CHAPTER 7

INDUSTRIAL DISTRICTS

10-7-1: USES TO BE ENCLOSED:

All uses, except off street parking spaces for vehicles in operable condition and off street loading and unloading berths shall be within completely enclosed buildings. No outdoor storage or operation is permitted. (Ord. 2010-04-07, 4-1-2010)

10-7-2: PERFORMANCE STANDARDS:

Any use established in an industrial district shall be operated in such a manner as to comply with applicable performance standards as hereinafter set forth governing noise, smoke, particulate matter, toxic or noxious matter, odors, fire and explosive hazards, or vibration, glare or heat; and no use shall be so altered or modified as to conflict with such applicable performance standards. Certification from a testing laboratory, approved by the board of trustees, indicating compliance with the applicable performance standards shall accompany application for a building permit.
   A.   Noise: Sound levels shall be measured with a sound level meter and associated octave band filter manufactured according to standards prescribed by the American Standards Association. Measurements shall be made in using the flat network of the sound level meter, and shall include continuous noise and those noises which cause rapid fluctuations of the needle of the sound level meter with a variation of no more than plus or minus two (±2) decibels. Noises incapable of being measured shall be measured with the impact noise meter manufactured according to standards prescribed by the American Standards Association, and shall comply with the applicable performance standards for noise.
At no point, either on the boundary of a residence or business district or at one hundred twenty five feet (125') from the nearest property line of a plant or operation, whichever distance is greater, shall the sound pressure level of any individual operation or plant (other than background noises produced by sources not under control of this title such as the operation of motor vehicles or other transportation facilities) exceed the decibel levels in the designated octave bands shown in the following table:

   B.   Vibration: No testing or research or other activity on the lot shall cause at any time ground transmitted vibrations in excess of the limits set forth below. Vibration (the periodic displacement, measured in inches, of earth) shall be measured at any point along a residence district boundary line with a three (3) component measuring instrument approved by the board of trustees and shall be expressed displacement in inches.

   C.   Smoke And Particulate Matter: The emission of smoke or particulate matter in such manner or quantity as to endanger or to be detrimental to the public health, safety, comfort or welfare is hereby declared to be a public nuisance and shall be unlawful.
For the purpose of grading the density of smoke, the Ringelmann chart, published and used by the United States school of mines, shall be employed. The emission of smoke or particulate matter of a density greater than no. 2 on the Ringelmann chart is prohibited at all times except as otherwise provided hereinafter:
      1.   Particulate Matter:
         a.   The emission from all sources within any lot area of particulate matter containing more than ten percent (10%) by weight of particles having a particle diameter larger than forty four (44) microns is prohibited.
         b.   Dust and other types of air pollution, borne by the wind from such sources as storage areas, yards, roads and the like, within lot boundaries, shall be kept to a minimum by appropriate landscaping, paving, fencing or other acceptable means. Emission of particulate matter from such sources in excess of the weight limitation heretofore specified is prohibited.
      2.   Smoke: The emission of more than eight (8) smoke units per hour per stack is prohibited, including smoke of a density in excess of Ringelmann no. 2. However, during one 1-hour period in each twenty four (24) hour day, each stack may emit up to sixteen (16) smoke units when blowing soot in cleaning fires. Only during fire cleaning periods, however, shall smoke of Ringelmann no. 3 be permitted, and then for not more than three (3) minutes.
   D.   Toxic Or Noxious Matter: No use shall, for any period of time, discharge across the boundaries of the lot wherein it is located toxic or noxious matter in such concentrations as to be detrimental to or endanger the public health, safety, comfort or welfare or cause injury or damage to property or business.
   E.   Odors: The emission of odorous matter shall be controlled in accordance with the nuisance ordinance of the village.
   F.   Fire:
      1.   The storage or utilization of solid materials or products with the potential for incombustible to moderate burning is permitted.
      2.   The storage or utilization of solid materials or products with the potential for free or active burning is permitted, provided the following conditions are met:
         a.   Said materials or products shall be stored or utilized within completely enclosed buildings or structures having incombustible exterior walls and handled in accordance with the standards and regulations of the village and the national fire protection association 1 .
         b.   All such buildings shall be set back at least forty feet (40') from all lot lines or in lieu thereof, shall be protected throughout by an automatic fire extinguishing system installed in accordance with the standards and requirements of the village and the national fire protection association.
      3.   The storage or utilization of flammable liquids or materials which produce flammable or explosive vapors shall be permitted in accordance with the following limitations, exclusive of storage in underground tanks and exclusive of storage of finished products in the original sealed containers:
         a.   Said materials or products shall be stored or utilized within completely enclosed buildings or structures having incombustible exterior walls and handled in accordance with the standards and regulations of the village and the national fire protection association.
         b.   All such buildings shall be set back at least forty feet (40') from all lot lines or in lieu thereof, shall be protected throughout by an automatic fire extinguishing system installed in accordance with the standards and regulations of the village and the national fire protection association.
         c.   The capacity of flammable liquids in excess of the following quantities shall not be permitted:

