ARTICLE III

COMPLIANCE WITH THE REGULATIONS

Section 1. - [Generally.]

Except as hereinafter specifically provided:

(1)

No land shall be used except for a purpose permitted in the district in which it is located.

(2)

No building shall be erected, converted, enlarged, reconstructed, moved or structurally altered, nor shall any building be used, except for a use permitted in the district in which such building is located.

(3)

No building shall be erected, converted, enlarged, reconstructed or structurally altered to exceed the height limit herein established for the district in which such building is located.

(4)

No building shall be erected, converted, enlarged, reconstructed or structurally altered except in conformity with the area regulations of the district in which such building is located.

(5)

No building shall be erected or structurally altered to the extent specifically provided hereinafter except in conformity with the off-street parking and loading regulations of the district in which such building is located. Off-street parking space being maintained in connection with any existing main building or structure shall be maintained so long as said main building or structure remains unless an equivalent number of such spaces are provided conforming to the requirements of the zoning ordinance; provided, however, that this regulation shall not require the maintenance of more parking space than is required hereinafter for a new building or structure identical to said existing building or structure.

No building shall be erected, converted, enlarged, reconstructed, structurally altered, moved or demolished unless a permit therefor has been issued by the building commissioner.

(7)

The minimum yards, parking spaces, and open spaces, including lot area per family, required by this ordinance, for each and every building existing at the time of passage of this ordinance [July 11, 1966] or for any building hereafter erected, shall not be encroached upon or considered as part of the yard or parking space or open space required for any other building, nor shall any lot area be reduced below the requirements of this ordinance for the district in which such lot is located.

(8)

Except for developers of subdivisions, who may construct not more than five buildings for display purposes, and except as may otherwise be provided herein, every building hereafter erected or structurally altered shall be located on a lot as herein defined; and in no case shall there be more than one main building on one lot. The yards and open spaces required in a district in which display buildings are erected shall be provided for and shall not be encroached upon by any display building.

(9)

Nothing contained in this ordinance shall prevent the use of land for the raising of crops, orchards or forestry, nor require permits therefor.

(10)

Secondary dwelling units are prohibited in the zoning classifications provided in and by articles III-A, IV, V, V-A, VI, VIII-A, and XII-A. Secondary dwelling units shall be permitted by special use exception in the zoning classifications provided in and by articles IX, X, XI, XII subject to all other provisions of those respective articles.
