19.60 Building

Requirements

19.60.010 Design review approval prerequisite to permit issuance.

No building permit or other permit shall be issued by the building inspector for construction, excavation, grading, exterior alteration or extension of any building, structure or improvement in any zone unless and until plans have first been submitted to and approved by the Planning Commission, pursuant to Title 20 of this Code, entitled “Environment and Design.” (Ord. 89-1 § 1, 1989.)

19.60.020 Compliance with requirements.

No structure shall be constructed, altered, extended, enlarged, moved, placed or maintained unless it complies with the requirements set forth in Sections 19.60.030 through 19.60.040. (Ord. 89-1 § 1, 1989.)

19.60.030 Number of main buildings permitted.

A. R-15 Zone and R-1 Zones. In any single-family residential zone, only one main building shall be located, constructed or maintained on any one lot.

B. Other Zones. In any zone other than a single-family residence zone, only one main building, whether a public building, apartment house, apartment court, main dwelling or otherwise, shall be located, constructed or maintained on any lot, except that two or more such main buildings may be erected, located or maintained on a lot if the building area in which each such main building and its accessory structures are located has, separate and distinct from the building area for any other main building on the same lot, at least the minimum lot frontage, the minimum average width, the minimum lot area, the minimum setback line and yard requirements prescribed by this Title for a lot in that zone.

C. C-1 Zone. In addition to the above main building restriction, in the C-1 zone no separate building designed to be used or used as a dwelling shall be located, constructed or maintained on the same lot with a building designed to be used or used for any business purposes. (Ord. 89-1 § 1, 1989.)

19.60.040 R-3C zone building restrictions.

In the R-3C zone, the following additional building restrictions shall apply:

A. Buildings and structures, except for docks, shall not extend more than one hundred feet from the front property line on Beach Road.

B. Buildings or structures shall not exceed seventy-five feet in depth or one hundred feet in width.

C. The clear separation between buildings or any part thereof on the same lot shall not be less than one-half the average depth of the two buildings, measured from the front property line, or a distance of thirty feet, whichever is greater.

D. At least fifty percent of each lot area in the R-3C zone shall remain in open water. (Ord. 89-1 § 1, 1989.)

19.60.050 Material storage restrictions in residential zones.

It is unlawful to utilize any lot or portion thereof in any residential zone for the storing of any materials, equipment or machinery used in any business or industry, or of any lumber, lime, cement, plaster or other building materials, excepting only temporary storage of building materials required for immediate construction. (Ord. 89-1 § 1, 1989.)

19.60.060 Building permits—Application requirements and issuance conditions.

No building permit or other permit shall be issued by the building inspector for the construction, alteration or extension of any building, structure or improvement contrary to the provisions of this Title, and any permit issued in conflict with this Title shall be void, unless a variance to the specific provision of this Title has been granted by the Planning Commission. Each application for a building permit filed with the Building Official shall be accompanied by a map or diagram showing the location of the land and the position thereon of the proposed structure or improvement.
