Word Usage

Sec. 7-A-1 Rules of Construction

  • "Shall," "will," "should," and "may."
    1. The words "shall" and "will" are mandatory.
    2. The words "should" and "may" are discretionary.  
  • Representative of the Town. Any office referred to in this UDC by title means the person employed or appointed by the Town in that position, or his duly authorized representative, and includes any person designated to perform the duties of such office.
  • Customary Usage. Definitions not expressly prescribed in this UDC are to be construed in accordance with customary usage in municipal planning practice.
  • Private Agreements. The UDC is not intended to repeal, abrogate, or impair any existing easements, covenants, or deed restrictions.
  • Interpretation. In the interpretation and application of this UDC, all provisions shall be:
    1. Considered as minimum requirements;
    2. Liberally construed in favor of the Town; and
    3. Deemed neither to limit nor repeal any other powers granted under state statutes.

    Abandonment
    Abandonment means to cease or discontinue a use or activity without the intent to resume, and an overt act or failure to act, but excluding temporary or short-term interruptions of a use, e.g., the change of tenancy or ownership, or activity during periods of remodeling, maintaining, or otherwise improving or rearranging a facility, or during normal periods of vacation or seasonal closure.

    Accessory Dwelling Unit (ADU)
    Accessory Dwelling Unit (ADU) means a residential dwelling unit, but not a mobile home or recreational vehicle, located on the same lot as a single-family dwelling unit, either within the same building as the single-family dwelling unit or in a detached building. The unit has a separate entryway, kitchen, and bathroom facilities.

    Accessory Structure
    Accessory Structure means a subordinate building or structure on the same property and not attached to the primary unit. Examples of accessory buildings include storage sheds, gazebos, detached carports, and detached residential garages.

    Accessory Use
    Accessory Use means a use incidental to and customarily associated with a specific principal use, located on the same lot or parcel.

    Adjacent
    Adjacent means to physically border a lot line. The term does not include properties that are separated by a public right-of-way such as a street.

    A
    Adult Daycare means a facility operating less than 24 hours a day caring for individuals who, due to functional impairment, need supervision of or assistance with activities of daily living.

    A
    Adult Entertainment Business means a business which as a part of or in the process of delivering goods and services displays to its patrons specified sexual activities, specified anatomical areas through the use of adult media or male or female models, or offers for sale sexually oriented toys or novelties. The following are examples of adult entertainment business but the list is not to be considered exclusive:

    • Adult media store;
    • Adult motion picture theater;
    • Adult internet store;
    • Sex shop;
    • Video-viewing booth;
    • Lingerie modeling studio or model studio; and 
    • Escort service bureau.

    Advertising Device
    Advertising Device means any balloon, flag, pennant, propeller; any oscillating, rotating, or pulsating light; or other contrivance except a sign, used to attract attention for the purpose of promoting the sale of products.

    Advertising Statuary
    Advertising Statuary means any imitation, representation or similitude of a person or thing that is sculptured, molded, modeled in, or cast from any substance, material, or fabric, which is used for commercial purposes.

    Advertising Structure
    Advertising Structure means any structure erected for advertising purposes, with or without any advertisement display thereon, situated upon or attached to real property, upon which any poster, bill, printing, painting, device or other advertisement may be placed, posted, painted, tacked, nailed or otherwise fastened, affixed, or displayed, provided, however, that said term shall not include buildings.

    Affordable Housing
    Affordable Housing means a lot or unit deed restricted with a covenant approved by the Town Council.

    Agricultural
    Agricultural means a use category containing nonresidential uses primarily related to the raising of animals and crops that do not exceed the threshold for concentrated or intensive animal feeding operations. The use category includes: crop production; nursery (retail); stables; and animal, crop, and farm equipment storage.

    A
    Airport or Heliport means an area of land or water or a structural surface which is used for the landing and takeoff of airplanes and / or helicopters, and any appurtenant areas which are used for fueling, maintenance, repairs, storage, buildings, and other airport or heliport facilities.

    Alley
    Alley means a dedicated public right-of-way that affords a secondary means of access to abutting property.

    Alteration
    Alteration means any act or process that changes one (1) or more of the architectural features of a site or structure, including, but not limited to, the erection, construction, reconstruction, or removal of any structure.

    A
    Amphitheater or Outdoor Performance Venue means an open-air facility or building with tiers of seats for spectators used for sports, performances, lectures, or other recreational or cultural events.

    Animal, Crop, and Farm Equipment Storage
    Animal, Crop, and Farm Equipment Storage means a structure designed for the indoor storage of animals (not consisting of a feedlot), harvested crops, and farm equipment.

    Animal Production
    Animal Production means the day-to-day management, housing, raising, boarding, training, or showing of livestock, dairy, or fowl for commercial purposes. Feedlots and slaughterhouses are specifically excluded from this definition.

    Annexation
    Annexation means the process by which land is added to the city by an ordinance or other legal action.

    Apartment
    Apartment means a multi-family building containing five (5) or more dwelling units, excluding a townhouse, with each unit having an entrance to a hallway, stairway, or balcony in common with a minimum of one (1) other dwelling unit.

    Applicant
    Applicant means any person who applies for approval of an administrative, adjudicative, quasi-judicial, or legislative procedure.

    Application
    Application means an application and all accompanying documentation required by this UDC for approval of all applicable administrative, adjudicative, quasi-judicial, and legislative procedures.

    Architectural Features
    Architectural Features means the physical elements of a structure or designed landscape which may include the setting, scale, detailing and decorative elements, size and shape of the structure/landscape or components of the structure/landscape (e.g., roofs, cupolas, windows, doors, fireplaces, stairways, retaining walls, benches, lighting, paths, materials, textures, and colors).

    Area
    Area means the size of a tract of land, lot, building, development, or sign, usually described in terms of square feet or acres.

    Art Gallery and Studio
    Art Gallery and Studio means establishment engaged in the sale, loan, or display of art books, paintings, sculpture, or other works of art.

    Assisted Living Facility
    Assisted Living Facility means any place or facility caring for adult individuals not related within the third degree of relationship to the administrator, operator, or owner by blood or marriage and who, by choice or due to functional impairments, may need personal care and may need supervised nursing care to compensate for activities of daily living limitations and in which the place or facility includes apartments for residents and provides or coordinates a range of services, including personal care or supervised nursing care available twenty-four (24) hours a day, seven (7) days a week, for the support of resident independence.

    Attached (Accessory Building or Structure)
    Attached (Accessory Building or Structure) means  building or structure that is structurally attached to and is an integrated part of, via exterior materials and architectural design, the principal building with wall-to-wall attachment or any permanent roof attachment such as a breezeway.

    Attainable Dwelling Unit
    Attainable Dwelling Unit means a primary or accessory dwelling unit for the purpose of providing attainable housing for residents earning a low to moderate annual income.

    Auto Access
    Auto Access means paved vehicular access from a public ROW whose width is not to exceed twenty-four feet (24') of paved surface. A Highway 40 access will be allowed only if consistent with the Downtown Plan, as amended, and approved by CDOT.

