OFF-STREET PARKING REQUIREMENTS6

It is the intent of this article to ensure the adequate provision of off-street parking facilities for specific land uses within the city through minimum space requirements and design standards.

The minimum provisions for paved off-street parking shall apply to all newly constructed buildings or structures and to existing buildings or structures that are enlarged or altered if the plans for such enlargement or alteration are submitted to the city for approval on or after July 1, 1995. Such off-street parking shall be located entirely on private property with no portion except necessary drives extending into any street or public right-of-way.

The planning commission shall review and approve all site plans for compliance with this article except in such cases where there is no repair or alteration to the site or to the exterior of an existing building. In such cases, no building permit for internal alteration of the building or certificate of occupancy shall be issued until the off-street parking is reviewed and approved by the planning department for compliance with this article.

The minimum number of required off-street parking spaces for various land uses is listed below. The planning commission may require off-street parking spaces above the minimum number listed below when it is determined that a proposed development will generate a need for parking beyond what is normally generated for the particular land use. For those land uses that are not listed, the planning commission shall establish the minimum required parking spaces after review and recommendation of the planning department.

The planning commission may reduce the number of paved parking spaces under the following provisions:
(1)
The site must be shown to have the capability to accommodate the minimum number of parking spaces required for the proposed land use.
(2)
The area remaining unpaved must be allocated to green space and is in addition to the minimum green space requirement for the site.
(3)
No more than 20 percent of the required parking spaces may remain undeveloped.
(4)
Any reduction in the required parking as outlined above is limited to the specific land use. Any change in land use shall require reapproval by the planning commission.
(5)
The applicant shall submit a security acceptable to the city in an amount equivalent to the cost of constructing the parking area left undeveloped. The planning commission may at any time in the future require that all the paved parking spaces required be constructed when it is determined that the reduced parking arrangement is inadequate to serve the needs of the facility. This requirement is subject to 12 months' written notice for service/institutional uses and three months' written notice for all other land uses. If the owner fails to construct the additional parking area within the required time, the city may collect on the security and complete the improvements.

(a)
Off-street parking spaces. All off-street parking spaces except handicapped spaces shall conform to the following size requirements:
(1)
Eighty percent of the required spaces must be at least nine feet by 18 feet.
(2)
Twenty percent of the required spaces may be no less than 8.5 feet by 16 feet for surface parking or eight feet by 16 feet if in a parking structure and properly marked as a compact space.
(b)
Internal access ways. All internal access drives and parking lot access ways must be at least 24 feet wide for two-way traffic and at least 18 feet wide for one-way traffic.

All off-street handicapped parking spaces shall conform to the federal Americans with Disabilities Act requirements and be designated as reserved for the physically handicapped by a sign showing the symbol of accessibility. The following minimum standards shall be met:
(1)
Location. Parking spaces designated for the physically handicapped shall be located to provide the shortest possible accessible circulation route to an accessible entrance of the building.
(2)
Number. The number of parking spaces to be reserved for the handicapped shall be as follows:

Minimum handicapped parking space size requirements: All off-street handicapped parking spaces shall conform to the following size requirements:
a.
Handicapped parking spaces must be at least 11 feet by 18 feet.
b.
Handicapped parking spaces must be adjacent to an access aisle measuring at least five feet by 18 feet. Two handicapped accessible parking spaces may share a common access aisle.

(a)
Spaces required. Every nonresidential building or structure over 7,500 gross square feet which requires deliveries or shipments shall provide off-street loading and unloading spaces in accordance with the table below, titled "Number of Off-Street Loading Spaces Required." Off-street loading spaces may have direct access to a public street subject to compliance with the vehicle access control regulations set forth in article VII of this chapter. Off-street loading spaces shall be separated from all internal access ways and required parking spaces. At no time shall part of a truck, van or other vehicle be allowed to extend onto a sidewalk, into the right-of-way or into a joint user access easement in order to deliver, load or unload goods.
(b)
Size requirements. All off-street loading spaces shall be at least 12 feet in width and have at least 14 feet of vertical clearance. Off-street loading spaces shall be at least 55 feet in length for industrial uses and at least 35 feet in length for all other uses.
(c)
Provision for reduction in number of spaces. Applicants may provide fewer off-street loading spaces than the number required by the table in this section if enough land is set aside to ensure that the required number of off-street loading spaces can be constructed in the future in the event of a change in tenant. The land set aside in this manner shall be preserved as green space but can not be counted as part of the site's overall 20 percent green space requirement.

The planning commission may reduce the total parking spaces for a commercial or service institution development based on recommendations from the planning department if the peak parking demand times for the various tenants or users do not conflict or overlap. The planning commission may require the entity applying for shared parking consideration to furnish a copy of a written agreement, guaranteeing long-term use of the subject parking area. In no case shall the reduction exceed 20 percent of the total parking requirement for commercial tenants or users or 30 percent of the total parking requirement for service institution tenants or users.
