Zone
The following uses are permitted in the R-3 zone: all uses and accessory uses permitted in the R-3C zone, subject to the same requirements and regulations as are provided for the R-3C zone in Chapter 19.32, including, but not limited to, single-family dwellings, two-family dwellings, apartment courts, apartment houses, multiple dwellings, transitional and supportive housing, and structures, facilities and uses relating to or convenient or necessary for any function of municipal government. The following uses are permitted in the R-3 zone with a use permit from the Planning Commission:
A. Public buildings, parks and playgrounds;
B. Living rooms or sleeping quarters in accessory buildings;
C. Electric substations and other public utility facilities;
D. Off-street parking facilities associated with housing units;
E. Any business relating to the ownership or management of any apartment house or apartment court or multiple dwelling, or to the renting or leasing of apartments in any such building, provided that no such business or activity shall be conducted in any separate building devoted exclusively to such business or activity, or on any floor other than the ground floor of any building;
F. Any professional office or activity;
G. Churches;
H. Club buildings;
I. Nursery schools and preschools. Any nursery school/ preschool use of property located within the R-3 zoning district, in existence on the date of adoption of the ordinance codified in this Title, is exempt from the requirement of obtaining a use permit under this Chapter.
J. Large residential or community care facilities serving seven or more individuals;

A. Incentives for Affordable Housing. If a development project with new housing units or additions of over three units to an existing development creates twenty percent of the new units as affordable to households making less than eighty percent of the area median income, the following standards shall apply, replacing the standards in the table above:
1. Lot Area/Unit. The maximum allowable density (i.e., minimum lot area/unit) shall be calculated over the total combined area of contiguous parcels equal to or greater than one-half acre under common ownership;
2. Off-Street Parking. Only one parking space and one-half common parking space is required per unit;
3. Usable open space: one hundred fifty square feet of private open space and one hundred fifty square feet of public open space if the development site is within one thousand linear feet of an existing park;
4. Maximum lot coverage: forty-five percent;
5. Maximum height: thirty-eight feet for buildings with frontage on Beach Road. (Ord. 2024-01 § 3 (Exh. A), 2024; Ord. 2011-4 § 27, 2011; Ord. 89-1 § 1, 1989.)
All new structures, and all exterior remodeling, alteration, addition or other construction, including retaining walls, swimming pools, fences and the like, shall be subject to the design review process as required in Title 20. (Ord. 2024-01 § 3 (Exh. A), 2024; Ord. 89-1 § 1, 1989.)
