A nonconforming use existing at the time of the passage of this Zoning Code (Ordinance 46-68, passed February 3, 1969), or amendments thereto, may be continued, provided that if said nonconforming use is wholly or substantially discontinued for a period of six months or more from the date that it became a nonconforming use, it shall be deemed to have been abandoned and thereby extinguished. A nonconforming use shall not be extended except as authorized, but the extension of a use to any portion of a building which portion was arranged or designed for such nonconforming use at the time of the passage of this Zoning Code shall not be deemed the extension of a nonconforming use. A building arranged, designed or devoted to a nonconforming use at the time of the passage of this Zoning Code shall not be reconstructed or structurally altered to an extent exceeding in aggregate cost, during any ten-year period, 50% of the fair market value of the land and building, unless the use of such building is changed to a conforming use. A nonconforming use, if changed to a conforming use, may not thereafter be changed back to a nonconforming use.
§ 1282.02 COMPLETION AND RESTORATION OF EXISTING BUILDINGS.
Nothing contained in this Zoning Code shall require any change in the plans, constitution or designated use of a building for which a building permit has been heretofore issued and the construction of which has been diligently prosecuted within 90 days of the date of such permit, and which entire building shall be completed according to such plans, as filed, within two years from the date of the passage of this Zoning Code (Ordinance 46-68, passed February 3, 1969). Nothing in this Zoning Code shall prevent the restoration of a building wholly or partly destroyed by fire, explosion, act of God or act of a public enemy subsequent to the passage of this Zoning Code. Nothing in this Zoning Code shall prevent the restoration of a wall declared unsafe by the Building Commissioner.
