A variance is an official permit, obtained from the hearing examiner, to do something normally forbidden by regulations. As used in this title, a variance is authorized only for height, setbacks, area, and size of structure or size of yards and open spaces. Establishment or expansion of a use otherwise prohibited shall not be allowed by variance, nor shall a variance be granted because of the presence of nonconformities in the zoning district. A variance may be allowed if the building site meets 7,000 square feet and setback requirements although it may not meet the minimum width requirement of 75 feet.