    Automotive Sales and Services
    Automotive Sales and Services means uses that sell, rent, and perform service on automobiles, light trucks, motorcycles, snowmobiles, and all-terrain vehicles, where the inventory is stored for any length of time on-site. The phrase does not include auto body (e.g., collision repair), paint, or upholstery services.

    Awning/Canopy
    Awning/Canopy means a structure partially attached or entirely supported by a wall and which is covered by canvas, cloth, or other similar material used as a protective cover for a door, entrance, window, walkway, or service area.

    Awning Signs
    Awning Signs means a sign that is painted on or otherwise attached to an awning.

    Balcony
    Balcony means an unenclosed platform that projects from or recesses into the wall of a building a minimum of two (2) feet, which is surrounded by a parapet or railing on its open side(s), and which is entirely supported by the building and/or columns. When such platform is both roofed and enclosed, it is considered interior space and is not a balcony.

    B
    Bank or Credit Union means any class of business that provides financial services and the transmission of funds, such as commercial banks, savings and loan associations, credit unions, brokerage offices, insurance companies, and real estate lending institutions.

    Banner
    Banner means a professionally produced strip of cloth, plastic, or similar material affixed to a building or railing which is located outdoors and contains language for advertisement, greeting, or similar messaging purposes.

    Bar or Tavern
    Bar or Tavern means an establishment serving alcoholic beverages in which the principal business is the sale of such beverages at retail for consumption on the premises and where sandwiches and light snacks may also be available for consumption on the premises.

    Base Flood
    Base Flood means the flood having a one percent (1%) chance of being equaled or exceeded in any given year.

    Basement
    Basement means the definition as adopted in the International Building Code and the International Residential Code.

    Bed and Breakfast means a business which provides accommodation to guests for sleeping, eating and bathing in a dwelling unit. The owner, lessee or manager of the bed and breakfast shall reside on the premises. Dwelling units providing this service shall be limited to not more than five (5) sleeping rooms, as defined in the IBC and IRC, of which no more than four (4) may be used for rental purposes.

    Bedroom
    Bedroom means any habitable room with no less than seventy square feet (70 sf.) of floor area and no dimension less than seven feet (7') in a dwelling unit other than bathroom(s), kitchen, living, and dining room. Unless specifically designed to exclude its use as a bedroom (e.g., enlarged entry ways without doors, no windows open to the exterior, etc.), any den, study, or other room meeting the above definition of a bedroom shall be considered a bedroom for the purpose of meeting the standards of this UDC.

    Billboards
    Billboards mean any framework for signs advertising merchandise, services, or entertainment sold, produced, manufactured, or furnished at a place other than the location of such structure.

    Block Face
    Block Face means the section of a block fronting on a street between two (2) intersecting streets or other block boundary.

    Block
    Block means a unit of land enclosed by streets or by a combination of streets, railroad ROW, watercourses, or any other barrier to the continuity of development, and which is subdivided into tracts of land.

    B
    Board of Adjustment (BOA) means a quasi-judicial body, appointed by the Town Council, who may, in appropriate cases and subject to appropriate conditions and safeguards, hear and decide appeals and grant variances, exceptions and limited uses from the terms of this UDC.

    Brewing/Distillery/Winery Production With On-Premise Consumption
    Brewing/Distillery/Winery Production With On-Premise Consumption means a facility used for the production and packaging of beers, meads, hard ciders, and/or similar beverages on‐site for distribution, retail, or wholesale as a brewery, distillery, or winery, which may include on-site consumption, subject to state licensing.

    Bufferyard
    Bufferyard means a unit of land with required landscape and screening improvements located on the perimeter of a property between land uses to eliminate or minimize conflicts and to provide pleasing and functionally appropriate transitions between them.

    BUG Rating
    BUG Rating means a system for rating the backlight, uplight, and glare of lighting fixtures, developed by Illuminating Engineering Society of North America ("IESNA") and detailed in IESNA TM-15-07: Backlight, Uplight, and Glare (BUG) Ratings. BUG ratings for outdoor luminaires are typically available from the manufacturers.

    Buildable Area
    Buildable Area means the area of a lot remaining after all setbacks and easements have been deducted. The buildable area shall be feasible and practical for the intended uses and structures of the zoning district in which the lot is located.

    Building or Development Contractor Storage
    Building or Development Contractor Storage means facilities for building, heating, plumbing, or electrical contractors, and related storage facilities. The site may include an unenclosed portion upon which a contractor maintains an area used to store equipment and other materials customarily used in the trade carried on by the contractor. This definition excludes temporary contractor storage associated with the site of an ongoing construction project.

    Building Coverage
    Building Coverage means the area of a parcel occupied by principal and accessory structures and impervious surfaces (i.e., driveways and sidewalks). Uncovered/unenclosed patios, decks, and porches and eaves (greater than twenty-four inches (24")) are included in the building coverage calculation.

    Building Face
    Building Face means the outer surface of an exterior wall of a building. For example, a building with a rectangular plan has four (4) exterior walls and four (4) building faces.

    Building Height
    Building Height means the vertical distance above a reference datum measured to the highest point of a flat roof or deck line of a mansard roof or the midpoint of the highest gable of a pitched or hipped roof.  The reference datum shall be selected by the following, whichever yields a greater height of a building:

    • The point of the lowest pre-construction elevation on any building face;
    • The point of the lowest post-construction elevation of any building face; or
    • The elevation of the lowest point of an exposed foundation.

    Building Height, Midpoint
    Building Height, Midpoint means the building height measured for a hipped or pitched roof that is halfway between the end of the eave (i.e., the intersection of the fascia board and the top of the roof sheathing) and the top of the roof.

    Building
    Building means any covered structure built for the support, shelter or enclosure of persons, animals, or movable property of any kind, and which is permanently affixed to the land.

    Building Official
    Building Official means the Town's Building Official or his or her designee.

    Building Permit
    Building Permit means an official document issued by the Town which authorizes the construction or siting of any building.

    Building, Principal
    Building, Principal means a building in which the primary use of the lot is conducted. In any residential zoning district, any dwelling unit shall be deemed to be the principal building on the lot on which it is located.

    Bulk Sales
    Bulk Sales means large wholesale sales of a product such as mulch, sand, pebbles, or rock where a single buyer or a small select number of buyers typically buy all or almost all of the inventory that a seller can produce.

    Bus Storage
    Bus Storage means an area established for short- or long-term storage of operable buses.

    Effective on: 6/12/2022

    Business
    Business means any kind of vocation, occupation, profession, enterprise, or establishment, or any and all other kinds of activity and matter, any of which are conducted for private profit or benefit, either directly or indirectly, on any premises within the Town or anywhere else within its jurisdiction, and shall have a current business license issued by the Town.

    Bylaws
    Bylaws means bylaws of the unit or homeowners' association (HOA) or corporation.

    C
    Campground with Overnight Accommodations means a tract of land designed for the temporary (usually one (1) night) use by travel trailers, recreation vehicles, or tents. A campground shall supply toilet and bathing facilities for the guests as essential elements.

