CHAPTER 17

61 MURALS

§ 17.61.010 Intent.

It is the intent of the city council, for purposes of promoting the local economy, tourism, and for further purposes of beautifying the city of Waterford, to adopt this chapter regarding murals, their location and design.

§ 17.61.020 Definitions.

As used in this chapter, the following definitions shall apply:
"Mural"
means a permanent picture painted directly on an exterior wall or on panels to exterior walls.
"Mural project permit"
means a permit issued by the city to a private party authorizing the painting of a mural within the city.

§ 17.61.030 Location of murals.

A. 
It is the intent of the city council that murals be located on the side of public, commercial, industrial and multifamily residential buildings.
B. 
Murals shall be located in the "downtown" area of the city of Waterford in that area bounded by buildings located on the west side of and visible from "F" Street to the west; buildings located on the east side of and visible from "E" Street to the east; buildings located on the south side of and visible from Highway 132 (Yosemite Parkway) to the south; and buildings located on the north side of and visible from Bentley Street to the north.
C. 
Other murals may be located within commercial or industrial areas of the city subject to approval by the Waterford city council.

§ 17.61.040 Character for design of murals.

The following criteria shall apply to the design of murals submitted for approval:
A. 
The subject matter shall be of historical significance of the growth and development of the city of Waterford and its surrounding environs or the natural terrain and/or geographical features.
B. 
The paint to be used and applied shall be appropriate for the use in an outdoor locale and for an artistic rendition and shall be of a permanent, long lasting variety.
C. 
To the extent feasible, the mural shall be vandal and graffiti resistant.
D. 
The council may, from time to time by resolution, adopt additional criteria and guidelines for the design of murals.

§ 17.61.050 Application for permit and fees.

A. 
Mural Design Approval Required—Permit Issuance. Prior to painting, installation and execution of a mural, an application must be submitted for review and approval by the planning commission.
B. 
Mural Design Amendment—Approval Required. Prior to amending a mural design (whether painted or not yet painted) that has been approved by the city planning commission, an application for an amendment of the permit shall first be reviewed and recommended for approval by the architectural review committee.
C. 
Upon approval by the planning commission, the permit for the mural shall be deemed amended.
D. 
Application Fee and/or Permit Issuance. In the event the city council determines it appropriate, it may set, by resolution, a fee for the application and/or permit issuance.
E. 
Planning commission approval of a mural design shall occur only after public notice and an opportunity being provided to any interested party to present any appropriate comments, considerations and/or concerns, either in writing or orally, to the city council.
F. 
Mural design review applications for mural permits may be referred to the Waterford chamber of commerce or similar business group for review and comment prior to action and referral by the architectural review committee. The chamber may offer suggestions and recommendation to the applicant, the architectural review committee and/or the city council to assist in the mural permit decision-making process.

§ 17.61.060 Maintenance, repair and removal.

All murals shall be maintained in good repair and condition by a sponsor as named in the mural application. The sponsor or building owner shall agree to maintain the mural in an attractive condition or the city shall have the mural repaired, removed or otherwise maintained at the building owner's sole cost and expense.
