Editor's note— At the direction of the town, per an email dated March 23, 2022, Article VIII, §§ 54-203—54-208, pertaining to manufactured homes, has been added to read as herein set out. The former Art. VIII, §§ 54-203—54-208, pertaining to floodway district regulations, has been renumbered as Art. IX, §§ 54-213—54-218. Additionally, Arts. IX and X have been renumbered as Arts. X and XI. Subsequently, Ord. No. 2022-151102, § 1, adopted Nov. 15, 2022, added a new Art. VIII to Ch. 54 and renumbered Arts. VIII—XI as Arts. IX—XII. Ord. No. 2024-06, § 1, adopted March 19, 2024, repealed Art. IX, §§ 54-203—54-208, and enacted a new Art. IX as set out herein. The former Art. IX pertained to similar subject matter.


Sec. 54-203.- Manufactured homes.

(a)

Manufactured home—Class A:

(1)

Notwithstanding any other provision of this chapter, a Class A manufactured home, as defined in this chapter, may be placed upon a lot in the R-7, R-10, R-21, R-43, MHO, and MHC districts in accordance with the Table of uses, found in section 54-143(b).

(b)

Manufactured home—Class B:

(1)

Notwithstanding any other provision of this chapter, a Class B manufactured home, as defined in this chapter, may be placed upon a lot in the MHO or MHC districts in accordance with the Table of uses, found in section 54-143(b).

(c)

Manufactured home—Class C:

(1)

Notwithstanding any other provision of this chapter, a Class C manufactured home, as defined in this chapter, may be placed upon a lot in the MHC district in accordance with the Table of uses, found in section 54-143(b).

(2)

Relocating Class C manufactured homes.

a.

Class C manufactured homes are not permitted in the Town of Woodfin. Class C manufactured homes located within the town, whether on individual lots or in manufactured home communities, upon the adoption of this ordinance, and which are continually located within the Town of Woodfin thereafter, may be moved within the same parcel or community (park). Further, it shall be the responsibility of the Class C homeowner seeking a zoning permit to demonstrate that the home was located within the Town of Woodfin prior to the adoption of the ordinance.

(3)

Replacing Class C manufactured homes.

a.

Notwithstanding article XII, nonconformities, section 54-346, other nonconformities, Class C manufactured homes lawfully existing at the time of adoption of this ordinance may remain, but if removed, may only be replaced with a Class A or Class B manufactured home or another use permitted in the underlying zoning district per section 54-143, Table of uses.

Sec. 54-204. - General requirements for all manufactured homes.

(a)

The following requirements pertain to all manufactured homes.

(1)

Set up. Manufactured homes shall be set up in accordance with the standards established by the North Carolina Department of Insurance and the most current edition of the State of North Carolina Regulations for Manufactured Homes.

(2)

Running gear. The towing tongue, wheels, axles, and transporting lights shall be removed upon final placement of the manufactured home.

(3)

Utilities. Shall be connected to the required utilities for systems contained within the manufactured home.

(4)

Access. Manufactured homes shall have stairs, porches, entrance platforms, ramps, and other means of entrance and exit installed or constructed in accordance with the standards set forth in the NC Building Code.

(5)

Storage. No manufactured home shall be used as a storage building.

(6)

ADU. Manufactured homes may be used as accessory dwelling units. Standards set forth in section 54-144(a) accessory dwelling apply.

(b)

New manufactured homes shall be installed per the Manufacturer's Installation Instructions, which are required to comply with the HUD document, 24 CFR Part 3285, Model Manufactured Home Installation Standards.

(c)

Used manufactured homes with a date of manufacture prior to January 1, 2009, shall be installed in accordance with the provisions of the September 2021 Revisions to 2019 Regulations for Manufactured Homes. This edition has been updated to meet or exceed the requirements of HUD 24 CFR Part 3285, Model Manufactured Home Installation Standards.

(d)

Used manufactured homes with a date of manufacture on or after January 1, 2009, shall be installed in accordance with the Manufacturer's Installation Instructions, if available, or the provisions of the September 2021 Revisions to 2019 Regulations for Manufactured Homes.

(1)

For all homes that are installed using the Manufacturer's Installation Instructions, any applicable areas not covered in the Manufacturer's Installation Instructions shall be in accordance with the September 2021 Revisions to 2019 Regulations for Manufactured Homes.