    Carport
    Carport means

    Cemetery
    Cemetery means any place, including a mausoleum, niche, or crypt, in which there is provided space either below or above the surface of the ground for the interment of the remains of human or pet bodies.

    C
    Certificate of Occupancy (CO) means a certificate setting forth that a structure complies with this UDC and the building code, and that the structure may be used for the purposes stated therein.

    Changeable Copy Sign
    Changeable Copy Sign means a sign or portion thereof with characters, letters, or illustrations that can be manually changed or rearranged for the purpose of advertising restaurant menus or specials (i.e., dry erase boards and chalkboards).

    Chicken
    Chicken means gallus domesticus. This definition does not include other fowl, such as, but not limited to, peacocks, turkeys, or waterfowl.

    Civic and Institutional Uses
    Civic and Institutional Uses means use category containing uses that provide services to the general public related to recreation, socialization, worship, health, education, and other uses that the Director interprets to be functionally similar to a use in this use category as outlined in Sec. 2-B-1, Use Tables

    C
    Clinic, Medical Lab, or Urgent Care means a facility providing medical, psychiatric, or surgical service for sick or injured persons exclusively on an outpatient basis, including diagnostic services, treatment, training, administration, and services to outpatients, employees, or visitors. The term clinic includes immediate care facilities, where urgent care treatment is the dominant form of care provided at the facility, but does not include hospital, freestanding emergency medical care facility, or state-designated trauma center.

    Club/Lodge
    Club/Lodge means a building in which members of a community or association may gather for social, educational, or cultural activities.

    Cluster Development
    Cluster Development means a design technique in which lots are grouped together, rather than spread evenly throughout a tract of land (as in standard development), which may be due to site constraints or to integrate greenways and common areas throughout the development. Cluster development allows the remaining land to be used for recreation, open space, and the preservation of natural resources.

    College, University, or Vocational School
    College, University, or Vocational School A community college, college, university, vocational, technical or trade school, language school, business school, beauty school, culinary school, training center, and comparable advanced or continuing education facilities.

    Commercial Amusement Use, Indoor
    Commercial Amusement Use, Indoor means uses that provide commercial amusement indoors (except sexually-oriented theater / dancing establishments), including, but not limited to:

    • Bowling alleys;

    • Dance club / dance hall;

    • Game arcades (e.g., video games, skeet ball, and comparable amusement machines)

    • Health and fitness center;

    • Indoor playgrounds (may include conventional playground equipment;

    • Indoor skating rinks (ice or roller);

    • Indoor stadium, movie theater, or live theater;

    • Inflatables;

    • Laser tag;

    • Local area network ("LAN") gaming centers;

    • Pool / billiard rooms;

    • Rock climbing walls;

    • Shooting arcades;

    • Trampolines; and

    • Zip lines, and comparable equipment)

    Commercial Amusement Use, Outdoor
    Commercial Amusement Use, Outdoor means uses that provide commercial amusement outdoors including, but not limited to:

    • Alpine and Nordic ski facilities;
    • Ice skating rinks; 
    • Amphitheaters;
    • Zip line courses, rope courses, and rock climbing; and
    • Outdoor areas with games (e.g., frisbee golf), food service, and incidental retail uses (e.g., souvenir shops) that are subordinate to the principal outdoor entertainment uses.

    The use does not include amusement parks, outdoor recreation or outdoor shooting, archery range, and paintball courses.

    Commission
    Commission means the Planning Commission (PC).

    Common Element, General
    Common Element, General means the land or the interest in the land on which a condominium building or buildings are located; the foundations, columns, girders, beams, supports, main walls, roofs, halls, corridors, lobbies, stairs, stairways, fire escapes, entrances, and exits of such building or buildings; the basements, yards, gardens, parking areas, and storage spaces; the premises for the lodging of custodians or persons in charge of the property; installations of central services such as power, light, gas, hot and cold water, heating, refrigeration, central air conditioning, and incinerating; the elevators, tanks, pumps, motors, fans, compressors, ducts, and in general all apparatus and installations existing for common use; such community and commercial facilities as may be provided for in the declaration; and all other parts of the property necessary or convenient to its existence, maintenance, and safety, or normally in common use.

    Common Element, Limited
    Common Element, Limited means those common elements of a condominium subdivision designated in the declaration as reserved for use by fewer than all the owners of the individual air space units.

    Common Open Space
    Common Open Space means areas of a parcel proposed for development that are used for open space, landscape areas (provided that the area of landscaping is not less than five feet (5') in any dimension), on-site recreation and leisure areas, and naturalized stormwater best management practices (BMPs).

    Community Garden
    Community Garden means a private or public facility for cultivation of fruit, flowers, vegetables, or ornamental plants by more than one (1) person or family.

    Compensatory Mitigation
    Compensatory Mitigation means the restoration, reestablishment, rehabilitation, establishment, creation, enhancement, or preservation of state waters for the purpose of offsetting unavoidable adverse impacts that remain after all appropriate and practicable avoidance and minimization has been achieved.

    Comprehensive Plan
    Comprehensive Plan means the master plan as adopted by the Town Council, as amended.

    Condo-Hotel
    Condo-Hotel means a Hotel or Motel, as defined by this UDC, in which ownership of individual units has been condominiumized in accordance with the Colorado Condominium Ownership Act, C.R.S. § 38-33-101, et seq. Condo-Hotel is considered a commercial use and shall only be occupied by unit owners for a maximum of 90 days in a calendar year.

    Condominium
    Condominium means a system of separate ownership of individual units, of which units own airspace within their unit, with each unit owner entitled to a percentage ownership in the common elements evidenced by the recording of a plat and condominium declaration.

    Condominium Plat
    Condominium Plat means a recorded plat showing the condominium units and common areas. The plat includes both horizontal and vertical measurements of the units, and includes area calculations for the units.

    Consensual Interest of Record
    Consensual Interest of Record means a person or entity that holds a fee or lien interest in the property encompassed by the as-built plat, which was granted or consented to by signature of an owner. The instrument containing the owner's signature is recorded in the land records of the Office of the Grand County Clerk and Recorder. Typical examples of a holder of a consensual interest of record are: the holder of a deed of trust or a mortgage whether created or assumed by the owner; the holder of a deed of trust or a mortgage which the owner took title subject to; or a leaseholder. Typical examples of persons or entities which are not holders of a consensual interest of record are mechanic's lien claimants, the owner of a right-of-way or easement which affects the property; and persons claiming an interest in the property as evidenced by a recorded lis pendens; and persons holding reserved oil, gas or mineral rights in the property.

    Construction means the act of erecting a new principal or accessory structure on a property, or making an addition to an existing structure.

    Construction Trailer
    Construction Trailer means a trailer or other moveable structure that is temporarily used for office space, meeting space, or storage of construction tools and materials associated with a specific construction project.

    Contiguous
    Contiguous means next to, abutting, or touching and having a boundary or portion thereof, which is the same boundary.

    Convenience Signs
    Convenience Signs means signs that display public information for the purpose of convenience or safety, on the door and/or windows.

