ARTICLE XIII

- SIGN REGULATIONS

Sec. 94-401. - Scope, purpose and intent.

  • a.
    Scope. The regulations set forth shall in this article apply to and govern signs in all districts. No sign shall be erected or maintained unless it is in compliance with the regulations governing content, size, location and other sign characteristics for the district in which it is located.
  • b.
    Purpose and intent. It is the intent of this article to:
    1. 1.
      Create a healthier residential and business environment by improving the visual quality of the city.
    2. 2.
      To promote traffic safety by protecting motorists from the distracting visual clutter of excessive signage. The regulations contained in this article restrict signage primarily to that which is an accessory use and not a principal use.
  • It is also the intent of this article to secure and preserve unto the people of the city the right of free expression guaranteed by the First Amendment of the Constitution of the United States; hence this article shall be so construed as to effectuate such intent.

    Sec. 94-402. - General provisions.

  • a.
    Unregulated signs. The provisions of this article shall not apply to the following:
    1. 1.
      Any sign which is located completely within an enclosed building and which is not visible from outside the building, and any sign which is so located that it is not visible beyond the boundaries of the lot or parcel on which it is located or from any public thoroughfare, except, however, that signs within a shopping center shall be subject to review and approval pursuant to site plan review.
    2. 2.
      Traffic signs of any public or governmental agency.
    3. 3.
      Any identification of any official public office, notices thereof, or any flag, emblem or insignia of the nation, a unit of government, or public school.
    4. 4.
      Any grave marker, headstone, memorial statue, or other similar remembrances that are noncommercial in nature.
    5. 5.
      Works of fine art, both two and three dimensional, with a commercial enterprise which may receive direct commercial gain from such display.
    6. 6.
      Temporary decorations or displays celebrating the occasion of traditionally accepted patriotic or religious holidays.
    7. 7.
      Signs on a truck, bus, trailer, or other vehicle which is maintained and operated for normal business purposes other than the display of such a sign on a lot.
    8. 8.
      Names and addresses on postal boxes.
    9. 9.
      Residential address numbers.
    10. 10.
      Names of newspapers and similar publications on their delivery boxes.
    11. 11.
      The posting of privately owned land and/or buildings or structures against trespassing, hunting, fishing, swimming or any other activity, and/or the warning of any person against any danger, hazard or condition pertaining to such land and/or buildings and structures.
    12. 12.
      The flying of individual national, state, or city flags attached to freestanding poles mounted on the ground, limited to a total of three provided that such flags shall not be used for commercial promotion.
    13. 13.
      Cornerstones, memorial tablets, and similar markers made of masonry, bronze and other incombustible and durable material and used to indicate, without advertising matter, information relating to the development of the facility on which they are located such as those involved in planning, financing and construction of buildings.
    14. 14.
      Historical signs and markers designating places of historical significance.
    15. 15.
      Directional markings, entrance and exit locators, traffic warnings, lane and stall markings, parking and loading area reservations and restrictions, and similar information when painted on or otherwise affixed to pavement, curbs or wheelstops.
    16. 16.
      Any informational sign, not exceeding six square feet, identifying an institutional use. Such signs may be located in public rights-of-way subject to engineering approval.
    17. 17.
      Any sign approved by the city commission for use on city-owned property at the city auditorium/stadium complex, and which is in conformance with subsection 94-408(d) (signs permitted in general commercial and city center-3 district).
    18. 18.
      Any sign approved by the city commission and incorporated into a county bus shelter, a city trolley shelter, or located at a bicycle sharing station or bicycle sharing kiosk, which signs shall be in conformance with the provisions of subsection 94-305(e) regarding visibility at intersections.
    19. 19.
      City entry identification signs designating entry points to the city.
    20. 20.
      Neighborhood entry identification signs designating entry points to neighborhoods.
    21. 21.
      City park identification signs designating city parks and recreation areas.
    22. 22.
      Temporary light pole banners which are located in a public right-of-way and which announce and promote special noncommercial events or organizations of public interest. Such banners are regulated in chapter 78, article VI, pertaining to special events.
  • b.1. Prohibited signs and related equipment. The following signs and related equipment shall not be permitted erected, or maintained in any district:

    1.   
      1. 1.
        Any sign or sign structure which is structurally unsafe or constitutes a hazard to safety or health by reason of inadequate maintenance, dilapidation or abandonment, or which is not kept in good repair or is capable of causing electrical shocks to persons likely to come into contact with it.
      2. 2.
        Any sign which obstructs free ingress to or egress from a required door, window, fire escape, or other required exit way.
      3. 3.
        Any sign which makes use of words such as "stop," "look," "danger," or any other words, phrases, symbols, or characters in such a manner as to interfere with, mislead, or confuse traffic.
      4. 4.
        Any sign which was or is unlawfully installed, erected, or maintained under the terms of this ordinance or under the applicable terms of any preceding ordinance.
      5. 5.
        Any sign which is supported by visible angular bracing members, guy wires or cables, or any sign that is served by visible electrical conduit.
      6. 6.
        Any sign which would project into any public right-of-way or other access way, or the visibility triangle area set forth in subsection 94-303(d), with the exception of sidewalk signs which are regulated by subsection 94-408(b)(6).
      7. 7.
        Any sign located so as to impair access to a roof.
      8. 8.
        Any sign in or on the waters of Lake Worth, Lake Mangonia, or Clear Lake.
      9. 9.
        Unauthorized signs on property owned by or under the control of the city.
      10. 10.
        Any billboard or off-premises sign, with the exception of subsection 94-404(g)(5).

    b.2. Prohibited signs and related equipment. The following signs and related equipment shall not be permitted erected, or maintained in any district, unless specifically permitted as part of a site-specific sign program adopted as part of a planned development (PD):