   G.   Glare Or Heat: Any operation producing intense glare or heat shall be performed within a completely enclosed building in such a manner as not to create a public nuisance or hazard along lot lines. (Ord. 2010-04-07, 4-1-2010)

10-7A-1: PURPOSE:

The purpose of the L-1 limited industrial district is to permit and control the development of industry within Winfield, to create jobs, to enhance the tax base and to implement the policy of the comprehensive development plan 1 . (Ord. 2010-04-07, 4-1-2010)

10-7A-2: PERMITTED USES:

Accessory uses in accordance with the provisions of section 10-2-7 of this title.
Automobile repair, major or minor.
Blueprinting and photocopying establishments.
Light machinery production; appliances, business machines, etc.
Offices.
Printing and publishing establishments.
Research laboratories.
Schools, including commercial or trade.

10-7A-3: SPECIAL USES:

The village board, upon recommendation of the plan commission, may grant a special permit to allow light manufacturing establishments, warehouses and wholesale establishments which meet the performance standards, and which it finds to be compatible with any residential uses in the area, and also which it finds will not cause automobile or truck traffic in proportions detrimental to residences in the area. Additional permitted special uses include the following:
Kennel, commercial or noncommercial.
Planned developments.
Recreation facility; commercial, institutional, or public.
Utility and other public service uses limited to the following:
Electric substations and distribution centers.
Fire and police stations.
Gas regulator stations.
Libraries, public.
Telephone exchanges, microwave relay towers and telephone transmission equipment buildings.
Wells, pumping stations, water reservoirs, and water towers. (Ord. 2010-04-07, 4-1-2010; amd. Ord. 2011-02-04, 2-17-2011)

10-7A-4: OFF STREET PARKING AND LOADING:

Parking and loading facilities shall be provided as required or permitted in chapter 9 of this title. (Ord. 2010-04-07, 4-1-2010)

10-7A-5: YARD AREAS:

   A.   Front Yard: Not less than forty feet (40') in depth.
   B.   Side Yards: Not less than ten feet (10'). Each side yard shall be increased five feet (5') for each story over one.
   C.   Rear Yard: Not less than twenty feet (20') in depth; except, a rear yard abutting on a railroad right of way shall be reduced to a minimum of five feet (5') in depth.
   D.   Transitional Yards: Where the L-1 district abuts a residence district, transitional yards shall be provided in accordance with the following regulations:
      1.   Where a side lot line coincides with a side or rear lot line of property in an adjacent residence district, a side yard of fifteen feet (15') shall be required.
      2.   Where a rear lot line coincides with a side lot line of property in an adjacent residence district, a rear yard of twenty feet (20') shall be required.
      3.   Where a rear lot line coincides with a rear lot line of property in an adjacent residence district, a yard shall be provided along such rear lot line. Such yard shall be forty feet (40') in depth.
      4.   Transitional yards shall be unobstructed from the lowest level to the sky, except as may be allowed in chapter 2 of this title. (Ord. 2010-04-07, 4-1-2010)

10-7A-6: BUILDING HEIGHT:

   A.   Maximum Height: Not more than two (2) stories or forty feet (40'), whichever is lower.
   B.   Special Use: Maximum height limitations shall be specified with the granting of a special use permit. (Ord. 2010-04-07, 4-1-2010)

10-7A-7: SIGNS:

All signs shall comply with the provisions of title 9, chapter 3 of this code, unless specifically exempted in accordance with the provisions of this title. (Ord. 2010-04-07, 4-1-2010)