    C
    Convenience Store and Gasoline Station means any retail establishment offering for sale any combination of fuels, automotive products, prepared or prepackaged food products, household items, and other goods commonly associated with this use. In addition to fueling stations designed for any number of automobiles and similar vehicles, convenience stores with fuel pumps may also include fueling stations designed for no more than three (3) tractor trailers.

    Council means the Town Council (TC) of the Town.

    Covenant means an agreement or promise to do or not to do a particular thing; to enter into a formal agreement, binding oneself in contract, which is either expressed or implied.

    Density means the number of dwelling/accommodation units per gross acre of the development.

    Developer
    Developer means the legal owner or owners of a any land included in a proposed development, or the holder of an option or contract to purchase, or any person having the authority to submit an application for approval of a subdivision under this UDC.

    Development Agreement
    Development Agreement means an agreement, outside of the Town's typical UDC process, between the Town and a person having a legal or equitable interest in real property for the purpose of establishing conditions under which development may proceed.

    Development Improvements Agreement means an agreement which specifies the types of improvements that are required by the Town to be completed, paid for, and guaranteed by the property owner/developer.

    Development
    Development means any constructed change to improved or unimproved real estate, including but not limited to buildings or other structures, filling, grading, paving, excavation or drilling operations or storage of equipment or materials. This does not include activities such as the maintenance of existing buildings and structures such as painting, re-roofing, and resurfacing roads.

    Directional Sign

    Disposal/Recycling Facility means facilities for the disposal of non-nuclear waste or fill, the composting of organic wastes, the collection, sorting and packaging of consumer recyclable materials such as paper, glass, aluminum, ferrous metal cans, and materials of like substances. The term includes landfill and composting facility.

    Disturbed Area
    Disturbed Area means that area of land to be disturbed or altered in any manner, whether temporarily or permanently, as a result of the subdivision of land and the construction of buildings and improvements thereon. This includes, but is not limited to, temporary and permanent roads and trails, disturbance or removal of vegetation, excavation, and the storage of fill materials.

    Dormitory
    Dormitory means a residential building comprised of groups of three (3) or more bedrooms with a shared bathroom and a central kitchen, within which up to fifteen percent (15%) of the total bedrooms may have a private bathroom and kitchen, limited to employee housing from October through May of each year for persons employed in Grand County at the time of occupancy in the Dormitory.

    Erosion and Sediment Control Plan means a set of plans prepared by or under the direction of a licensed professional engineer indicating the specific measures and sequencing to be used to control sediment and erosion on a development site during and after construction.

    Establishment
    Establishment means any legal use of land, other than residential, which involves the use of structures, subject to applicable zoning regulations and building codes.     Finished Grade means the final ground surface elevation after the completion of grading or other site preparation related to a proposed development that conforms to an approved grading permit and/or building permit.

    Flood Insurance Rate Map (FIRM)
    Flood Insurance Rate Map (FIRM) means an official map of the Town, on which the Federal Emergency Management Agency (FEMA) has delineated the Special Flood Hazard Area (SFHA).

    Flood Insurance Study (FIS)
    Flood Insurance Study (FIS) means the official report provided by the Federal Emergency Management Agency (FEMA). The report contains the Flood Insurance Rate Map (FIRM) as well as flood profiles for studied flooding sources that can be used to determine base flood elevations for some areas.

    F
    Flood or Flooding means a general and temporary condition of partial or complete inundation of normally dry land areas from:

    • The overflow of water from channels and reservoir spillways;
    • The unusual and rapid accumulation or runoff of surface waters from any source; or
    • Mudslides or mudflows that occur from excess surface water that is combined with mud or other debris that is sufficiently fluid so as to flow over the surface of normally dry land areas (e.g., earth carried by a current of water and deposited along the path of the current).

    Floodplain Administrator
    Floodplain Administrator means the official designated to enforce the flood hazard reduction standards of this UDC.  The Town has designated the Town Engineer for these duties.

    Floodplain Development Permit
    Floodplain Development Permit means a permit required before construction or development begins within any Special Flood Hazard Area (SFHA). If the Federal Emergency Management Agency (FEMA) has not defined the SFHA within the Town, the Town shall require permits for all proposed construction or other development in the Town including the placement of manufactured homes, so that it may determine whether such construction or other development is proposed within flood-prone areas. Permits are required to ensure that proposed development projects meet the requirements of the National Flood Insurance Program (NFIP) and the floodplain management regulations.

    Floodplain Management means the operation of an overall program of corrective and preventative measures for reducing flood damage, including, but not limited to, emergency preparedness plans, flood control works, and floodplain management regulations.

    Floodway (Regulatory Floodway)
    Floodway (Regulatory Floodway) means the channel of a watercourse and adjacent land areas that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than a designated height. The Colorado statewide standard for the designated height to be used for all newly studied reaches is six inches (6"). Letters of Map Revision (LOMR) to existing floodway delineations may continue to use the floodway criteria in place at the time of the existing floodway delineation.

    F
    Floor Area Ratio (FAR) means a regulation that controls the size of buildings in certain zoning districts.  FAR is the ratio of total building floor area in relation to the area of the lot (see also "gross floor area"). The maximum amount of floor area allowable on a lot is calculated by multiplying the lot area by the allowable FAR.  For example, on a ten thousand (10,000) square-foot lot in a zoning district with a maximum FAR of 0.5, the floor area of a building cannot exceed five thousand (5,000) square feet.

    Freestanding Sign means any detached sign that shall include any sign supported by one (1) or more uprights, braces, poles, or posts placed upon, in, or supported by the ground and not part of, or attached to, any building. This definition includes monument signs and ground signs.

    Frontage means the length of a lot line or lines abutting on a street or a right-of-way (ROW).

    Full Cutoff Fixture
    Full Cutoff Fixture means a luminaire that has no direct uplight (no light emitted above horizontal plane), and that limits one hundred percent (100%) of light output below ninety degrees (90°), and with a maximum of ten percent (10%) of total lumens delivered within the 80° to 90° zone.

    Garden Center means a place of business where retail and wholesale products and produce are sold. The items sold may include, but is not limited to plants, nursery products, potting soil, and gardening tools and utensils.

    Grade means the level of the ground.

    Greenhouse (Personal)
    Greenhouse (Personal) means a temporary or permanent structure typically made of, but not limited to, glass or fiberglass, in which plants are cultivated.

    Gross Floor Area (GFA)
    Gross Floor Area (GFA) means the sum of the total horizontal areas of every floor of every building on a lot. The measurement of gross floor area shall be computed by applying the following criteria:

    • The horizontal square footage is measured from the outside face of all exterior walls.
    • Cellars, basements, penthouses, attics, covered or uncovered porches, balconies and decks, enclosed storage or mechanical areas, mezzanines, and similar structures shall be included as GFA wherever a minimum of seven feet (7') are provided between the finished floor and the ceiling.
    • No deduction shall apply for horizontal areas void of actual floor space (e.g., elevator shafts and stairwells) or the protected upper floors of open atriums and foyers.