    1.   
      1. 1.
        Signs which incorporate any flashing or moving lights, except that this section shall not be deemed to prohibit signs which state time and/or temperature information and which incorporate moving or exposed incandescent light bulbs with a time and/or temperature sequence span of four to eight seconds.
      2. 2.
        Banners, pennants, spinners, balloons and streamers, except as permitted by subsection (a)(6) of this section and section 94-407[16]. For the purposes of this section, banners, pennants, streamers, spinners, and balloons shall be any such object with or without lettering or other specific identification or advertising information or graphic.
      3. 3.
        String lights used on commercial premises except as permitted by subsection (a)(6) of this section.
      4. 4.
        Any sign which has any visible moving parts, visible revolving or rotating part, or visible mechanical movement of any description or other apparent visible movement achieved by electrical, electronic, or mechanical means, including intermittent electrical pulsations, or action of normal wind current.
      5. 5.
        Any portable sign. For the purpose of this section, a portable sign shall be any sign which is not permanently affixed to the ground or to a building or to another structure which is affixed to the ground in accordance with the requirements of the building code. A sign which is affixed to a truck, bus, trailer or other vehicle which has as a primary purpose the display of such a sign on a lot shall be considered to be a portable sign and shall be prohibited. However, a sign which is affixed to a truck, bus, trailer or other vehicle which is maintained and operated primarily for business purposes other than the display of such a sign on a lot, shall not be considered to be a portable sign, but shall be considered to be an unregulated sign pursuant to the provisions of subsection (a)(1) of this section. These provisions do not apply to sidewalk signs as defined and regulated by section 94-611 and subsection 94-408(b)(6).
      6. 6.
        Any sign attached to or painted on a standpipe, gutter drain, fire escape, television antenna, satellite dish, or any similar accessory structure.
      7. 7.
        Any sign within 50 feet of any residential district boundary line unless such design is completely screened from the residential district by a building; such sign is expressly permitted in the particular residential district that is within 100 feet and meets all the requirements which would be applicable if such sign were located within the particular residential district.
      8. 8.
        Any wall mounted sign located on the exterior of a building which would project more than 18 inches there from, except as provided for in section 94-403.
      9. 9.
        Any sign which would project above the height, as defined in section 94-611, of the building on which it is located at the point where it is located.
      10. 10.
        Any sign which emits a sound, odor, or visible matter.
      11. 11.
        Any signs made of any material (including paper, cardboard, wood, and metal) when such sign is tacked, nailed, posted, pasted, glued, or otherwise attached to or painted on trees, utility poles, fences, or other similar objects. However, this section shall not prohibit signs on freestanding landscape walls if such walls are permitted or required under the terms of this chapter. For the purposes of this section, a freestanding landscape wall shall be any wall which:
        1. a.
          Is not part of a building or which extends beyond a building.
        2. b.
          Is of brick, decorative concrete, or comparable durable wood and steel construction and is built upon a permanent foundation.
      12. 12.
        Any addition or enlargement of an existing sign unless such addition or enlargement has been approved by issuance of a permit in conformance with the sign code.
      13. 13.
        Any sign which contains or consists of a three dimensional sculptural figure which is an emblem of the business to which it is accessory or which represents products manufactured or sold by such business.
      14. 14.
        Any other sign not specifically authorized by this chapter.
    1. c.
      Severability.
      1. 1.
        Generally. If any part, section, subsection, paragraph, subparagraph, sentence, phrase, clause, term, or word of this article is declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, the declaration of such unconstitutionality shall not affect any other part, section, subsection, paragraph, subparagraph, sentence, phrase, clause, term, or word of this article.
      2. 2.
        Severability where less speech results. Without diminishing or limiting in any way the declaration of severability set forth above in subsection (1) or elsewhere in this article, this Code, or any adopting ordinance, if any part, section, subsection, paragraph, subparagraph, sentence, phrase, clause, term, or word of this article is declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, the declaration of such unconstitutionality shall not affect any other part, section, subsection, paragraph, subparagraph, sentence, phrase, clause, term, or word of this article, even if such severability would result in a situation where there would be less speech, whether by subjecting previously exempt signs to permitting or otherwise.
      3. 3.
        Severability of provisions pertaining to prohibited signs. Without diminishing or limiting in any way the declaration of severability set forth above in subsection (1) or elsewhere in this article, this Code, or any adopting ordinance, if any part, section, subsection, paragraph, subparagraph, sentence, phrase, clause, term, or word of this article or any other law is declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, the declaration of such unconstitutionality shall not affect any other part, section, subsection, paragraph, subparagraph, sentence, phrase, clause, term, or word of this article that pertains to prohibited signs, including specifically those signs and sign types prohibited and not allowed under subsection 94-402(b) of this article. Furthermore, if any part, section, subsection, paragraph, subparagraph, sentence, phrase, clause, term, or word of subsection 94-402(b) is declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, the declaration of such unconstitutionality shall not affect any other part, section, subsection, paragraph, subparagraph, sentence, phrase, clause, term, or word of subsection 94-402(b).
      4. 4.
        Severability of prohibition on billboards. If any part, section, subsection, paragraph, subparagraph, sentence, phrase, clause, term, or word of this article and/or any other code provisions and/or laws are declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, the declaration of such unconstitutionality shall not affect the prohibition on billboards as contained in this article and Code.
    2. d.
      Substitution of speech.
      1. 1.
        Substitution of noncommercial speech for commercial speech. Notwithstanding anything contained in this article or Code to the contrary, any sign erected pursuant to the provisions of this article or Code may, at the option of the owner, contain a noncommercial message in lieu of a commercial message and the noncommercial copy may be substituted at any time in place of the commercial copy upon issuance of a duly authorized building permit. The noncommercial message (copy) may occupy the entire sign face or any portion thereof. The sign face may be changed from commercial to noncommercial messages, or from one noncommercial message to another noncommercial message, as frequently as desired by the owner of the sign, provided that the size, height, setback, and other dimensional criteria contained in this article and Code have been satisfied, and appropriate building permits have been issued.
    3. e.
      Permits required.
      1. 1.
        Except for those signs described in subsection 94-402(a), an owner or applicant shall obtain a duly-authorized building permit from the city's construction services department prior to the installation of any sign, including the change of any sign face.

    Sec. 94-403. - Signs on a marquee, canopy or awning.

  • a.
    Signs on a marquee. Not withstanding the limitations of this article on the projection of signs from the wall of a building, signs shall be permitted on marquees subject to the following limitations:
    1. 1.
      Such signs shall indicate only the name of the building or the name of the principal occupant of the building.
    2. 2.
      Such signs shall be affixed flat to the face of the marquee, projecting no more than three inches therefrom.
    3. 3.
      Such signs shall not extend above or below the structure of the marquee.
    4. 4.
      Such signs shall be counted in determining the area of wall mounted signs permitted on the wall from which the marquee projects.
  • b.
    Signs on a canopy or awning. Notwithstanding limitations of this article on the projection of signs from the wall of a building, signs shall be permitted on canopies and awnings subject to the following limitations:
    1. 1.
      Such signs shall indicate only the name of the building or the name of the principal occupant of the building.
    2. 2.
      Such signs shall be painted or printed directly on the canopy or awning.
    3. 3.
      Such signs shall be counted in determining the area of wall mounted signs permitted on the wall from which the canopy or awning projects.

    Sec. 94-404. - Legal noncomplying signs.

