165.11 B BUSINESS DISTRICTS

REGULATIONS.

1.   The following information summarizes the requirements for both Business Districts. All requirements that not presented in a table format shall be assumed to apply for both districts, unless otherwise stated.
2.   Permitted Principal Uses.

An automotive body shop, when incidental and secondary to the function of an auto dealership; provided, however, that the outdoor storage of any wrecked vehicle shall be on a durable, dust-free surface, and shall be screened from view of the street or neighboring properties.

4.   Special Uses. As authorized by the Board of Adjustment (Section 165.24).

Any use that is determined to be of the same general character as the aforementioned permitted uses, but not including any use which may become noxious or offensive. Any unlisted use without Board of Adjustment approval is prohibited.

For any property directly adjacent to certain Arterial Streets, all new development shall be considered a Special Use, as part of the Access Management strategy described in Section 165.24(3).
5.   Site and Structure Requirements. The following minimum requirements shall be observed for all non-residential properties, subject to the additional requirements, exemptions, and modifications in Section 165.22.

All residential properties in B-1 and B-2 Districts shall conform to the Building and Lot Requirements, and Yard Measurements for the R-4 Multi-Family Residence District, as outlined in Section 165.07(5 and 6).
6.   Parking. As regulated by Section 165.19, Off-Street Parking and Loading Spaces.
7.   Sign Requirements. As regulated by Chapter 160 of this Code of Ordinances.
8.   Fencing.
   A.   The following types of fencing (see Section 165.03, Definitions) are allowed in the B-1 and B-2 Districts, under the specified conditions:

In the B-2 District only, Security or Impoundment Fencing may have a top addition of barbed wire, which shall be positioned at least 6 feet above grade level, be no greater than 2 feet in width, and not extend over the adjoining property line. If the fence itself is exactly 8 feet, or nearly 8 feet in height, the barbed wire may extend above this point
 
   B.   Residential Uses. Properties within the B-1 and B-2 Districts, which are used for residential purposes, shall be subject to the Fencing requirements listed in Section 165.07(8).
   C.   Adjacent Residential Districts. If a non-residential property directly adjoins a Residential District (or any other property currently used for residential purposes), not separated by a public right-of-way, any boundary fence that is adjacent to the Residential District (or other residential use) shall not exceed 5 feet in height above grade level.
   D.   Barbed Wire and Adjacent Districts. In the B-2 District, barbed wire shall not be used along any fence that directly borders a B-1 District, or any Residential District, unless separated by a public right-of-way.