    Group Home
    Group Home means any dwelling unit occupied by not more than ten (10) persons and which dwelling unit is licensed by a regulatory agency of Colorado.

    Guarantee
    Guarantee means a form of security, including a cash deposit, surety bond, or instrument of credit in an amount to completely construct or install the designed site improvements. All guarantees shall be approved by the Town Council wherever required by this UDC.

    Health and Fitness Center
    Health and Fitness Center means a commercial exercise or fitness club, sports instruction, swimming instruction, martial arts school, yoga studio, or dance instruction studio operating as a business. This use is classified as a Commercial Amusement, Indoor.

    Highest Adjacent Grade
    Highest Adjacent Grade means the highest natural elevation of the ground surface, prior to construction, immediately next to the proposed walls of the building.

    Historic Structure
    Historic Structure means any structure that is:

    • Listed individually in the National Register of Historic Places (a listing maintained by the U.S. Department of Interior) or preliminarily determined by the Secretary of the Interior as meeting the requirements for individual listing on the National Register;
    • Certified or preliminarily determined by the Secretary of the Interior as contributing to the historical significance of a registered historic district or a district preliminarily determined by the Secretary to qualify as a registered historic district;
    • Individually listed on the Colorado State Register of Historic Properties; or
    • Individually listed on a local inventory of historic places in communities with historic preservation programs that have been certified either means:
      • By an approved state program as determined by the Secretary of the Interior; or
      • Directly by the Secretary of the Interior in states without approved programs.

    Home Occupation
    Home Occupation means a business, profession, occupation, or trade conducted within and subordinate to a dwelling unit.

    Homeowners' Association (HOA)
    Homeowners' Association (HOA) means a private association, governed by a set of covenants and restrictions either compliant with the Colorado Common Interest Ownership Act or subject to an exemption to the provisions thereof.

    Hospital
    Hospital means any building or portion thereof licensed as a hospital by the Colorado Department of Public Health and Environment (CDPHE) and used for diagnosis, treatment, surgery, and care of human ailments, including the usual and customary accessory uses and ancillary offices of a hospital. The term does not mean alcoholism or drug rehabilitation facilities, nor does it mean medical offices.

    Hostel
    Hostel means a facility for residence, on a short-term basis, that provides simple dormitory or sleeping rooms and common rooms for cooking, social, recreational, and educational use; that is characterized and approved by the International Hostel Federation or its national or regional affiliates, or a similar organization; and that is supervised by a resident house manager who directs the guests' participation in the domestic duties and activities of the hostel.

    H
    Hotel or Motel means a building or group of buildings in which six (6) or more guest rooms are used to provide overnight accommodations for transient guests for compensation and provides amenities and services such as small-scale meeting rooms, business centers (personal computers, fax machines, and printers for guest use), food service for guests, and recreational facilities such as swimming pools and health and fitness centers.

    Identification Sign means any sign which serves to identify only the name, address, and lawful use of the activity to which it relates and which sets forth no other advertisement.

    Impervious Area or Surface
    Impervious Area or Surface means the total number of square feet of hard surface area on a given property that either prevents or retards the entry of water into the soil matrix, or causes water to run off the surface in greater quantities or at an increased rate of flow, than it would enter under natural conditions as undisturbed property. Impervious area or surface includes buildings; parking areas; driveways; streets; sidewalks; areas of concrete, asphalt, gravel, or other compacted aggregate; and areas covered by the outdoor storage of goods or materials which do not absorb water.

    Improvement means any building, structure, bridge, parking area, fence, gate, wall, landscaping, or other object constituting a physical addition to real property, or any part of such addition, or the process of installing such additions.

    Industrial, Heavy means a use engaged in the basic processing and manufacturing of materials or products or parts, predominantly from extracted raw materials, or a use engaged in storage of, or manufacturing processes using flammable or explosive materials, or storage or manufacturing processes that potentially involve hazardous or commonly recognized offensive conditions.

    Kennel means any building or lot on which five (5) or more domesticated animals more than six (6) months of age are housed, bred, boarded, trained, or sold.

    Kitchen
    Kitchen means any part of a room or dwelling unit that can be used for the preparation of food that includes one (1) or more of the following: a refrigerator, cooking device, and sink. The following do not constitute a kitchen under this definition: (1) a wet bar; or (2) an ancillary refrigerator that is used solely to store food that is prepared in the kitchen of a dwelling unit.

    Land Development
    Land Development means any human-induced change to improved or unimproved land, including but not limited to construction, installation or expansion of a building or other structure, land division, and site alteration such as that due to dredging, grading, construction of earthen berms, paving, improvements for use as parking or storage, excavation, or clearing.

    Land Use
    Land Use means the occupation or use of land or water area for human activity or any purpose.

    Landowner
    Landowner means any person with fee title to a parcel of land.

    Landscape Surface Ratio (LSR)
    Landscape Surface Ratio (LSR) means the ratio of pervious landscaped surface to a unit of land area. For the purposes of calculating the landscape surface, the pervious surface may be covered with plants, rocks, pebbles, sand, mulch, or another natural material.

    Landscaping
    Landscaping means a permeable ground area, raised or otherwise, consisting of living and maintained trees, shrubs, ground covers, native grasses, and wildflowers. The term does not include areas of rocks, pebbles, sand, mulch, and other non-living materials. See Appendix CRecommended Plant List, for suggested plants.

    Legally Nonconforming
    Legally Nonconforming means a use, structure, lot, or sign that was lawfully built or installed under the regulations as they existed at the time of the construction or installation, however because of ordinances adopted by the Town, the use, structure, lot, or sign would not be able to be lawfully built or installed under the current requirements.

    Library
    Library means a building owned, operated, or occupied by a governmental agency, school, or charitable organization to provide literary, musical, artistic, and reference materials to the public.

    Limited Use
    Limited Use means a use that is allowed in a zoning district, subject to standards that mitigate its impact on other uses in the district or that prevent a concentration of the use in a particular area.

    Live-Work Unit
    Live-Work Unit means a dwelling unit, part of which is used as a business establishment if the dwelling unit is used as the principal residence of the business operator. Typically, the business operation is limited to the first story with the residence to occupy the second story and above.

    Loading Space
    Loading Space means a durably paved space used for loading and unloading from vehicles, except passenger vehicles, in connection with the use of the property on which such space is located.

    L
    Local Streets means Local Road System. See 3.3.2, Local Road System, in the Standards.

    L
    Long-Term Tenancy means rental for a term of a minimum of six (6) months. This is required for an initial lease. Carryover leases may be month-to-month.

    Lot
    Lot means a designated parcel, plot, or area of land established by a subdivision plat to be used, developed or built upon with a building. A lot may not have less than the minimum area and width required by this UDC for the specified zoning district.

    Lot Area means the area of a lot excluding any portion of the right-of-way of any public or private street.

    Lot Depth
    Lot Depth means the distance between the midpoint of the front lot line and the midpoint of the rear lot line.

    Lot Line
    Lot Line means the property line bounding a lot.