  • a.
    Legal noncomplying signs defined. A legal noncomplying sign is any sign which was legally established pursuant to the issuance of a sign permit on or before the effective date of the ordinance from which this article is derived, and which is rendered noncomplying by the provision of such ordinance or a subsequent amendment thereto. In order to be considered a legal noncomplying sign, a sign must comply with all applicable regulations in effect at the time it was erected, including having been issued a sign permit. Signs for which no sign permit was required at the time they were established and which are rendered noncomplying by the provisions of this article or a subsequent amendment thereto shall not enjoy legal noncomplying status, but shall be illegal noncomplying signs.
  • b.
    Regulations applicable to legal noncomplying signs. Legal noncomplying signs shall be subject to the building and structural nonconformity provisions of ARTICLE XIV of this chapter and the provisions of this section.
  • c.
    Replacement of legal noncomplying sign with another noncomplying sign restricted. The sign face of a legal noncomplying sign may be changed, replaced, or repaired provided the change, replacement or repair shall not prolong the life of the sign structure or so as to change the shape or size of the sign. Normal maintenance of noncomplying signs to preserve structural soundness shall not be prohibited.
  • d.
    Alteration of noncomplying message prohibited. No sign with a noncomplying commercial message shall have any changes made in the words or symbols which would result in a different noncomplying commercial message unless the sign is a billboard, an off-premises advertising sign, a bulletin board, or substantially similar type of sign, specifically designed for periodic change of message.
  • e.
    Removal of damaged noncomplying signs. No noncomplying sign shall be reconstructed or repaired to a noncomplying state after damage or destruction if the cost of reconstruction exceeds 50 percent of the replacement cost of the sign. Damaged noncomplying signs which may not be reconstructed or repaired under the terms of this article shall be removed immediately.
  • f.
    Removal of obsolete noncomplying signs. Obsolete signs which are noncomplying in their number, size or placement shall be removed not less than 30 days after becoming obsolete. An obsolete sign is hereby defined as any such sign which no longer correctly directs or exhorts any person; or which advertises a business, service, product or activity no longer conducted, available or in the case of on-premises signs, or on any lot in the case of off-premises signs.
  • g.
    Removal of legal noncomplying signs. Any sign which may become noncomplying as a result of this article or any amendment to this article may be continued in operation and maintained indefinitely as a legal noncomplying sign, provided that:
    1. 1.
      No structural alteration, enlargement, or extension shall be made to a legal noncomplying sign unless the structural alteration, enlargement, or extension will result in the elimination of the noncomplying features of the sign.
    2. 2.
      No sign shall be moved in whole or in part to any other location where it would remain noncomplying.
    3. 3.
      If a legal noncomplying sign is damaged or destroyed by any means to the extent of 50 percent or more of its replacement value at the time of the damage, the sign may not be rebuilt or used thereafter unless it conforms to all of the provisions of this ordinance. In the event the damage or destruction is less than 50 percent of its replacement value at the time, the sign may be rebuilt to its original condition and may continue to be displayed.
    4. 4.
      Normal maintenance of legal noncomplying signs, including necessary nonstructural repairs and incidental work which does not extend or intensify the noncomplying features of the sign, shall be permitted.
    5. 5.
      Billboards
      1. a.
        Any billboards within the City of West Palm Beach, with exception of those located within 350 feet of the main line of Interstate 95, existing before March 9, 1998, may be relocated adjacent to Interstate 95 by March 23, 2007, subject to the approval of a Class A special use permit prior to applying for a billboard sign permit with the construction services department. The city commission may grant waivers of the additional standards if the request is found consistent with the waiver standards outlined in subsection 94-273(a)(2). All distance requirements provided in this section shall be measured from the furthest projection of the structure.
        1. 1.
          Applicable locations. Billboards may be located in any industrial or general commercial zoning district, or in any industrial or commercial planned development district, where billboards are permitted, subject to the following regulations:
          1. i.
            Billboards shall be located a maximum of 350 feet from the main line of the Interstate 95 right-of-way;
          2. ii.
            Billboards located along the same side of the Interstate 95 right-of-way shall have a minimum separation distance of 1,500 feet.
          3. iii.
            All relocated billboards shall be constructed on a monopole.
          4. iv.
            Roof-mounted billboards are prohibited.
        2. 2.
          Additional application requirements.
          1. i.
            The plans submitted with the Class A special use permit and the billboard sign permit shall include the following:
            1. I.
              The location and the billboard face square footage of the billboard(s) proposed for removal;
            2. II.
              The location of the proposed relocated billboard;
            3. III.
              A site plan and a survey indicating the proposed setbacks from the Interstate 95 right-of-way, the nearest billboard(s) to the north and south on the same side of the Interstate 95 right-of-way, residential zoning district(s) on the same side of the Interstate 95 right-of-way, and the nearest intersection on the same side of the Interstate 95 right-of-way;
            4. IV.
              A cross section that depicts the distance between nearest point of the billboard and the main line of the Interstate 95 right-of-way, as well as the maximum height of the billboard at grade and from the crown of Interstate 95;
            5. V.
              An elevation plan that depicts the dimension of the relocated billboard face; and
            6. VI.
              The written permission of the property owner of the relocated billboard location.
          2. ii.
            A relocated billboard structure with two faces may be constructed adjacent to Interstate 95 for each billboard structure with two faces removed.
          3. iii.
            The face of the relocated billboard, including temporary embellishments, shall not exceed 700 square feet in area.
          4. iv.
            A lighting plan showing the illumination for a relocated billboard directed only towards the billboard face.
          5. v.
            The relocated billboard(s) may not commence construction prior to the removal of the existing billboard(s) being relocated. The relocated billboard(s) shall commence construction within six months of the issuance of the billboard sign permit. If the applicant has demonstrated good faith effort to commence construction, the building official may extend such billboard sign permit for a period not to exceed an additional six months. Should a sign permit for construction of a relocated billboard(s) lapse, the demolished billboard(s) shall not be reconstructed at the original location and no further billboard relocation right shall exist.
        3. 3.
          Additional standards.
          1. i.
            A relocated billboard shall be located on a property that has a minimum frontage of 250 linear feet along Interstate 95.
          2. ii.
            A relocated billboard shall comply with the setbacks listed below:
            1. I.
              From side and rear property lines: 50 feet minimum.
            2. II.
              From a residential zoning district on the same side of the right-of-way: 250 feet minimum.
          3. iii.
            The height of a relocated billboard shall not exceed 65 feet above the crown of Interstate 95 to the top of the highest sign face, including temporary embellishments.
      2. b.
        An existing billboard affected by any roadway modification constructed or required by the state department of transportation may be modified or relocated on the same parcel subject to subsections (g)(5)a.1., (g)(5)a.2.iv., (g)(5)a.2.iv, and (g)(5)a.3. of this section and the following requirements:
        1. 1.
          A billboard which is eligible for modification or relocation under these provisions shall be subject to Class A special use permit review.
        2. 2.
          Waivers from the dimensional requirements of subsection (g)(5)a.3. of this section may be granted provided that such waivers are found consistent with the waiver standards outlined in subsection 94-273(a)(2) and that such waivers are the minimum required for the modified or relocated billboard as demonstrated by the applicant.
        3. 3.
          The face of the modified or relocated billboard shall not exceed that of the existing billboard.
        4. 4.
          A modified or relocated billboard shall not commence construction prior to the demolition of the billboard that requires modification or relocation. The modified or relocated billboard shall commence construction within six months of the issuance of the billboard sign permit. If the applicant has demonstrated good faith effort to commence construction, the building official may extend such billboard sign permit for a period not to exceed six months. Should a sign permit for a modified or relocated billboard lapse, the demolished billboard shall not be reconstructed at the original location and no further billboard modification or relocation right shall exist.
        5. 5.
          Mitigating measures including, but not limited to, a landscape buffer, shall be considered to mitigate any negative impacts of the modified or relocated billboard.
  • h.
    Illegal noncomplying signs defined. An illegal noncomplying sign is any sign which was not in compliance with applicable regulations at the time such sign was established. Signs for which a required permit has not been issued shall be deemed to be illegal noncomplying signs even if they comply with all other requirement in effect at the time they were established.
  • i.
    Regulations applicable to illegal noncomplying signs. Nothing in this ordinance shall be deemed to allow the continued maintenance of an illegal noncomplying sign. Illegal noncomplying signs shall be subject to immediate removal.
  • j.
    Construction and maintenance of signs subject to building code. The construction, installation, erection, anchorage, and maintenance of all signs shall be subject to the regulations of the building code. All electrical service wiring associated with freestanding signs shall be installed underground.

    Sec. 94-405. - Computation of sign area.

  • a.
    Computation of sign area and number. Computation of sign area for signs not covered by section 94-409 and except as provided in subsection (b) of this section: the area of each face of a sign shall be the area of the smallest circle, triangle, or parallelogram, which contains all content, background, and structural elements of the sign. Sign area shall not include structural elements which function solely as support for the sign or cover of structural elements.
  • b.
    Computation of sign area for signs which consist only of letters and numbers which are individually painted on or otherwise attached to a building wall, decorative landscape wall, screen wall, marquee, or canopy or awning. The area of each face of a sign which consists only of letters and numbers which are individually painted on or otherwise attached to a building wall, decorative landscape wall, screen wall, marquee, canopy, or awning shall be computed as in subsection (a) of this section. However, the maximum area of signs covered by this section shall be 20 percent larger than the maximum area otherwise permitted by this article.
  • c.
    Certain support structures exempted from computation of area of freestanding signs. Support structures which are part of a decorative landscape wall or screen wall shall not be considered to be part of a freestanding sign.
  • d.
    Determination of the number of signs. Any collection of sign content, sign background, and sign structure may be considered to be one sign face if the area of such sign face is measured as only one circle or only one triangle or only one parallelogram, provided that the area so measured conforms to the maximum sign area requirements of this article.
  • e.
    Placement, vertical dimension, construction, and finish of signs. It is the intent of these sign placement, vertical dimension, construction, and finish regulations to preserve and enhance the aesthetic quality of the environment by reducing the visual discordance which can result from:
    1. 1.
      The haphazard placement of signs on buildings; and
    2. 2.
      The use of an array of different sign constructions on one building.

