CHAPTER 13

P PUBLIC DISTRICT

8-13-1: INTENT:

The Public District is intended to provide for major public land areas and public and semi-public institutional uses, including land reserves for future public and institutional use, and for the preservation of publicly established historic sites. (Ord. 2019-01, 3-19-2019)

8-13-2: PERMITTED USES:

Cemeteries.
Hospitals.
Municipal, County, State and Federal uses, facilities, services and buildings.
Parks, playfields, playgrounds, and golf courses operated by a public agency.
Public colleges and universities.
Public utility uses, facilities, services and buildings.
Publicly established historical sites and buildings. (Ord. 2019-01, 3-19-2019)

8-13-3: CONDITIONAL USES:

These uses may be allowed upon review and approval of a conditional use permit by the commission and Council.
Churches.
Private facilities such as golf courses.
Other potentially compatible uses provided they are not contrary to the intent of the district. (Ord. 2019-01, 3-19-2019)

8-13-4: MINIMUM STANDARDS:

   A.   Lot Area: None, except in the case of a commercial lot adjoining a residential lot; then the minimum lot size shall not be less than five thousand (5,000) square feet.
   B.   Lot Width: None, except in the case of a commercial use lot adjoining a Residential District, then the minimum lot width shall be forty feet (40').
   C.   Setback Requirements:
      1.   Front Setback: Building setback shall be a minimum of fifteen feet (15') from the front property lines, or as determined by Zoning and Planning.
      2.   Rear Setback: Ten feet (10'), except in the case of a commercial lot adjoining a residential lot, or public street, then the rear setback shall be a minimum of twenty five feet (25').
      3.   Side Setback: Ten feet (10'), except in the case of a commercial lot adjoining a residential lot, or public street, then the side setback shall be a minimum of fifteen feet (15').
   D.   Height Limitations: Maximum height shall not exceed thirty five feet (35') or three (3) stories, whichever is less. (Ord. 2019-01, 3-19-2019)

8-13-5: ACCESSORY USES:

A use that complies with all of the following may be operated as an accessory use to a permitted use in the P District:
   A.   The use is clearly incidental and secondary to the operation of the permitted use.
   B.   The use is commonly associated with the operation of the permitted use.
   C.   It is operated and maintained under the same ownership and on the same lot as the permitted use. (Ord. 2019-01, 3-19-2019)