    Lot Line, Front
    Lot Line, Front means the lot line separating a lot and a public or private street or access easement.

    • For an interior lot, the lot line separating the lot from the public or private street or access easement.
    • For a corner lot, the shorter lot line abutting a public or private street or access easement. In instances of equal line dimension, the front lot line shall be determined by the Director, or as may be noted on the final plat.
    • For a double frontage lot, the lot lines separating the lot from the public or private street or access easement of the more minor street. In cases where each street has the same classification, the front lot line shall be determined by the Director at the time of application for Site Plan for the lot, or as may be noted on the Final Plat.

    Lot Line, Interior Side
    Lot Line, Interior Side means the lot line that connects the front lot line to the rear lot line, running generally perpendicular radial to a public or private street or access easement.

    Lot Line, Rear shall mean, in the case of:

    • A square or rectangular lot, the lot line opposite and most distant from the front lot line;
    • An irregular or triangular-shaped lot, a line at least ten feet (10') long, parallel to and at the maximum distance from the front lot line.

    Lot Line, Side
    Lot Line, Side means any lot line other than a front or rear lot line.

    Lot Width
    Lot Width means the distance between the side lot lines of a lot, measured at right angles to the lot line establishing the lot depth at the established building setback line. For lots on cul-de-sacs and curved streets, the minimum lot width is measured at the front building setback line along an arc parallel to the right-of-way of the cul-de-sac or curved street.

    Lot, Corner
    Lot, Corner means a lot abutting upon two (2) or more streets or access easements at their intersection.

    Lot, Flag
    Lot, Flag means a lot that is characterized by a strip of land, not less than thirty feet (30') in width, which provides access to the main portion of the lot referred to as the “flag.” The strip of land shall be referred to as the “pole” of the flag lot.

    Lot, Interior
    Lot, Interior means a lot whose side lot lines do not abut upon any public or private street or access easement.

    Lot, Through or Double Frontage
    Lot, Through or Double Frontage means a lot, other than a corner lot, having frontage on two (2) streets or access easements. To determine the front lot line, see Lot Line, Front.

    Lowest Floor
    Lowest Floor means the lowest floor of the lowest enclosed area (including basement). An unfinished or flood resistant enclosure, usable solely for parking of vehicles, building access, or storage in an area other than a basement area is not considered a building's lowest floor; provided that such an enclosure is not built so as to render the structure in violation of the applicable non-elevation design requirements of Section 60.3 of the National Flood Insurance Program regulations.

    Lumen
    Lumen means the unit of measurement used to quantify the amount of light produced by a luminaire. This is distinct from “watt,” a measure of power consumption.

    Luminaire
    Luminaire means a complete lighting unit consisting of a light source and all necessary mechanical, electrical, and decorative parts ready to be mounted on a pole or other location.

    Major or Minor Collector Streets
    Major or Minor Collector Streets means Collector Road System. See 3.3.1, Collector Road System, in the Standards.

    Manufactured Home
    Manufactured Home means a structure constructed on or after June 15, 1976, according to the rules of the United States Department of Housing and Urban Development, transportable in one (1) or more sections, which, when in traveling mode, is eight (8) body feet or more in width or forty (40) body feet or more in length, or, when erected on site is three hundred and twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air-conditioning, and electrical systems. The term does not include a recreational vehicle.

    M
    Manufactured Home Park means a parcel (or contiguous parcels) of land with two (2) or more manufactured home lots for rent or sale.

    Marijuana
    Marijuana means all parts of the plant of the genus cannabis whether growing or not, the seeds thereof, the resin extracted from any part of the plant, and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds, or its resin, including marijuana concentrate, but excluding industrial hemp, fiber produced from the stalks, oil, or cake made from the seeds of the plant, sterilized seed of the plant which is incapable of germination, or the weight of any other ingredient combined with marijuana to prepare topical or oral administrations, food, drink, or other product.

    Marijuana Related Uses
    Marijuana Related Uses means all uses related to the sale, production, testing, and cultivation of marijuana related products and crops.  Including but not limited to:

    • Marijuana Cultivation Facilities;
    • Marijuana Product Manufacturing Facilities;
    • Marijuana Products;
    • Marijuana Stores; and
    • Marijuana Testing Facilities.

    Marijuana Cultivation Facility
    Marijuana Cultivation Facility means an entity licensed to cultivate, prepare, and package marijuana and sell marijuana to marijuana stores, to marijuana product manufacturing facilities, and to other marijuana cultivation facilities, but not to consumers.

    Marijuana Product Manufacturing Facility
    Marijuana Product Manufacturing Facility means an entity licensed to purchase marijuana; manufacture, prepare, and package marijuana products; and sell marijuana and marijuana products to other marijuana product manufacturing facilities and to marijuana stores, but not to consumers.

    Marijuana Products
    Marijuana Products means products that are comprised of marijuana and other ingredients that are intended for use or consumption, including, without limitation, edible products, ointments, and tinctures.

    Marijuana Store means an entity licensed to purchase marijuana from marijuana cultivation facilities and marijuana and marijuana products from marijuana product manufacturing facilities and to sell marijuana and marijuana products to consumers.

    Marquee Sign means a sign utilizing changeable or removable letters and numbers secured in a reader board (track) used for advertisement of regularly changing activities on the premises.

    Master Association
    Master Association means the Winter Park Village Master Association or its appointee.

    Mean Sea Level
    Mean Sea Level means for purposes of the National Flood Insurance Program (NFIP), the National Geodetic Vertical Datum (NGVD) of 1929 or other datum, to which base flood elevations shown on a community's Flood Insurance Rate Map (FIRM) are referenced.

    Medical Office means a use where medical, dental, psychiatric, psychological, chiropractic, and other outpatient services are performed.

    Menu Board
    Menu Board means any display box, freestanding sign, wall sign, or permanent window mounted sign used for the express purpose of displaying menus.

    M
    Message Center means a sign that contains a changing message within the copy area that remains on for a specified minimum period of time and blacks out for a specified minimum period of time between messages.  Messages contained on the sign do not travel or appear to travel in any direction.

    Mini-Warehouse means a building containing small, independent, fully enclosed storage compartments that are leased to persons exclusively for storage of their personal property.

    Minor-Operated Business

    Modular Home
    Modular Home means a dwelling unit that is transportable in one (1) or more sections, designed to be used as a dwelling unit on a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning and electrical systems contained therein. Modular homes are subject to the same codes and regulations as site-built dwelling units.

    Monument
    Monument means permanent concrete or metal markers used to establish all lot lines of the plat of a subdivision, including all lot corners, boundary line corners, and points of change in street or access easement alignment.

    Monument Sign
    Monument Sign means any freestanding sign that includes an architecturally designed base or column that is constructed of stone, brick or timbers, or other similar material, and is designed to be architecturally compatible with the design of the project.

    Multiple-Use Facility
    Multiple-Use Facility means any building that is occupied by more than one (1) legal and distinct business (see Business, Primary and Business, Secondary (reserved definitions)).

