CHAPTER 18
20 R-1 VILLAGE LARGE LOT RESIDENTIAL DISTRICT
§ 18.20.010 Purpose.
The R-1 district is for the existing core residential development in the village by providing for detached single-family homes. The R-1 district is intended to provide a quiet, pleasant and relatively spacious living area protected from traffic hazards and intrusion of incompatible land uses.

§ 18.20.020 Permitted uses.
The following uses of land are permitted in the R-1 district: single-family detached residences; home occupations; horticultural uses; essential services; accessory buildings; government uses.

§ 18.20.030 Conditional uses.
The following are permitted as conditional uses within the R-1 district:
(a)
Home occupations and professional offices.
(b)
Mobile homes, within a mobile home park, authorized by the village. Such use shall conform to all ordinances of the village regulating or applying to mobile homes and their placement.
(c)
Boarding, rooming, lodging and bed and breakfast houses.
(d)
Community living arrangements which have a capacity for nine or more persons.
(e)
Utilities.
(f)
Churches.
(g)
Photography studio, art studio and art gallery.
(h)
Zero lot line homes.

§ 18.20.040 Specifications.
Within the R-1 district the following standards shall apply:
(a) Maximum Building Height | 35 feet |

§ 18.20.050 Placement of accessory buildings.
Garages, gardening, tool and storage sheds incidental to the residential use. Accessory buildings, which are not a part of the principal building, shall not occupy more than 30 percent of the required rear yard, and shall not be more than 15 feet high nor more than one story, and shall not be nearer than 10 feet to any lot line. Accessory buildings shall be no closer than 10 feet to a rear lot line abutting on a public alley.

§ 18.20.060 Zero lot line homes.
(a)
Definitions.
"Dwelling unit"
shall mean and refer to any portion of a residence building situated, designed and intended for use and occupancy as a residence by a single family.
"Lot"
shall mean and refer to the property upon which a dwelling unit is situated or to be situated.
"Owner"
shall mean and refer to the owner of record of fee simple title to any lot, including contract sellers and vendees, but excluding those having such interest merely as security for the performance of an obligation and excluding those who have a lien upon the lot by provision or operation of law.
"Zero lot line home"
shall mean and refer to a side-by-side single-family attached dwelling.
(b)
Zero Lot Line Duplexes/Common Wall Construction Dwellings.
(1)
When attached dwellings are constructed, the plans, specifications and construction of the building shall require that the installation of sewer and water and other utility services be provided separately to each dwelling unit.
(2)
Wherever the improvements abut on the common boundary line between adjoining units, there shall be a one-hour firewall running from the lowest floor level, including the basement if it is a common wall, to the underside of the roof sheathing. Such basement wall shall be waterproof masonry.
(3)
When an attached dwelling unit is sold, the owners of the units shall enter into an agreement, a copy of which shall be filed with the village, as to their respective rights, duties and obligations including repairs, maintenance, destruction and insurance.
(4)
In addition to the requirements of subsection (b)(3) of this section, said agreement between the owners will automatically include the following provisions:
a.
Each unit of the building shall be constructed at the same time and shall be maintained in such way that the exterior of the two units is identical, aesthetically pleasing and in harmony with the neighborhood.
b.
Each unit shall plant at least two trees and each unit shall have a foundation planting equal to at least one-half of the street side of the unit. The lawns, shrubs and trees of each unit shall be maintained in order that each shall be consistent with the other.
c.
Both units shall at all times be the same in color and type of exterior construction material for the exterior walls and roof.
(5)
Each lot on which is to be constructed a zero lot line home will be divided equally between the two units with the common wall being located on the division line. The division shall be by certified survey. The front entrances to the units will face the street.
(6)
The following shall apply to a zero lot line home:
1. Maximum Building Height | 35 feet and 2.5 stories |
2. Minimum Front Yard Setback | 25 feet |
3. Minimum Rear Yard Setback for Principal Building | 25 feet |
4. Minimum Side Yard Setback for Each Unit | Zero & 10 feet |
5. Minimum lot width of 60 feet or minimum square footage for each lot of 7,200 square feet | |
6. Minimum Square Footage Each Unit | 7,200 square feet |
7. Minimum Floor Area Each Unit | 900 square feet |
8. Minimum Off-Street Parking Each Unit | 2 parking spaces one of which shall be an attached garage |
(c)
Before any permit may be issued for a zero lot line home, the construction of the home must be approved by the plan commission and village board. A permit may be issued only for new construction. Zero lot line homes will be allowed only on parcels zoned R-3 and specifically allocated for such construction.
(d)
Fees. The fees are to be paid by the developer.
(e)
Condominiums. All condominiums shall conform to applicable requirements set forth in Chapter 703, Wis. Stats.
