165.05 A-1

AGRICULTURAL DISTRICT.

1.   Purpose. This district is established to provide for the protection, regulation, and continued agricultural use of tracts of land not planned for future residential, business, or industrial uses.
2.   Permitted Principal Uses.
   A.   The practice of agriculture and use of agricultural buildings, provided that livestock shall not be housed or fed within 200 feet of any lot in a Residential District.
   B.   One single-family dwelling on a lot of 4 acres or more. Dwellings existing prior to annexation by the City are permitted on lots of less than 4 acres.
   C.   Any building or structure used as a nursery, school, library, or similar public cultural use, located no less than 50 feet from any lot in a Residential District.
   D.   Cemeteries.
   E.   Churches and other religious institutions, located no less than 20 feet from any lot in a Residential District.
   F.   Essential services as defined in (Section 165.03)
   G.   Municipal administrative or public service buildings or properties, except such uses as storage yards, warehouses, garages, or other uses customarily conducted as gainful businesses, provided any building is located no less than 20 feet from any lot in a Residential District.
   H.   Professional office (as defined in Section 165.03)
   I.   Public parks, playgrounds, and recreational areas.
   J.   Railroad rights-of-way and trackage, not including switching, storage, terminal facilities or freight yards.
   K.   Sale of nursery and greenhouse products.
   L.   Transformer stations and booster or pressure regulating stations, without service yard or storage.
3.   Permitted Accessory Uses.
   A.   Buildings, structures, and uses accessory to agricultural uses including roadside stands, selling produce grown on the premises, provided these are located no less than 20 feet from a street or highway right-of-way line.
   B.   Private garages or parking areas.
   C.   Living quarters of persons employed on the premises, such as a caretaker or housekeeper.
   D.   Home occupations, when housed in a single-family dwelling, as regulated in Section 165.20.
4.   Special Uses. As authorized by the Board of Adjustment, (Section 165.24).
   A.   Sanitary landfills, in accordance with County and State regulations, except that no sanitary landfill shall be operated within 1,320 feet of any Residential District.
   B.   Privately operated country clubs, golf courses, swimming clubs, riding stables, and similar recreation uses provided that any principal accessory building shall be located not less than 200 feet from any lot in a Residential District.
   C.   Airports and landing strips.
   D.   Communications towers and antennas, as regulated in Chapter 114 of this Code of Ordinances.
   E.   Wind Energy Systems, as regulated in Chapter 115 of this Code of Ordinances.
   F.   Home businesses, as regulated in Section 165.20
   G.   For any property directly adjacent to certain Arterial Streets, all new development shall be considered a Special Use, as part of the Access Management strategy described in Section 165.24(3).
5.   Height Regulations. No principal structure shall exceed 2½ stories or 30 feet in height.
6.   Building, Lot and Yard Requirements. The following minimum requirements shall be observed subject to the additional requirements, exemptions, and modifications in Section 165.20.

7.   Sign Requirements. As regulated by Chapter 160 of this Code of Ordinances.
8.   Fencing:
   A.   The following types of fencing (see Section 165.03, Definitions) are allowed in the A-1 District, under the specified conditions:

In a front yard, any fencing other than a split-rail or picket fence made of wrought iron, wood, or vinyl shall require the approval of the Board of Adjustment.
 
   B.   Internal Fencing. There is no regulation of agricultural fences in the interior of a property in the A-1 District.
   C.   Residential Properties. Properties used solely for residential purposes shall be subject to the regulations for Security, Impoundment, and Privacy Fencing specified in Section 165.07(8).
   D.   Barbed Wire and Adjacent Districts.
      (1)   Barbed wire shall not be used along any boundary fence that directly borders a B-1 District, or any Residential District, unless separated by a public right-of-way.
      (2)   Barbed wire may be used along a boundary fence that directly borders a B-2 District, or any Industrial District, but if not separated by a public right-of-way, the use of barbed wire shall be subject to the following conditions:
         a.   Barbed wire may only be used when attached as the top addition to a boundary fence.
         b.   The barbed wire section must be at least 6 feet from the ground.
         c.   Barbed wire shall not exceed 2 feet in width.
         d.   Barbed wire may not extend over the adjoining property line.
