Overlay Zone
A. The purpose of the planned unit development (PUD) overlay zone is to designate land for the creation of unique development or design solutions that vary from the City’s development standards in exchange for public benefits or amenities not otherwise required, such as open space, scenic views, and undergrounding of utilities. A. A PUD overlay zone may be applied to properties situated in the following base zones only: R-2 (duplex residential zone), R-3 (multiple dwelling residential zone), or R-3C (multiple dwelling—Belvedere Cove).
B. Overlay zones may only be applied to one or more parcels totaling one acre or more in size. Parcels must either be contiguous or abutting and separated only by a roadway.
C. The parcel(s) may lie wholly or in part within the City limits but must have a base zone assigned by the City of Belvedere. (Ord. 2011-2 § 3, 2011.)
Permitted uses in the PUD overlay zone are those of the underlying base zone. (Ord. 2011-2 § 3, 2011.)
Uses not permitted in the underlying base zone are permitted in the PUD overlay zone with a conditional use permit from the Planning Commission. (Ord. 2011-2 § 3, 2011.)
A. The following development standards of the base zone may not be changed by application of a PUD overlay zone: Density, lot coverage, and building height.
B. Among the standards which may be approved for change by a PUD overlay zone are: minimum lot size, building setbacks, and parking.
C. Nothing in this section is intended to preclude submittal for a PUD overlay zone by property owners with existing uses and/or structures that do not comply with the current zoning regulations of the base zoning district. However, the PUD overlay zone does not allow for expansion of nonconformities relative to density, lot coverage, or building height. (Ord. 2011-2 § 3, 2011.)
A rezone application to establish a PUD overlay zone may be initiated by a property owner or by the City Council. Rezone applications shall be accompanied by an application for a planned unit development permit (PUD Permit). (Ord. 2011-2 § 3, 2011.)