    Multiple Use Facility Identification Signs means any sign identifying a multiple-use facility and the tenants therein.

    Multiplex
    Multiplex means a multifamily building that is designed to resemble a large single-family detached home, which includes three to four (3-4) individual dwelling units. Units may have either private or shared access and may be arranged in a variety of configurations, including side-to-side or over-under.

    Mural means any painted design which covers all or a major portion of a wall, building façade, or other structure for the purpose of displaying an art piece, and not meant for the purpose of advertising.

    Neon Sign means a sign in which a colorless, odorless, primarily inert gaseous element known as "neon" is found and produces illumination.

    New Construction means for the purpose of determining insurance rates, structures for which the "start of construction" commenced on or after the effective date of an initial firm or after December 31, 1974, whichever is later, and includes any subsequent improvements to such structures.     Open Space means all areas of a parcel proposed for development that are open from ground to sky and are used for bufferyards, resource protection, outdoor recreation, and leisure areas with permeable ground surfaces, naturalized stormwater best management practices, and vegetative landscaping, except landscape areas that:

    1. Are used to reduce the depth of a parking stall;

    2. Are less than five feet (5') in any dimension; and/or

    3. Are in a residential subdivision and are allocated to private yards.

    Outdoor Recreation means uses that provide recreational opportunities outdoors for the public or residents of a subdivision or development, which are generally not commercial in nature (except for golf courses and ski slopes, which may be commercial in nature). The phrase "recreation, outdoor" includes areas for active or passive recreational activities including, but not limited to:

    • Jogging, cycling, fitness trails, playing fields, playgrounds, outdoor swimming pools, and tennis courts;
    • Golf courses (regardless of ownership or membership);
    • Ski slopes;
    • Arboretums, wildlife sanctuaries, forests, and other natural areas which may be used for walking or hiking; or
    • Other passive recreation-oriented parks, including picnic areas and garden plots.

    Outdoor Storage Area

    Overnight Accommodation means commercial bedroom and bathroom units arranged for short-term stays of less than thirty (30) days for rent that contain a lobby on the premises (Campground with Overnight Accommodations excluded). Examples of this use category include Bed and Breakfast; HostelHotel or Motel and other uses that the Director interprets to meet the characteristics of Overnight Accommodations. Short-Term Rental is excluded from this definition.

    Parking Garage means a structure with vertically stacked decks or a single elevated deck designed to accommodate the temporary storage of operable vehicles, which may be an independent structure or integrated into a building in part or in whole. This definition does not pertain to Tuck-Under Parking.

    Parking Lot
    Parking Lot means an at-grade area of land, generally open to the sky, designed to accommodate the temporary storage of operable vehicles, which may be independent of or accessory to a specific use. Parking Lot shall not include driveways for single-family detached and attached land use types, regardless of whether the driveway provides the minimum required parking spaces for the aforementioned dwelling types.

    Photometric Plan means a proposed exterior lighting plan used to verify compliance with the standards for outdoor lighting in this UDC.     Plaza means an outdoor community amenity that serves a variety of users including building tenants, visitors and members of the public.     Public Improvement means any drainage ditch, roadway, parkway, sidewalk, pedestrian way, tree, lawn, off-street parking area, lot improvement, or other facility for which the local government may ultimately assume the responsibility for maintenance and operation, or which may affect an improvement for which local government responsibility is established.  All such improvements shall be properly bonded for or secured by a letter of credit or other acceptable legal instruments.

    P
    Public or Private School means any public or private facility which conducts regular classes preschool through twelve (12), or any portion thereof, and which meets the minimum educational standards set forth by the State of Colorado. In addition, public or private school shall also include any publicly owned or operated vocational-technical institution.

    Real Estate Sales Office, Temporary On-Site
    Real Estate Sales Office, Temporary On-Site means an office establishment used for advertising and executing the first-time sale of on-site property interests.

    Real Estate Sales Trailer means the temporary use of a trailer or other moveable structure as an office to sell property interests within a specific subdivision or development.

    Recreational Vehicle
    Recreational Vehicle means a vehicle which is:

    • Built on a single chassis;
    • Four hundred (400) square feet or less when measured at the largest horizontal projections;
    • Designed to be self-propelled or permanently towable by a light-duty truck; and
    • Designed primarily not for use as a permanent dwelling but as temporary living quarters for recreational, camping, travel, or seasonal use.

    Retaining Wall means a structure designed to restrain soil to unnatural slopes.     Solid-to-Void Ratio
    Solid-to-Void Ratio means a measurement of the amount of solid material in relation to the amount of empty space, usually expressed as a ratio. A solid to void ratio of one to three (1:3) contains one unit of solid material for every three (3) units of opening. (Example: 1 inch of solid fence with 3 inches of spacing.) The solid to void ratio is measured at every section of fence (the area between each vertical post making contact with the ground), and is not merely an average over the length of the fence.

    Subdivider
    Subdivider means any person, individual, firm, partnership, association, corporation, estate, trust or any other group or combination acting as a unit, subdividing or proposing to subdivide land so as to constitute a "subdivision" as defined in this UDC, including any agent of the subdivider.

    Subdivision
    Subdivision means:

    • The division of a parcel of land into two (2) or more parcels, sites, or lots for the purpose, whether immediate or future, of transfer of ownership or building development. The granting of easements, rights of way, or dedication of land for public use shall not be considered a division of land unless the same is made or granted as a part and parcel of a proposed subdivision.
    • The improvement of one (1) or more parcels of land for residential or commercial structures or groups of structures involving the division or allocation of land for the opening, widening, or extension of any street or streets, the division or allocation of land as open spaces for common use by owners, occupants, or leaseholders.

    Subdivision, Major means any subdivision containing five (5) or more planned lots or dwelling units that will require construction and/or extension of public or private streets or access easements; or construction and/or extension of public utilities.

    Subdivision, Minor means any subdivision containing not more than four (4) lots or dwelling units fronting on an existing or planned public or private street or access easement.

    Substantial Damage
    Substantial Damage means damage of any origin sustained by a building or structure, whereby the cost of restoring the building or structure to its before-damaged condition would equal or exceed fifty percent (50%) of the market value of the building or structure before the damage occurred.

    Substantial Improvement
    Substantial Improvement means any reconstruction, rehabilitation, addition, or other improvement of a structure, the cost of which equals or exceeds fifty percent (50%) of the market value of the structure before "start of construction" of the improvement.  The value of the structure shall be determined by the local jurisdiction having land use authority in the area of interest. This includes structures which have incurred substantial damage, regardless of the actual repair work performed. The term does not, however, include either:

    • Any project for improvement of a structure to correct existing violations of state or local health, sanitary, or safety code specifications which have been identified by the local code enforcement official and which are the minimum necessary conditions; or
    • Any alteration of a historic structure provided that the alteration will not preclude the structure's continued designation as a historic structure.

    Telecommunication Uses means facilities that transmits or receives, or both, electromagnetic signals.     Tower means a self-supporting lattice, guyed or monopole structure that supports telecommunications facilities for the purpose of providing personal wireless telecommunications services.     Town Engineer means the designated Town Engineer for the Town or his or her designee.