      It is recognized that this intent may be met by approaches other than those specifically set forth in this section. Accordingly, this section makes provisions for approval of signs which conform to the intent of this section but which do not conform to the specific requirements of subsections (h) and (i) of this section.

  • f.
    Placement of signs attached to building walls in relation to building lines. Signs shall be placed on a building so as not to break important horizontal or vertical building lines. This requirement will be considered met if none of the following types of lines are broken:
    1. 1.
      Cornice line;
    2. 2.
      Lintel lines, actual and extended;
    3. 3.
      Sill lines, actual and extended;
    4. 4.
      Belt course lines;
    5. 5.
      Column and pilaster lines.

    This requirement may be considered met even if one or more of the types of lines in subsections (f)(1)—(5) of this section are broken if the building is designed so that a permitted sign cannot be located without breaking one or more of the above lines and the sign or signs are placed to minimize the breaking of important building lines.

  • g.
    Vertical dimension of wall mounted signs in relations to building facade elements. The maximum vertical dimension of a wall-mounted sign shall be no more than 40 percent of the vertical face dimension of the facade element (parapet, spandrel, facia, or other facade element) on which it is mounted. This requirement shall be considered met even if all or a portion of a sign exceeds in vertical dimension 40 percent of the vertical dimension of the facade element on which it is mounted if the building is designed so that a permitted sign cannot be located without exceeding the 40 percent limit of any building facade element.
  • h.
    Coordination of construction type of wall-mounted signs. Whenever more than two wall-mounted signs are permitted on any one building, all may be, and all except one must be of the same construction type (cabinet, individual pan-channel letters, individual reverse pan-channel letters, or other). In addition, all may be and all except one must have the same base line if they are individual letters mounted on the building facade, and must have the same base and top line if they are of any other construction type.
  • i.
    Finish of sign background and sign structure. Low freestanding signs shall have a background and structure which is of a material, color, and finish that is used extensively in the building to which the sign is accessory. A material, color, and finish will be considered to be used extensively if it covers more of the nonglass portions of the highly visible surfaces of the building than does any other material, or if it covers at least 30 percent of the nonglass portions of the highly visible surfaces of the building.
  • j.
    Alternate approaches. Signs which do not conform to one or more of the requirements set forth in subsections (a)—(i) of this section may be approved if the review authority finds on the basis of sufficient facts that the intent set forth in section 94-401 is met. Such a finding shall only be made based on a written analysis and recommendation from a recognized design professional.

    Sec. 94-406. - Illumination of signs.

    Except as otherwise provided in this chapter, signs shall be illuminated only as follows:

    1. 1.
      By lights placed inside a cabinet sign with an opaque or a translucent background and translucent copy;
    2. 2.
      By lights placed inside individual pan-channel letters;
    3. 3.
      By halo lights placed behind individual reverse pan-channel letters;
    4. 4.
      By lights which are directed to shine directly on the sign. Such lights shall be directed and/or shielded so as not to shine directly unto neighboring property or the eyes of passing motorists;
    5. 5.
      By exposed incandescent bulbs, if such signs give time or information; or
    6. 6.
      By exposed neon lighting.

    Sec. 94-407. - Signs permitted in all districts.

    The following signs shall be permitted in all districts:

