No new inhabited private/commercial dwelling building or structure involving lodging, trade, manufacturer, repair storage, traffic or occupancy by the public shall be nearer than 100 feet to an existing gas/oil well, storage tank or other equipment. No new traveled part of any public street, road or highway, or parking area shall be nearer than 50 feet to an existing gas/oil well, storage tank or other equipment. This rule does not apply to a building or structure which is incidental to agricultural use of the land on which it is located unless such building is used as a private dwelling, house or the business of retail trade.
The Board of Zoning Appeals may vary or permit exceptions to any of the provisions of this chapter if it finds that such variance or exception will not violate the spirit or intent of this chapter.

§ 1287.99 PENALTY.
Whoever violates or fails to comply with any of these provisions, or any order pursuant thereto, shall be punished as provided in § 202.99 of this Code of Ordinances.