    Townhouse Group means a cluster or grouping of townhouses contiguous to one another.

    Trail means a pedestrian/bicycle way that may be located within, or away from, a public right-of-way, and is an alternative path and usually part of a trail system.

    Triplex means a multiplex building type on a single platted lot containing three (3) separate dwelling units, each of which is totally separated from the other by:

    • An unpierced wall extending from ground to roof ("side-by-side" triplex); or
    • A ceiling/floor that extends from exterior wall, pierced only by a stairway that is not inside of either dwelling unit ("over-under" triplex).

    • Utility Major includesElectrical substation; Electric generation plant; Solar panel array (large scale); Water or wastewater treatment plant; and other uses that the Director interprets to be functionally similar to a use in this Use Category.

    • Utility Minor includes: Collocated telecommunication antenna; Public or municipally-owned utilities; Solar panel array (small scale); Stormwater retention or detention facility; Cable and fiber optic communications; Telephone exchange; and other uses that the Director interprets to be functionally similar to a use in this Use Category.

    Variance
    Variance means a modification from the provisions of this UDC in cases when the enforcement of its provisions would result in unnecessary hardship.

    Vegetated Buffer
    Vegetated Buffer means a strip of plantings parallel to a watercourse, consisting of riparian and wetland plant species (including grasses, shrubs, and trees), that has a width of a minimum of thirty linear feet (30').

    Vehicle Parts, Sales, Rentals, and Leasing
    Vehicle Parts, Sales, Rentals, and Leasing means an establishment engaged in the retail sale, rental, and/or lease of new or used vehicles, in any combination with repair and maintenance services and the sale of replacement parts and accessories.

    Vehicle Service
    Vehicle Service means the use of any building, land area, premises or portion thereof, where light maintenance activities such as engine tune-ups, lubrication, carburetor cleaning, brake repair, car washing, detailing, polishing, or the like are conducted.

    Vehicle Wash
    Vehicle Wash means any area or business using self-service, in-bay automatic, or conveyor equipment for cleaning and washing motor or other vehicle types, as a part of another business operation (e.g., as an accessory use to a convenience store and gasoline station).

    Vested Property Right
    Vested Property Right means the right to undertake and complete the development and use of property under the express terms and conditions of a site specific development plan.

    Veterinary Services, Small Animal
    Veterinary Services, Small Animal means any establishment where small animals are cared for by persons who are licensed to perform veterinary care. Extended care to allow five (5) or more small animals to recover and rehabilitate from veterinary services shall not be considered to constitute a kennel.

    View Corridor
    View Corridor means a space between a viewing place and a significant scenic view.

    Walking Sign
    Walking Sign means any sign, including sandwich board type signs, or lettering on a costume, which is carried or worn by any person which is visible from a public right of way, adjacent property, or a public area.

    Wall Sign
    Wall Sign means any sign attached or erected on the exterior wall of a building with the exposed face of the sign parallel to said wall and supported throughout its length by the wall of the building.

    Warning Sign
    Warning Sign means a sign with no commercial message that displays information pertinent to the safety or legal responsibilities of the public such as signs warning of high voltage, no trespassing, and similar directives.

    Waste-Related Service
    Waste-Related Service means a Use Category that contains industrial uses involved in the storage or movement of waste for themselves or other firms. Goods are generally delivered to other firms or the final consumer with little on-site sales activity to customers.

    Examples of primary uses in this category include: 

    Disposal / Recycling Facility and other uses that the Director interprets to meet the characteristics of this Use Category.

    Watercourse
    Watercourse means any body of water, including, but not limited to, lakes, ponds, rivers, streams, bodies of water, and intermittent streams, as delineated by the Town or State of Colorado.

    Waterway
    Waterway means a channel that directs surface runoff to a watercourse or to the public storm drain.

    Water Surface Elevation
    Water Surface Elevation means the height, in relation to the National Geodetic Vertical Datum (NGVD) of 1929 (or other datum, where specified), of floods of various magnitudes and frequencies in the floodplains of coastal or riverine areas.

    Wet Bar
    Wet Bar means a bar for mixing drinks that may contain a sink with running water, a dishwasher, and a refrigerator but no other facilities that can be used for the preparation of food other than mixing drinks. A sink in a wet bar must be smaller than a sink in the kitchen.

    Wetland
    Wetland means 1) areas including lakes, rivers, streams, intermittent streams, ponds, sloughs, areas of seasonal standing water, or 2) those areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances, do support a prevalence of vegetation typically adapted for life in saturated soil conditions, as such areas are specifically delineated as provided for in the 1987 edition of the Corps of Engineers Wetlands Delineation Manual. Wetlands generally include fens, swamps, marshes, bogs, and similar areas. Manmade lakes or ponds built for the purpose of detaining runoff are not considered wetlands in the context of the UDC. Wetlands do not need to have a connection to waters of the United States, as defined by 33 Code of Federal Regulations (CFR) parts 328 and 329 (as amended) or U.S. Environmental Protection Agency 40 CFR part 230 (as amended) to fall under Town jurisdiction.

    Wind Energy Conversion System
    Wind Energy Conversion System means any device including, but not limited to, wind chargers, windmills, and wind turbines. These convert wind energy into another usable form of energy. Wind energy conversion systems shall include all associated support structures and transmission lines.

    Window Sign
    Window Sign means any sign attached to a window, or located within a building and within three feet (3') of a window which, in the sole judgment of the Director, is intended to be viewed from the outside of the building.

    Wireless Telecommunication Facility
    Wireless Telecommunication Facility means radio or television broadcasting towers, telecommunications towers, and antenna / satellite dish arrays (free-standing or tower mounted).  The phrase does not include residential satellite dishes, TV or HDTV antennae, or amateur radio antennae.

    Yard
    Yard means the required open area between a building and a lot line, unoccupied and unobstructed from the ground up, except for such encroachments as are expressly permitted by this UDC.

    Yard, Front
    Yard, Front means a yard extending across the full width of the lot between the front lot line and the nearest line or point of a building.

    Yard, Rear
    Yard, Rear means a yard extending the full width of the lot between the rear lot line and the nearest line or point of a building.

    Yard, Required
    Yard, Required means the area between the lot line and the required setback in relation to that lot line. This includes front, side, and rear yards.

    Yard, Side means a yard extending from the front yard to the rear yard between the side lot line and the nearest line or point of a building.

    Zero Lot-Line
    Zero Lot-Line means a dwelling type consisting of a single-family detached house platted on an individual lot with only one (1) side yard. No windows are permitted on the zero lot line wall of the house.

    Zoning District
    Zoning District means a designation shown on the Official Zoning Map as being a district enumerated in Sec. 2-A-4, Establishment of Zoning Districts, in which a specific set of zoning standards apply.

    Zoning Map
    Zoning Map means the map showing the location and boundaries of the zoning districts established by this UDC.  This map is entitled the "Official Zoning Map of the Town of Winter Park, Colorado".