    1. 1.
      Residential unit nameplate signs. Low freestanding signs with one or two faces and wall mounted signs with one face shall be permitted subject to the following controls:
      1. a.
        Permitted content: the name of the occupant and the address of the residential unit to which the sign is an accessory. In addition, signs permitted pursuant to this section may contain any noncommercial message which has not been declared by a court of competent jurisdiction to be obscene, defamatory or otherwise contrary to law.
      2. b.
        Maximum area: one square foot per face.
      3. c.
        Maximum number: one per dwelling unit.
      4. d.
        Location: on the same lot as the residential unit which the sign identifies.
      5. e.
        Maximum height:
        1. 1.
          Low freestanding: four feet.
        2. 2.
          Wall mounted: no higher than the wall on which it is mounted.
    2. 2.
      Residential development permanent identification signs. Low freestanding signs with one or two faces shall be permitted subject to the following controls:
      1. a.
        Permitted content: the name, logo and address (if applicable) of the residential development identified. Types of residential developments which may be so identified include subdivisions, condominiums, apartments, and mobile home parks. In addition, signs permitted pursuant to this section may contain any noncommercial message which has not been declared by a court of competent jurisdiction to be obscene, defamatory, or otherwise contrary to law.
      2. b.
        Maximum area:
        1. 1.
          Under 50 residential units: 32 square feet per face.
        2. 2.
          50 or more residential units: 48 square feet per face.
      3. c.
        Maximum number: one per entrance to the development, but no two signs for the same development shall be within 500 feet of each other.
      4. d.
        Location: within 100 feet of the entrance of the development which it identifies.
      5. e.
        Minimum setbacks:
        1. 1.
          From lot line of any property located outside the development: 20 feet.
        2. 2.
          From public rights-of-way: 15 feet if all sign faces placed parallel to the street and 20 feet if one or more sign faces not placed parallel to the street.
        3. 3.
          From intersections of streets with other streets and with access drives: as required by subsection 94-305(e).
      6. f.
        Maximum height:
        1. 1.
          Freestanding: four feet.
        2. 2.
          Wall-mounted: no higher than the wall on which it is mounted.
    3. 3.
      Identification signs for nonresidential uses. Low freestanding signs with one or two faces and wall mounted signs with one face shall be permitted subject to the following controls:
      1. a.
        Permitted content: the name, logo and and address of the building to which the sign is accessory; the name, logo, address of occupants of the building, and other related information. In addition, signs permitted pursuant to this section may contain any noncommercial message which has not been declared by a court of competent jurisdiction to be obscene, defamatory, or otherwise contrary to law.
      2. b.
        Maximum area: 20 square feet.
      3. c.
        Maximum number: one per lot.
      4. d.
        Location: on the principal structure of the use to which it is an accessory, unless such structure is more than 20 feet from the nearest right-of-way, then on the same lot as the use which the sign identifies.
      5. e.
        Minimum setbacks:
        1. 1.
          From lot line of another lot: 20 feet.
        2. 2.
          From public rights-of-way: 15 feet if all sign faces placed parallel to the street, and 20 feet if one or more signs faces not placed parallel to the street.
        3. 3.
          From intersections of streets with other streets and with access drives: as required by subsection 94-305(e).
      6. f.
        Maximum height:
        1. 1.
          Low freestanding: six feet.
        2. 2.
          Wall mounted: no higher than the wall on which it is mounted.
      7. g.
        Additional limitations: on any lot in which a sign is established under the provisions of section 94-408.
    4. 4.
      Bulletin boards for houses of worship (manual or electronic). In addition to signs permitted pursuant to this section, freestanding manual or electronic bulletin boards with one or two faces and wall mounted manual or electronic bulletin boards with one face shall be permitted for houses of worship subject to the following controls:
    1.   
      1. a.
        Permitted content: Any information related directly or indirectly to the activities of the house of worship. In addition, signs permitted pursuant to this section may contain any noncommercial message which has not been declared by a court of competent jurisdiction to be obscene, defamatory, or otherwise contrary to law.
      2. b.
        Content change: Signs permitted pursuant to this section shall be permitted to change its message no more than four times within a 24-hour period.
      3. c.
        Maximum area: 20 square feet per face.
      4. d.
        Maximum number: one per lot.
      5. e.
        Location: on the same lot as the use to which it is accessory.
      6. f.
        Minimum setbacks:
        1. 1.
          From lot line of another lot: 20 feet.
        2. 2.
          From public right-of-way: 15 feet if all sign faces placed parallel to the street and 20 feet if one or more sign faces not placed parallel to the street.
        3. 3.
          From intersections of streets with other streets and with access drives as required by subsection 94-305(e).
      7. g.
        Maximum height:
        1. 1.
          Low freestanding: six feet.
        2. 2.
          Wall-mounted: 12 feet.
      8. h.
        Prohibited lighting for an electronic message sign:
        1. 1.
          Lamps or bulbs in excess of 30 watts.
        2. 2.
          Exposed reflectorized lamps or bulbs.
        3. 3.
          Lamps or bulbs not covered by a lens, filter, louver or sunscreen.
        4. 4.
          Modes of operation that scroll, flash, zoom, twinkle or sparkle.
    1. 5.
      Parking area identification signs. Low-freestanding signs with one or two faces and wall mounted signs with one face shall be permitted subject to the following controls:
      1. a.
        Permitted content: designation of entrance and exit points, including directional arrows.
      2. b.
        Maximum area: four square feet per sign face.
      3. c.
        Maximum number: one per entrance and exit.
      4. d.
        Location: on the same lot as the parking area to which it is accessory.
      5. e.
        Minimum setbacks:
        1. 1.
          From lot line of another lot: 20 feet.
        2. 2.
          From public rights-of-way: zero feet.
        3. 3.
          From intersections of streets with other streets and with access drives: as required by subsection 94-305(e).
      6. f.
        Maximum height:
        1. 1.
          Low-freestanding: six feet.
        2. 2.
          Wall-mounted: 12 feet.
    2. 6.
      Parking area instructional and related signs. Low freestanding signs with one or two faces and wall-mounted signs with one face shall be permitted subject to the following controls:
      1. a.
        Permitted content: the direction of traffic flow within a parking or loading area, areas where no parking is permitted; identification of parking spaces reserved for other specific groups or for individuals, and other similar information.
      2. b.
        Maximum area: not larger than is necessary to be visible to site where they are located, and subject to site plan review authority approval.
      3. c.
        Maximum number: as necessary to regulate traffic flow, parking, loading, handicapped, and reserved parking; and subject to site plan review authority approval.
      4. d.
        Location: on the same lot as the parking and other vehicular circulation areas to which they are accessory.
      5. e.
        Minimum setbacks:
        1. 1.
          From lot line of another lot: subject to site plan review authority approval pursuant to site plan review.
        2. 2.
          From public rights-of-way: subject to site plan review authority approval pursuant to site plan review.
        3. 3.
          From intersections of streets with other streets and with access drives: as required by subsection 94-305(e).
      6. f.
        Maximum height:
        1. 1.
          Wall-mounted: no higher than the wall on which is mounted.
        2. 2.
          Low freestanding: six feet.
    3. 7.
      Temporary signs accessory to development of residential and nonresidential uses. A low freestanding sign with one or two faces and wall mounted signs with one face shall be permitted subject to the following controls:
      1. a.
        Permitted content: identification of home or home sites, condominiums, apartments, or mobile homes sites for sale, rent, or lease in a residential development under construction; and/or identification of nonresidential development under construction. Signs may include identification of developers, contractor, architects, engineers, real estate agents, and other related information.
      2. b.
        Maximum area: 200 square feet per face.
      3. c.
        Maximum number: one per 500 feet or fraction thereof of each street frontage.
      4. d.
        Location: within 100 feet of the entrance to the development it identifies.
      5. e.
        Minimum setbacks: 20 feet from the lot line of any property located outside the development.
      6. f.
        Upon final certificate of occupancy of a completed residential or nonresidential structure, such sign shall be removed.
      7. g.
        Illegally placed temporary signs shall be removed by or at the expense of the owner or individual responsible for the illegal placement.
    4. 8.
      Temporary construction fences. Construction fences for permitted, commenced construction projects may:
      1. a.
        In an area not to exceed 200 square feet per street frontage provide text identifying the developer, architect, contractor, lenders, future tenants and other professionals hired to develop the project and a rendering of the proposed project.
      2. b.
        Provide an unlimited amount of graphics and artwork not related to or advertising the construction project or any other products or services and not containing any lewd or obscene visuals.
      3. c.
        In addition to the above, construction fences for public non-profit construction projects may provide copy identifying individual sponsors of the construction project in an area not to exceed 15 percent of the face of the fence.
      4. d.
        In an area not to exceed ten percent of the face of the fence per street frontage, provide text and/or graphics advertising governmental institutions. Such advertising shall be located a minimum of ten feet from any other text and/or graphics.
    5. 9.
      Temporary real estate "For Sale," "For Lease," and "For Rent" signs. Low freestanding signs with one of two faces and wall-mounted signs with one face shall be permitted subject to the following controls:
      1. a.
        Permitted content: the name, logo, address, and telephone number of the real estate agent or owner, offering the property on which it is located for sale, lease, or rent; and other related information.
      2. b.
        Maximum area:
        1. 1.
          For residential uses: six square feet per sign face.
        2. 2.
          For nonresidential uses: 16 square feet per sign face.
      3. c.
        Maximum number: one sign per lot.
      4. d.
        Location: on the lot advertised for sale.
      5. e.
        Minimum setbacks:
        1. 1.
          From lot line of another lot: 20 feet.
        2. 2.
          From public rights-of-way: 15 feet if all sign faces placed parallel to the street and 20 feet if one or more sign faces are not placed parallel to the street.
        3. 3.
          From intersections of streets with other streets and with access drives: as required by subsection 94-305(e).
      6. f.
        Maximum height: six feet.
      7. g.
        Time limit: Signs permitted pursuant to this section shall be removed as soon as 90 percent of the residential units and/or 90 percent of the leasable or saleable floor area of the development to which they are appurtenant is sold, rented, or leased to any purchaser other than the original developer.
      8. h.
        Illegally placed temporary signs shall be removed by or at the expense of the owner or individual responsible for the illegal placement.
    6. 10.
      Temporary political signs pertaining to specific elections.
      1. a.
        Permitted content: any message urging the election or defeat of any candidate seeking any political office or urging the passage or defeat of any ballot measure.
      2. b.
        Maximum area: the total aggregate sign area for all such signs on a lot shall be 20 square feet. The maximum freestanding sign area shall be proportioned to its distance to the nearest public right-of-way or other public property as follows:

