, shall be allowed in PC districts, subject to the approval of the development plan and development schedule by the city council.

§ 17.30.040 Uses requiring a use permit.

A use permit shall be required for all uses in a PC district unless there is an approved development plan approved by the city council. Any use permit must be consistent with the general plan.

§ 17.30.050 Height and space requirements.

Minimum lot size, yards, parking requirements, maximum height, density, and percentage of coverage shall be established for each PC zone by the development plan approved by the city council. In no instance shall the density of a residential development exceed the density permitted by the general plan designation.

§ 17.30.060 Area requirements.

No PC district shall be established for a site with less than one acre, (one or more owners) exclusive of bordering streets or highways.

§ 17.30.070 Development plan.

An application for a PC zone shall include and be accompanied by a development plan. The PC zone, when adopted, shall become part of the zoning map of the city as provided for in Chapter 17.06 and the development plan for such PC zone shall be adopted by resolution of the city council.
A. 
The development plan shall include:
1. 
A map showing any street system and lot design proposed within the zone. Any area proposed to be dedicated or reserved for parks, parkways, playground, school sites, public buildings, and other such uses must be shown. Compliance with this requirement shall not be construed to relieve the applicant from compliance with the subdivision regulations or any other applicable regulation of the city of Waterford.
2. 
A plot plan for each building site or sites in the proposed PC zone or any portion thereof as required by the planning commission. The plot plan shall show the approximate location of all proposed buildings, indicating distances between buildings and between buildings and property or building site lines.
3. 
Elevations of all proposed structures. Such drawings need not be the result of final architectural decisions but need only be in sufficient detail to indicate the height of proposed buildings and general appearance of the proposed structures so that the entire development will have architectural unity, be in harmony with surrounding developments and comply with any design criteria in effect at the time of application.
4. 
A parking and circulation plan for all nonresidential developments. This plan shall include off-street parking, truck loading access, proposed circulation patterns of vehicles within the PC zone and to and from adjacent public thoroughfares. Any special engineering features and traffic regulation devices needed to facilitate or insure the safety of the circulation pattern shall be shown.
5. 
Any or all of the following plans and diagrams or similar information may be required by the planning commission:
a. 
A parking and circulation plan for residential developments;
b. 
A landscaping and tree planting plan;
c. 
A map showing the existing and proposed topography of the area at one-foot contour intervals and trees and structures on the property;
d. 
An economic feasibility report or market analysis;
e. 
Noise evaluation of the proposed development;
f. 
A traffic analysis of the proposed development.
B. 
Any changes proposed in the development plan shall be submitted to the planning director and shall be processed as follows:
1. 
Changes in a development plan which do not involve new uses, significant impact on adjacent property or significant site redesign may be approved by the planning director or referred to the planning commission for decision without a public hearing.
2. 
Changes in a development plan which involve new uses, revisions with significant impact on adjacent property or significant site redesign shall be considered amendments to the PC zone and processed the same as a zone boundary change.

§ 17.30.080 Development schedule.

A. 
An application for a PC zoned shall be accompanied by a development schedule indicating the approximate date when construction of the project can be expected to begin, the anticipated rate of development and the completion date.
B. 
From time to time the planning commission shall compare the actual development accomplished in the various PC zones with the approved development schedules. If the development schedule has expired, the commission may either recommend that the city council grant an extension to the schedule or shall initiate proceedings to rezone the property to the zone classification which it held immediately prior to being zoned PC.
C. 
Upon request by the property owner and for good cause, the planning commission may recommend that the city council extend the time limits of the development schedule provided that any request for an extension be on file in the office of the planning director at least thirty days prior to the expiration of any time limit.

§ 17.30.090 Revocation.

If conditions of approval have not been complied with, the planning commission may initiate proceedings to review the PC zone and either modify it or rezone the property to the zoned classification which it held immediately prior to being zoned PC.

§ 17.30.100 Designation of PC zoning map.

Each PC zone shall be numbered, the first adopted being shown on the zoning map as PC (1) and each zone subsequently adopted being numbered successively.
