ARTICLE XVII

MUNICIPAL WELLHEAD PROTECTION

Sec. 32-516.- Description of district.

The limits of the municipal wellhead protection (MWP) district are hereby defined to be all areas within a 250-foot radius of the city's municipal water supply wells. The district establishes measures to protect the quality of the present and future water supply of the city. Because these protective measures allow some latitude with land uses and because the district is not intended to prescribe a specific land use, but rather to define a range of acceptable land uses, the municipal wellhead protection district is designed as an overlay district. Within the range of land uses which can be located within the district, this article establishes performance standards which apply to development within the district. Unless otherwise noted, the regulations of the underlying zoning district shall be maintained and not affected.

Sec. 32-517. - Intent.

The intent of the regulations within this zoning district is to limit the use of such sensitive lands to:

(1)

Provide essential and adequate supplies of drinking water in order to provide for the health, safety, and welfare of the public and to continue to have a healthy economic climate.

(2)

Protect the quality of groundwater that supplies wells which contribute drinking water to the public water supply system.

(3)

Minimize danger to public health by avoiding certain land uses and developments connected with the increased incidence of groundwater contamination.

Sec. 32-518. - Conditions and performance standards.

Within the municipal wellhead protection district, the following conditions and performance standards shall apply, in addition to the regulations of the original district on which the municipal wellhead protection district is superimposed:

(1)

New septic tanks and drainfields are prohibited.

(2)

New facilities which handle, treat, store, or dispose of petroleum products, hazardous waste, or hazardous materials are prohibited.

(3)

New animal feedlots, poultry enclosures, or animal enclosures are prohibited (this does not apply to family pets).