        Time limit: signs permitted pursuant to this section shall be removed within 48 hours after the day of the election to which they apply.
      6. h.
        Permit requirements: no sign permit required.
      7. i.
        Illegally placed temporary signs shall be removed by or at the expense of the owner or individual responsible for the illegal placement.
    1. 11.
      Temporary garage sale and yard sale signs. Low freestanding signs with one or two faces, and wall-mounted signs with one face shall be permitted subject to the following controls:
      1. a.
        Permitted content: type of sale, the address, dates and hours of the sale, and directional information, and other related information.
      2. b.
        Maximum area: six square feet per face.
      3. c.
        Maximum number: not more than one per lot, nor three per sale.
      4. d.
        Location: only on lots where the property owner has given permission.
      5. e.
        Minimum setbacks:
        1. 1.
          From lot line of another lot: 20 feet.
        2. 2.
          From public rights-of-way: zero feet.
        3. 3.
          From intersections of streets with other streets and with access drives: as required by subsection 94-305(e).
      6. f.
        Maximum height:
        1. 1.
          Low freestanding: six feet.
        2. 2.
          Wall-mounted: six feet.
      7. g.
        Illegally placed temporary signs shall be removed by or at the expense of the owner or individual responsible for the illegal placement.
    2. 12.
      Temporary signs for special events. Signs announcing and promoting special events may be displayed pursuant to the issuance of a special event permit and the regulations set forth in Chapter 78, Article VI.- Special Events of this code.
    3. 13.
      Noncommercial free expression signs. Low freestanding signs with one or two faces shall be permitted as accessory to any use subject to the following controls:
      1. a.
        Permitted content: any thought, idea, sentiment, opinion, or any political, philosophical, religious, aesthetic or other expression which does not promote, advertise or solicit for, by content or design, any commercial business, product or service; and which has not been declared by a court of competent jurisdiction to be obscene, defamatory, or otherwise contrary to law.
      2. b.
        Maximum area: six square feet per face.
      3. c.
        Maximum number: one sign per lot. Such sign shall be permitted in addition to all other signs permitted by this article.
      4. d.
        Location: on the same lot as the use to which it is accessory.
      5. e.
        Minimum setbacks:
        1. 1.
          From lot line of another lot: 20 feet.
        2. 2.
          From public rights-of-way: zero feet.
        3. 3.
          From intersections of streets with other streets and with access drives: as required by subsection 94-305(e).
      6. f.
        Maximum height:
        1. 1.
          Wall-mounted: six feet.
        2. 2.
          Low freestanding: four feet.
      7. g.
        Illegally placed temporary signs shall be removed by or at the expense of the owner or individual responsible for the illegal placement.
    4. 14.
      Changeable copy event signs for theaters, indoor motion pictures and live performances (manual or electronic).
      1. a.
        Content: the name, logo and address of the building and building occupant to which the sign is accessory and other information relating to on-site films, events and performances. Signs permitted pursuant to this section shall be permitted to change their message no more than four times within a 24-hour period.
      2. b.
        Maximum sum total area of changeable copy event signage: pursuant to zoning district regulations of section 94-408.
      3. c.
        Maximum number of changeable copy event signs: two manual or electronic message signs for each individual lot or business.
      4. d.
        Minimum setbacks for freestanding event signs: pursuant to zoning district regulations of section 94-408.
      5. e.
        Maximum height: pursuant to zoning district regulations of section 94-408.
      6. f.
        Prohibited lighting for electronic message sign:
        1. 1.
          Lamps or bulbs in excess of 30 watts.
        2. 2.
          Modes of operation that scroll, flash, zoom, twinkle or sparkle.
        3. 3.
          Lamps or bulbs not covered by a lens, filter, louver or sunscreen.
        4. 4.
          Exposed reflectorized lamps or bulbs.
    5. 15.
      Changeable copy event signs for auditoriums, convention centers, stadiums, sport arenas and regional attraction facilities (manual or electronic).
      1. a.
        Content: the name, logo and address of the building and building occupant to which the sign is accessory and other information relating to on-site events and performances. Signs permitted pursuant to this section shall be permitted to change their message not more than once per two second period.
      2. b.
        Maximum sum total area of changeable copy event signage: pursuant to zoning district regulations of section 94-408.
      3. c.
        Maximum number of changeable copy event signs: two manual or electronic message signs for each individual facility.
      4. d.
        Minimum setbacks for freestanding event signs: pursuant to zoning district regulations of section 94-408.
      5. e.
        Maximum height: pursuant to zoning district regulations of section 94-408.
      6. f.
        Prohibited lighting for electronic message sign:
        1. 1.
          Lamps or bulbs in excess of 30 watts.
        2. 2.
          Exposed reflectorized lamps or bulbs.
        3. 3.
          Lamps or bulbs not covered by a lens, filter, louver or sunscreen.
        4. 4.
          Modes of operation that scroll, flash, zoom, twinkle or sparkle.
      7. g.
        Location: electronic message signs shall only be located on roadways classified as arterial or expressways.
    6. 16.
      On-premises banners shall only be permitted for not-for-profit cultural facilities and the Palm Beach County Convention Center to announce limited events such as public functions or fundraising events for charitable, educational, civic, or similar purposes in all zoning districts, provided the following conditions are met:
      1. a.
        A one-time informal site plan review approval is required for all banner locations and size. Additional banners, locations or square footage than previously approved requires new informal site plan review approval. As part of the application process the applicant must complete a detailed sign program to include:
        1. 1.
          A copy of a plot plan showing the proposed locations where the banners are to be mounted;
        2. 2.
          A photometric plan; and
        3. 3.
          The dimensional elevations of the building facades or light pole detail upon which the banner is to be located.
      2. b.
        The program shall meet the following requirements:
        1. 1.
          Banners may be located on a light pole or on a building facade;
        2. 2.
          Banner designs shall be consistent with the building's architecture, scale and proportions;
        3. 3.
          Banners applied to the facade of the building shall be located with respect to the building's architecture and shall not obscure windows or other architectural elements;
        4. 4.
          The total number of banners shall not exceed four (4) per street front;
        5. 5.
          Banner Size:
          1. a.
            Maximum size for banners mounted on buildings: The maximum total area of the banners shall not exceed five percent of the surface area of the building's street facade or 40 square feet, whichever is greater.
          2. b.
            Maximum size for all other banners: 40 square feet.
      3. c.
        All structures holding or supporting banners are subject to final approval during the building permit process.
      4. d.
        Banners for special events may be displayed no longer than 30 days before the event and shall be removed within seven days after the event. The event date must be stated on the banner. The planning director or designee may approve up to a 30-day extension prior to the event upon a showing of just cause.
      5. e.
        Light poles with banners shall be a minimum of five feet from the property line and no portion of the banner shall extend into the public right-of-way.
      6. f.
        A banner's highest point shall not exceed the highest point of the building or pole upon which it is mounted.
      7. g.
        The minimum clearance of banners above the finished grade shall be eight feet.
      8. h.
        Banners must present a professional appearance and shall be maintained in good condition.
      9. i.
        Banner content is limited to the announcement of special events. A banner may include an acknowledgement of corporate sponsors provided such acknowledgement meets the following criteria:
        1. 1.
          Total acknowledgment does not exceed an area of ten percent of the banner surface area; and
        2. 2.
          Acknowledgement content is limited to "sponsored by," followed by the name of the corporate sponsor; and
        3. 3.
          Acknowledgement of multiple corporate sponsors must be contained in the same location.

    Sec. 94-408. - Signs permitted in commercial, industrial, community service, recreation and open space and conservation districts.

