CHAPTER 18

30 R-3 VILLAGE TWO-FAMILY RESIDENTIAL DISTRICT

§ 18.30.010 Purpose.

The R-3 district is for two-family housing within the village limits of Arena. The R-3 district is intended to provide a quiet, pleasant and relatively spacious living area protected from traffic hazards and intrusion of incompatible land uses.

§ 18.30.020 Permitted uses.

The following uses of land are permitted in the R-3 district:

(a)

Single-family dwellings.

(b)

Two-family dwellings.

(c)

Private garage space for up to four cars for each residential parcel.

(d)

Accessory buildings, not to exceed 120 square feet.

(e)

Water storage facilities and their accessory structures.

(f)

Community living arrangements which have a capacity for eight or fewer persons.

(g)

Uses customarily incident to any of the above uses; provided, that no such use generates traffic or noise that would create a public or private nuisance.

(h)

Bed and breakfast.

§ 18.30.030 Conditional uses.

The following are permitted as conditional uses within the R-3 district:

(a)

Home occupations and professional offices.

(b)

Libraries, museums and art galleries.

(c)

Hospitals and clinics.

(d)

Colleges and vocational schools.

(e)

Telephone buildings, exchanges, lines and transformer stations, but excepting service garages and storage yards.

(f)

Microwave radio relay structures and community television antennas.

(g)

Funeral homes.

(h)

Accessory building in excess of 120 square feet.

(i)

Mobile homes, within a mobile home subdivision, authorized by the village. Such use shall conform to all ordinances of the village regulating or applying to mobile homes.

(j)

Bed and breakfasts.

§ 18.30.040 Zero lot line homes.

(a)

Definitions.

"Dwelling unit"

shall mean and refer to any portion of a residence building situated, designed and intended for use and occupancy as a residence by a single family.

"Lot"

shall mean and refer to the property upon which a zero-dwelling unit is situated or to be situated.

"Owner"

shall mean and refer to the owner of record of fee simple title to any lot, including contract sellers and vendees, but excluding those having such interest merely as security for the performance of an obligation and excluding those who have a lien upon the lot by provision or operation of law.

"Zero lot line home"

shall mean and refer to a side-by-side single-family attached dwelling.

(b)

Zero Lot Line Duplexes/Common Wall Construction Dwellings.

(1)

When attached dwellings are constructed, the plans, specifications and construction of the building shall require that the installation of sewer and water and other utility services be provided separately to each dwelling unit.

(2)

Wherever the improvements abut on the common boundary line between adjoining units, there shall be a one-hour firewall running from the lowest floor level, including the basement if it is a common wall, to the underside of the roof sheathing. Such basement wall shall be waterproof masonry.

(3)

When an attached dwelling unit is sold, the owners of the units shall enter into an agreement, a copy of which shall be filed with the village, as to their respective rights, duties and obligations including repairs, maintenance, destruction and insurance.

(4)

In addition to the requirements of subsection (b)(3) of this section, said agreement between the owners will automatically include the following provisions:

Each unit of the building shall be constructed at the same time and shall be maintained in such way that the exteriors of the two units are identical, aesthetically pleasing and in harmony with the neighborhood.

Each unit shall plant at least two trees and each unit shall have a foundation planting equal to at least one-half of the street side of the unit. The lawns, shrubs and trees of each unit shall be maintained in order that each shall be consistent with the other.

Both units shall at all times be the same color and a single type of exterior construction material for the exterior walls and roof.

Each lot on which is to be constructed a zero lot line home will be divided equally between the two units with the common wall being located on the division line. The division shall be by certified survey. The front entrances to the units will face the street.

(6)

The following shall apply to a zero lot line home:

a. Maximum Building Height	35 feet and 2.5 stories
b. Minimum Front Yard Setback	25 feet
c. Minimum Rear Yard Setback for Principal Building	25 feet
d. Minimum Side Yard Setback for Each Unit	Zero and 10 feet
e. Minimum Lot Width Each Unit	60 feet or minimum square footage 7,200 each unit lot
f. Minimum Floor Area Each Unit	900 square feet
g. Minimum Off-Street Parking Each Unit	2 parking spaces, one of which shall be an attached garage

(c)

Before any permit may be issued for a zero lot line home, the construction of the home must be approved by the plan commission and village board. A permit may be issued only for new construction. Zero lot line homes will be allowed only on parcels zoned R-3 and specifically allocated for such construction.

(d)

Fees. The fees are to be paid by the developer.

(e)

Condominiums. All condominiums shall conform to applicable requirements set forth in Chapter 703, Wis. Stats., and shall also comply with AMC § 1.05.070.

§ 18.30.050 Specifications.

Within the R-3 district the following standards shall apply:

(a) Maximum Building Height	35 feet
(b) Minimum Front Yard Setback	25 feet
(Note: More restrictive standards may be imposed by the state regulations in certain circumstances; for example, on lots fronting on certain classes of state highways.)
(c) Minimum Rear Yard Setback
Principal Buildings	25 feet
Accessory Buildings and Garages	10 feet
(d) Minimum Side Yard Setback
Principal Buildings	10 feet each side with a combined total of 20 feet
Accessory Buildings and Garages	10 feet
(e) Minimum Average Lot Width (New Lots)	90 feet
(f) Minimum Lot Area	12,000 square feet
(g) Minimum front yard setback shall apply to both street sides of a corner lot.
(h) Main Floor Living Area	Minimum 900 square feet per family unit
(i) Minimum Dwelling Width	24 feet
(j) Restricted in Residential	No shouse shall be built in a residential area
