ARTICLE IV

ESTABLISHMENT OF DISTRICTS

Sec. 54-119.- Districts.

For the purpose of this article the town is hereby divided into the use districts with the designations and purposes as listed below:

(1)

R-43 Residential District;

(2)

R-21 Residential District;

(3)

R-10 Residential District;

(4)

R-7 Residential District;

(5)

TR Transitional District;

(6)

MV Mountain Village District;

(7)

C-S Community Shopping District;

(8)

C-S-2 Community Shopping District;

(9)

C-S-3 Community Shopping District;

(10)

L-I Light Industrial District;

(11)

H-I Heavy Industrial District.

(12)

MHC Manufactured Home Community District.

(13)

MHO Manufactured Home Overlay District.

(14)

CZ Conditional Zoning District.

Sec. 54-120. - District boundaries.

The boundaries of the districts are shown on the map entitled "The Official Zoning Map, Town of Woodfin, North Carolina," on file in the office of the town administrator. The zoning map and all the notations, references and amendments thereto, and other information shown thereon are hereby made a part of this article the same as if such information set forth on the map were all fully described as set out herein. The zoning map, properly attested, is posted at the town hall and is available for inspection by the public. The map is also available at www.woodfin-nc.gov.

Sec. 54-121. - Due consideration.

In the creation, by this article, of the respective districts, careful consideration is given to the peculiar suitability of each district for the particular uses and regulations applied to it, and the necessary and proper grouping and arrangements of various uses and densities of population in accordance with a well-considered comprehensive plan for the physical development of the town.

Sec. 54-122. - Rules governing interpretation.

Where uncertainty exists as to the boundaries of any of the aforesaid districts, as shown on the zoning map, the following rules shall apply:

(1)

Where such district boundaries are indicated as approximately following street, alley, or highway lines, such lines shall be construed to be such boundaries.

(2)

Where district boundaries are so indicated that they approximately follow lot lines, such lot lines shall be construed to be said boundaries.

(3)

Where district boundaries are so indicated that they are approximately parallel to the centerline of streets, alleys, or highways, or the right-of-way of same, such district boundaries shall be construed as being parallel thereto and at such distances therefrom as indicated on the zoning map.

Where a district boundary line divides a lot or tract in single ownership, the district requirements for the least restricted portion of such lot or tract shall be deemed to apply to the whole thereof provided such extensions shall not include any part of a lot or tract more than 35 feet beyond the district boundary line. The term "least restricted" means use restrictions, not lot or tract size.

Where physical features existing on the ground are at variance with those shown on the zoning map, or in other circumstances not covered previously in this section, the board of adjustment shall interpret the distinct boundaries.