  • a.
    Signs permitted in the office commercial (OC), neighborhood commercial (NC), commercial marine (CM) districts. Signs permitted in the office commercial (OC), neighborhood commercial (NC), commercial marine (CM) districts shall be as follows:
    1. 1.
      Wall-mounted signs. The requirements for wall mounted signs shall be as follows:
      1. a.
        Content: the name, logo and address of the building and building occupants to which the sign is accessory, and other related information. In addition, signs permitted pursuant to this section may contain any noncommercial message which has not been declared by a court of competent jurisdiction to be obscene, defamatory or otherwise contrary to law.
      2. b.
        Maximum sum total area of all signs mounted on the front facade of a building: 75 percent of the area permitted by section 94-409.
      3. c.
        Maximum sum total area of all signs mounted on a facade other than the front facade: 75 percent of the area permitted by section 94-409.
      4. d.
        Maximum number on each building: one sign for each individual business occupant of the building, plus two additional signs.
      5. e.
        Maximum height: no higher than the building wall on which it is mounted.
    2. 2.
      Low freestanding signs. The requirements for low freestanding signs shall be as follows:
      1. a.
        Content: the name, logo, and address of the building and building occupants to which the sign is accessory and other related information in addition, signs permitted pursuant to this section may contain any noncommercial message which has not been declared by a court of competent jurisdiction to be obscene, defamatory, or otherwise contrary to law.
      2. b.
        Maximum sum total area of all low freestanding signs on front street: one square foot for each one linear foot of front street frontage of the lots on which located.
      3. c.
        Maximum sum total area of all low freestanding signs on side street frontage: 0.50 square feet for each one linear foot of front street frontage of the lots on which located.
      4. d.
        Maximum number of all low freestanding signs on each lot: one sign for each individual business occupant on the lot to a maximum of three signs.
      5. e.
        Minimum setbacks:
        1. 1.
          From lot line of another lot: 24 feet.
        2. 2.
          From public right-of-way line: five feet.
        3. 3.
          From intersections of streets with other streets and with access drives: as required by subsection 94-305(e).
        4. 4.
          Maximum height: ten feet.
    3. 3.
      Time and temperature signs. Signs giving time and temperature information shall be permitted when attached to or made part of an otherwise permitted sign. Such signs shall not be larger than 25 percent of the permitted area of the sign to which they are attached. Such signs shall be counted on part of the permitted area of the sign to which they are attached.
    4. 4.
      Manual changeable copy signs. Changeable copy information signs shall be permitted when attached to or made part of an otherwise permitted sign. Such signs shall be limited to two manual changeable copy message signs per parcel and shall be counted as part of the permitted area of the sign to which it is attached.
    5. 5.
      Pedestrian blade signs. Pedestrian blade signs are permitted in the neighborhood commercial (NC) district on properties which have frontage on Dixie Highway and Tamarind Avenue. The requirements for pedestrian blade signs shall be as follows:
      1. a.
        Location and size requirements: The signs may be attached perpendicular to the building facade extending up to four feet from the frontage line and not exceeding three feet in vertical dimension, including all mounting brackets and hardware, and shall be set back a minimum of two feet from the corner of the building or storefront.
      2. b.
        Clearance: The bottom of the pedestrian blade sign shall be a minimum of eight feet above the ground surface when projecting over a private or public right-of-way (i.e. walkway or road).
      3. c.
        Maximum number of signs:
        1. 1.
          One pedestrian sign is permitted for each business with an entrance door at the sidewalk level.
        2. 2.
          Multiple businesses sharing a single entrance door are allowed only one shared sign.
      4. d.
        Illumination: The illumination of pedestrian blade signs shall be directed toward the sign face only.
      5. e.
        Sign design requirements: Shall comply to standards found in subsection 94-108(f)(4).
      6. f.
        Installation requirements: Shall comply to standards found in subsection 94-108(f)(5).
  • b.
    Signs permitted in CC-2 district. When provided, signage for residential uses in CC-2 districts shall adhere to the requirements of section 94-407(2). Signage for all other permitted uses shall adhere to the requirements of section 94-408(a), but shall not exceed 48 square feet in size.
  • c.
    Size restrictions for signs facing Flagler Drive. Whereas the eastern city limits of the city is that body of water known as Lake Worth, and whereas the city has constructed a scenic drive along Lake Worth known as Flagler Drive, and whereas the city desires to promote, protect and enhance the scenic and natural beauty of Flagler Drive and its relationship to adjacent areas and Lake Worth, therefore, on all commercially zoned property having frontage on Flagler Drive, signs shall be permitted as allowed by this article; however, the allowable sign area shall be limited to 50 percent of that otherwise permitted by this article.
  • d.
    Signs permitted in general commercial (GC). Signs permitted in the general commercial (GC) district shall be as follows:
    1. 1.
      Wall mounted signs. The requirements for wall mounted signs shall be as follows:
      1. a.
        Content: the name, logo and address of the building and building occupant to which the sign is accessory and other related information. In addition, signs permitted pursuant to this subsection may contain any noncommercial message which has not been declared by a court of competent jurisdiction to be obscene, defamatory or otherwise contrary to law.
      2. b.
        Maximum sum total area of all signs mounted on the front facade of a building: area shall be as set forth in section 94-409 if there is only one sign on the street facade, and two percent less than the area designated in section 94-409 for each sign more than two on the front street facade.
      3. c.
        Maximum sum total area of all signs mounted on facade other than front facade: area shall be 50 percent of the area set forth in section 94-409, if there is only one sign on a facade, and two percent less than 50 percent of the area designated in the building facade sign area table for each sign more than two on the facade.
      4. d.
        Maximum number for each building: one sign for each individual business occupant of the building, plus two additional signs.
      5. e.
        Maximum height: no higher than the building wall on which it is mounted.
    2. 2.
      Low freestanding signs. The requirements for low freestanding signs shall be as follows:
      1. a.
        Content: the name, logo and address of the building and building occupants to which the sign is accessory and other related information. In addition, signs permitted pursuant to this section may contain any noncommercial message that has not been declared by a court of competent jurisdiction to be obscene, defamatory, or otherwise contrary to law.
      2. b.
        Maximum sum total area of all low freestanding signs on front street shall be the larger of either:
        1. 1.
          1.25 square feet for each one linear foot of front street frontage of the lots on which located; or
        2. 2.
          Two times the area permitted, but not utilized for high freestanding signs under the provisions of subsection (d)(3) of this section.
      3. c.
        Maximum sum total area of all low freestanding signs on side street frontage shall be the larger of either: 0.75 square feet for each one linear foot of side street frontage, or two times the area permitted but not utilized for high freestanding signs under the provisions of subsection (d)(3) of this section.
      4. d.
        Maximum number of all low freestanding signs on each lot: one sign for each individual business occupant on the lot, to a maximum of three signs.
      5. e.
        Minimum setbacks:
        1. 1.
          From lot line of another lot: 24 feet.
        2. 2.
          From public right-of-way line: five feet.
        3. 3.
          From intersections of streets with other streets and with access drives: as required by subsection 94-305(e).
      6. f.
        Maximum height: ten feet.
    3. 3.
      High freestanding signs. the requirements for high freestanding signs shall be as follows:
      1. a.
        Content: the name, logo and address of the building and building occupants to which the sign is accessory and other related information. In addition, signs permitted pursuant to this section may contain any noncommercial message that has not been declared by a court of competent jurisdiction to be obscene, defamatory or otherwise contrary to law.
      2. b.
        Maximum sum total area of all high freestanding signs along front street right-of-way lines which are not opposite residential uses: oe square foot for each one linear foot of frontage.
      3. c.
        Maximum sum total area of all high freestanding signs along front right-of-way lines which are not front street right-of-way lines and which are opposite residential uses: 0.50 square feet for each one linear foot of frontage.
      4. d.
        Maximum sum total area of all high freestanding signs along front street of other public right-of-way lines which are opposite residential uses: 0.25 square feet for each one linear foot of frontage.
      5. e.
        Maximum number of all high freestanding signs on each street frontage: no signs for the first 75 linear feet of street frontage; one sign for each additional 75 feet or fraction thereof of street frontage. Frontage on each street shall be considered separately in determining if this requirement is met.
      6. f.
        Minimum setbacks:
        1. 1.
          From lot line of another lot: 24 feet.
        2. 2.
          From public right-of-way line: five feet, except that in the triangular area made by the intersection of two public right-of-way lines and a line connecting points on each line 20 feet from the point of intersection, one freestanding sign may be erected provided the lot on which it is erected qualifies for a high freestanding sign under the area and number provisions of this subsection (d)(3)f.2. Signs so located shall conform to the provisions of subsection 94-305(e).
        3. 3.
          From other high freestanding signs on same lot: 75 feet measured from the grade level of the land where the sign is positioned.
        4. 4.
          From utility poles which support electrical transmission lines: eight feet.
      7. g.
        Maximum height:
        1. 1.
          For automobile filling stations located within 750 feet of a four-ramp I-95 interchange or within 1,000 feet of a clover leaf-type ramp at an I-95 interchange: 60 feet.
        2. 2.
          For all other nonresidential uses: 30 feet.
        3. 3.
          The height of above permitted signs shall be measured at grade level of land where sign is to be positioned.
    4. 4.
      Time and temperature signs. Signs giving time and temperature information shall be permitted when attached to or made part of an otherwise permitted sign. Such signs shall not be larger than 25 percent of the permitted or of the sign to which they are attached. Such signs shall be counted as part of the permitted area of the sign to which they are attached.
    5. 5.
      Window signs advertising special sales, events or services. Signs pertaining to special sales, events or services may be affixed to the inside of a window for not more than 30 days provided that their total area does not exceed 25 percent of the window area.
    6. 6.
      Temporary signs and displays announcing the opening of a new business or the change in ownership of an established business. Temporary signs and displays announcing the opening of a new business or the change in ownership of an established business or the change in ownership of an established business shall be permitted in addition to other signs which may be permitted on the lot where located. Such signs shall not remain in place for more than 30 days commencing immediately upon the opening of a new business or the change of ownership of an established business. On lots with more than one business establishment, no signs or displays shall be permitted under the provision of this section. Signs established pursuant to this section shall not be subject to the prohibition of portable signs set forth in subsection 94-402(b)(9).
    7. 7.
      Temporary balloon type signs. The following regulations shall apply to all temporary balloon signs:
      1. a.
        The leading edge of the balloon on the ground shall be set back a minimum of 15 feet from all base building lines;
      2. b.
        The balloon itself shall be no higher than 30 feet from the base to the top and no more than 30 feet in width;
      3. c.
        If placed on a building, the balloon shall only be on one- or two-story buildings and maximum height shall not exceed 60 feet from the ground;
      4. d.
        Balloons shall be erected no closer than 500 feet in any direction from any other legally permitted balloon;
      5. e.
        No parcel or development shall be issued more than four permits in any calendar year. The maximum duration of any permit shall be for ten days. There shall be 30 days between subsequent permits from the day the balloon is removed;
      6. f.
        Balloons shall not be located in any required vehicular use area and shall comply with the parking code and all other city codes;
      7. g.
        Only cold air shall be used in the balloons, no hazardous gas or hot air;
      8. h.
        No balloon shall be allowed in any right-of-way; and
      9. i.
        A copy of the following shall be provided to the planning department for processing the permit application:
        1. 1.
          Legal description and address of location;
        2. 2.
          Written permission of property owner or owner's designated agent;
        3. 3.
          Occupational license;
        4. 4.
          Liability and property damage insurance;
        5. 5.
          Copy of a survey or site plan showing the location of the balloon, centerline of any right-of-way and demonstrating compliance with these regulations; and
        6. 6.
          A photograph of the balloon.
    8. 8.
      Manual changeable copy signs. Changeable copy information signs shall be permitted when attached to or made part of an otherwise permitted sign. Such signs shall be limited to two manual changeable copy message signs per parcel and shall be counted as part of the permitted area of the sign to which it is attached.
    9. 9.

