CHAPTER 9

BUSINESS DISTRICTS

8-9A-1: INTENT:

The intent of the B-1 District is to establish and preserve a General Business District, providing a wide variety of goods and services for the Town. (Ord. 2019-01, 3-19-2019)

8-9A-2: PERMITTED USES:

In a B-1 District, no building or premises shall be used, and no building shall be erected or structurally altered unless otherwise provided herein, except for one or more of the following uses:
Accessory building and uses.
Antique shop, with all merchandise displayed and sold inside a building.
Apparel and accessory store.
Appliance store, household.
Athletic clubs, health and exercise center, or commercial recreation.
Auto supply store.
Automobile and pick-up trucks rated at one and one-half (11/2) tons or less sales, service and repair, new and used.
Automobile and truck washing establishment.
Automobile sales and/or repairing, provided outside storage areas are enclosed by a minimum six foot (6') solid fence, or other buffering material of similar height approved by the Zoning and Planning Commission, if adjacent to a Residential Zone. (See section 8-3-11 of this title.)
Bank, savings and loan institutions.
Bar, liquor store.
Barbershop and beauty shop.
Bed and breakfast.
Bicycle sales, service and repair shop.
Boat sales, service and repair.
Bookstore or stationery store.
Business and office machine sales, service, and repair shop.
Business, technical, or vocational school, including music and dance.
Cafes and coffee shops.
Church and parish house.
Convenience store.
Dance studio.
(Daycare) childcare center.
Drugstore and prescription shop.
Dry cleaning and laundry.
Electrical shop.
Florist and gift shop.
Furniture and home furnishing store.
Garden shop.
Gas station.
Grocery store, including retail meat market, produce store, delicatessen, and catering.
Hardware and paint store.
Heating and air conditioning shop.
Hobby and craft store.
Hotels, motels.
Locksmith.
Medical, dental, optician, optometrist, or health clinic.
Miniature golf course.
Office; general and professional.
Office supply and equipment.
Pawn shop.
Pharmacy.
Plumbing shop.
Private club or lodge.
Public or private school.
Recreational vehicle sales.
Rental store.
Repair shop, for household appliances.
Restaurant and convenience food restaurant.
Self-service laundry.
Sporting and athletic goods store.
Sundry shops and stores.
Theaters, auditoriums and other places of indoor assembly.
Thrift shops.
Tire sales and repair.
Travel agency.
Vocational centers, medical and professional institutions.
Other commercial uses, similar to listed uses and approved by Planning staff. (Ord. 2019-01, 3-19-2019)

8-9A-3: CONDITIONAL USES:

Gaming/gambling: provided said use is located in excess of three hundred feet (300') from any school or church.
Parking lots.
Pet stores; pet supplies, indoor boarding.
Sale and service and repair of heavier motor vehicles.
Veterinary clinic and indoor animal boarding.
Other compatible uses, as determined by Zoning and Planning. (Ord. 2019-01, 3-19-2019)

8-9A-4: MINIMUM STANDARDS:

   A.   Lot Area: None.
   B.   Lot Width: None.
   C.   Setback Requirements:
      1.   Front Setback: Building setback shall be a minimum of twenty five feet (25') from the front property lines, or as determined by Zoning and Planning.
      2.   Rear Setback: Ten feet (10'), except in the case of a commercial lot adjacent to a street, then the rear setback shall be a minimum of fifteen feet (15').
      3.   Side Setback: 7.5 feet, except in the case of a commercial lot adjoining a residential lot, or public street, then the side setback shall be a minimum of fifteen feet (15').
   D.   Height Limitations: Maximum height shall not exceed thirty five feet (35') or three (3) stories, whichever is less. (Ord. 2019-01, 3-19-2019)

8-9A-5: SUPPLEMENTARY AND BULK REGULATIONS:

No part of an area or width required for the purpose of complying with the provisions of this title shall be included as an area or width required for another lot. (Ord. 2019-01, 3-19-2019)

8-9A-6: LANDSCAPE REQUIREMENTS:

A landscape plan shall be submitted for the Town's review and be approved as part of any required plan review and approval or as a part of any building permit application package for any new development project. (Ord. 2019-01, 3-19-2019)

8-9A-7: ACCESSORY USES:

A use that complies with all of the following may be operated as an accessory use to a permitted use in the B-1 District:
   A.   The use is clearly incidental and secondary to the operation of the permitted use;
   B.   The use is commonly associated with the operation of the permitted use;
   C.   It is operated and maintained under the same ownership and on the same lot as the permitted use. (Ord. 2019-01, 3-19-2019)

8-9B-1: PURPOSE:

The district is intended for commercial businesses which generate higher traffic volumes and require access to arterial streets. (Ord. 2019-01, 3-19-2019)

8-9B-2: PERMITTED USES:

Automobile and truck washes.
Automobile sales and repair areas and shops, provided outside storage areas are enclosed by a minimum six foot (6') solid fence, or other buffering material of similar height approved by the Zoning and Planning Commission, if adjacent to a Residential Zone. (See section 8-3-11 of this title.)
Automobile service stations, automobile service centers.
Automobile, truck and trailer sales.
Bed and breakfast (including homestay and inns).
Churches.
Clubs and lodges.
Commercial laundries.
Convenience establishment, high volume.
Drive-in/through facilities such as restaurants, package liquors, branch banks, etc.
Frozen food lockers.
Grocery stores.
Hotels, motels.
Medical laboratories, clinics, health spas, real estate brokers, insurance agents, and public health facilities.
Offices, general and professional.
Parks, playgrounds, historical sites, golf courses, and other similar recreational facilities.
Pawnshops.
Personal service shops.
Pet supplies.
Recreation centers, restaurants, cafes, coffee shops, and retail business.
Truck/car stops.
Other retail businesses, as deemed appropriate by Zoning and Planning. (Ord. 2019-01, 3-19-2019)

8-9B-3: MINIMUM STANDARDS:

   A.   Lot Area: Four thousand (4,000) square feet.
   B.   Setback Requirements:
      1.   Front Setback: Building setback shall be a minimum of twenty five feet (25') from the front property lines, or as determined by Zoning and Planning.
      2.   Rear Setback: Ten feet (10'), except in the case of a commercial lot adjacent to a street, then the rear setback shall be a minimum of fifteen feet (15').
      3.   Side Setback: Ten feet (10'), except a Commercially zoned lot adjoining a Residential zoned lot where the side setback shall be a minimum of fifteen feet (15').
   C.   Buffering: For commercial developments that adjoin residential properties, one of the buffering alternatives expressed in section 8-3-11 of this title shall be developed to reduce noise and increase visual privacy. (Ord. 2019-01, 3-19-2019)

8-9B-4: CONDITIONAL USES:

The following are conditional uses in the B-2 District:
Parking lots.
Public utility and public service installations and facilities, including repair and storage facilities.
Other compatible uses, as determined by the commission. (Ord. 2019-01, 3-19-2019)

8-9B-5: LANDSCAPE REQUIREMENTS:
