ZONING DISTRICTS AND MAP

10-3-1: DISTRICTS ESTABLISHED:

For the purpose and provisions of this title, the village is hereby divided into the following districts:

10-3-2: ZONING MAP:

The boundaries of the zoning districts are established as shown on the map entitled "zoning map of the village of Winfield, Illinois", which map, as amended, is the official zoning map of the village and is made a part hereof, and shall have the same force and effect as if the zoning map, together with all notations, references and other information shown thereon were fully set forth and described herein. 10-3-3: DISTRICT BOUNDARIES:

When uncertainty exists with respect to the boundaries of the various districts as shown on the zoning map, the following rules shall apply:
   A.   District boundary lines are either the centerline of railroads, highways, streets, alleys or easements, or the boundary lines of sections, quarter sections, divisions of sections, tracts of lots of such lines extended otherwise as indicated.
   B.   In areas not subdivided into lots and blocks, wherever a district is indicated as a strip adjacent to and paralleling a street or highway, the depth of such strips shall be in accordance with the dimensions shown on the maps measured at right angles from the centerlines of the street or highway, and the length of frontage shall be in accordance with dimensions shown on the map from sections, quarter section or division lines, or centerlines of streets, highways or railroad rights of way unless otherwise indicated.
   C.   Where a lot held in one ownership and of record on the effective date hereof is divided by a district boundary line, the entire lot shall be construed to be within the more restricted district. (Ord. 2010-04-07, 4-1-2010)

10-3-4: ZONING OF PUBLIC WAYS, WATERWAYS AND RAILROAD RIGHTS OF WAY:

All streets, alleys, public ways, waterways and railroad rights of way, if not otherwise specifically designated, shall be deemed to be in the same zone as the property immediately abutting on such streets, alleys, public ways and railroad rights of way or waterways. Where the centerline of a street, alley, public way, waterway or railroad right of way serves a district boundary, the zoning of such areas, unless otherwise specifically designated, shall be deemed to be the same as that of the abutting property up to such centerline. 10-3-5: ZONING OF ANNEXED AREAS:

   A.   Territory annexed to the village shall be automatically zoned as R-1B single-family residence district effective immediately upon annexation unless a different zoning classification has been established by an annexation agreement duly executed in accordance with 65 Illinois Compiled Statutes 5/11-15-1 and a public hearing has been held in accordance with the procedure set forth in chapter 11 of this title.
   B.   If a change in zoning classification, special use or variation is desired subsequent to annexation and no annexation agreement applies, then the zoning change can only be accomplished in accordance with the procedure set forth in chapters 10 and 11 of this title. 10-3-6: REZONING OF PUBLIC AND SEMIPUBLIC AREAS:

An area indicated on the official zoning map as a public park, recreation area, public school site, cemetery or other similar open space, including those areas approved as part of the final plan for a planned development, shall not be used for any other purpose than that which is designated by the map. The village board may, upon recommendation by the plan commission, approve an amendment to a planned development to discontinue an approved use and allow for other uses only if the proposed amendment meets one or more of the criteria required for an amendment to an approved planned development special use under section 10-10-4 of this title.