      Wall mounted signs. The requirements for wall mounted signs shall be as follows:
      1. a.
        Content: the name, logo and address of the building and of the occupants of the building which the sign is accessory, and other related information. In addition, signs permitted pursuant to this section may contain any noncommercial message which has not been declared by a court of competent jurisdiction to be obscene, defamatory or otherwise contrary to law.
      2. b.
        Maximum sum total area of all signs mounted on the front facade of a building: 100 percent of the area permitted by section 94-409.
      3. c.
        Maximum sum total area of all signs mounted on a facade other than front facade: 50 percent of the area permitted by section 94-409.
      4. d.
        Maximum number on each building: one sign for each individual business occupant of the building, plus two additional signs.
      5. e.
        Maximum height: no higher than the building wall on which it is mounted.
    2. 2.
      Low freestanding signs. The requirements for low freestanding signs shall be as follows:
      1. a.
        Content: the name, logo and address of the building and building occupants to which the sign is accessory and other related information. In addition, signs permitted pursuant to this section may contain any noncommercial message which has not been declared by a court of competent jurisdiction to be obscene, defamatory, or otherwise contrary to law.

        2. b.
          Maximum sum total area of all signs mounted on the front facade of a building: 75 percent of the area permitted by section 94-409.
        3. c.
          Maximum sum total area of all signs mounted on a facade other than front facade: 75 percent of the area permitted by section 94-409.
        4. d.
          Maximum number on each building: one sign for each individual business occupant of the building, plus two additional signs.
        5. e.
          Maximum height: no higher than the building wall on which it is mounted.
      2. 2.
        Low freestanding signs. The requirements for low freestanding signs shall be as follows:
        1. a.
          Content: the name, logo and address of the building and building occupants to which the sign is accessory and other related information. In addition, signs permitted pursuant to this section may contain any noncommercial message that has not been declared by a court of competent jurisdiction to be obscene, defamatory, or otherwise contrary to law.
        2. b.
          Maximum sum total area of all low freestanding signs on front street: one square foot for each one linear foot of front street frontage of the lots on which located.
        3. c.
          Maximum number of all low freestanding signs on side street frontage: 0.50 square feet for each one linear foot of front street frontage of the lots on which located.
        4. d.
          Maximum number of all low freestanding signs on each lot: one sign for each individual business occupant on the lot to a maximum of three signs.
        5. e.
          Minimum setbacks:
          1. 1.
            From lot line of another lot: 24 feet.
          2. 2.
            From public right-of-way line: five feet.
          3. 3.
            From intersections of streets with other streets and with access drives: as required by subsection 94-305(e).
        6. f.
          Maximum height: ten feet.
      3. 3.
        Manual changeable copy signs. Changeable copy information signs shall be permitted when attached to or made part of an otherwise permitted sign. Such signs shall be limited to two manual changeable copy message signs per parcel and shall be counted as part of the permitted area of the sign to which it is attached.
    2. g.
      Gasoline price and essential directional signs for service stations.
      1. 1.
        Gasoline price signs (manual or electronic). One gasoline price sign shall be permitted per gasoline station. It shall be affixed to a permanent sign structure or to a building and shall not be located closer than 20 feet to any side property line. The price sign shall be included in the total area of signage otherwise permitted and shall be permitted to change their price no more than four times within a 24-hour period. Prohibited lighting for electronic price signs shall include; lamps or bulbs in excess of 30 watts, exposed reflectorized lamps or bulbs, lamps or bulbs not covered by a lens, filter or sunscreen and lamps or bulbs that scroll, flash, zoom, twinkle or sparkle.
      2. 2.
        Essential directional signs. Signs providing information needed for motorists to locate the proper service station pump site shall be permitted. Such signs shall include those identifying the type of fuel sold at individual service station pumps, the location of full-service and self service pump islands, and other similar information. Such signs shall be of a size which can be seen by motorists once on the site but shall not be sized to attract attention of motorists on public rights-of-way.
    3. h.
      Sign plan requirements. Sign permits shall be issued only for signs which conform to an approved sign plan for the lot on which the sign is located. Sign plans shall be approved pursuant to the site plan review process. Sign plans may be submitted and approved concurrently with the initial site plan for a lot, or they may be submitted and approved as an amendment to the approved on a site plan. Sign plans shall be approved on a finding that all signs will conform to the provisions of this article and that the graphic style, materials, placement and other characteristics of all signs on the parcel will be coordinated.

    Sec. 94-410. - Murals.

  • a.
    A mural may be located anywhere in the city provided it is first approved by permit issued by the city building official in accordance with the procedures and criteria listed in this section.
  • b.
    An application for a mural permit shall be filed with the city building and zoning department and shall include:
    1. 1.
      The name of the artist;
    2. 2.
      Description of the materials to comprise the mural and manner of application;
    3. 3.
      A statement regarding the durability of the materials considering the location and positioning of the mural; and
    4. 4.
      Plans for installation of the mural, including the need for scaffolding, and/or other equipment to be attached to the building.
  • c.
    Upon receipt of a complete application, the city building official shall review the application materials to determine that:
    1. 1.
      The plans for installation of the work is reasonable;
    2. 2.
      Excessive maintenance should not be required; and
    3. 3.
      The materials to be used and the manner of application will not impact or harm neighboring properties, the public or the environment.
  • and shall, upon making such determinations, issue a mural permit. Absent such a determination, the building official shall deny the application. The building official may consult with other city staff to obtain information needed to make the determinations.

    1. d.
      Any person aggrieved by the decision of the building official may appeal such decision within 15 days thereof to the city commission which shall apply the standards set forth in this section in reviewing the decision of the building official. The city commission may affirm, reverse or reverse with modifications the decision of the building official. The decision of the city commission shall be final.
