CHAPTER 1284

OFF-STREET PARKING

§ 1284.01 PURPOSES.

   Off-street parking and loading requirements and regulations are established in order to achieve, among others, the following purposes:
   (A)   To relieve congestion so that streets can be utilized more fully for the movement of vehicular traffic;
   (B)   To promote the safety and convenience of pedestrians and shoppers by locating parking areas so as to lessen car movements in the vicinity of intensive pedestrian traffic;
   (C)   To protect adjoining residential neighborhoods from on-street parking; and
   (D)   To promote the general convenience, welfare and prosperity of business, service, research, production and manufacturing developments which depend upon off-street parking and loading facilities.

§ 1284.02 FACILITIES REQUIRED.

   Off-street parking and loading facilities are required in accordance with this chapter as a condition precedent to the exercise of any use permitted in this Zoning Code.

§ 1284.03 GENERAL REQUIREMENTS.

   An off-street parking facility shall be required when a new building is constructed, when a new use is established, when an existing building is altered or an existing use is enlarged so that there is an increase in the number of dwelling units, seating capacity or floor area or when the changed use requires different measuring standards. An off-street parking facility shall continue unobstructed in operation and shall not be used for any other purpose than parking, except that in residential districts a garage with the customary uses incident to the dwelling is permitted. Parking facilities once established shall not be changed to another location, nor shall they be reduced, without the approval in writing of the Board of Zoning Appeals upon written application made therefor. Should such parking facility be reduced without such approval, then the main use of the premises shall cease, which shall be in addition to other remedies provided for violations of this Zoning Code. A parking space means an open or enclosed area accessible from the street for parking of a motor vehicle of an owner, occupant, employee, customer or tenant of the main use.

§ 1284.04 MEASUREMENT AND DESIGN STANDARDS.

   For the purpose of determining the off-street parking and loading facilities required as accessory to a use, the following design and measurement standards shall be met.
   (A)   Dimensions. Each off-street parking space must meet the following dimensions exclusive of all drives, aisles and turning places:
      (1)   For 90-degree parking, a parking space shall have not less than nine feet in width and 19 feet in length;
      (2)   For 60-degree parking, a parking space shall have not less than nine feet in width and 19 feet in length;
      (3)   For 45-degree parking, a parking space shall have not less than 12 feet in width and 19 feet in length;
      (4)   For parallel parking, a parking space shall have not less than nine feet in width and 23 feet in length; and
      (5)   Aisles which access any parking spaces must be 24 feet in width minimum.
 
   (B)   Surfacing. All off-street parking shall be hard-surfaced and shall be provided with proper drainage so that no water drains into the street or adjacent property.
   (C)    Standards of Measurement. Where floor area is used as the standard, it shall mean the total area of all floors measured from the interior faces of the building, excluding the floor or part thereof used for the storage or parking of merchandise and not used by the public, or, if so provided in the schedule, only the floor area used by the public for a specific use. Where seating arrangement is used as the standard, it shall mean 24 linear inches of benches, pews or spaces for loose chairs or similar seating facilities. The spacing of pews shall be 30 inches on center. Where the number of employees is used as the standard, it shall mean the maximum number of employees on any two successive shifts. Where “indoor customer service area” is used as the standard, it shall mean the total area of all floors measured from the interior faces of the building. The only permissible exclusions are the floors or parts thereof shown as storage, mechanical room, restrooms or kitchens on the approved floor plans. Where “outdoor customer service area” is used as the standard, it shall mean the total area of the outdoor patio, or public access serving area, and shown on the approved site plan.

§ 1284.05 SPACE SCHEDULE FOR OFF-STREET PARKING.

   Off-street parking shall be required as provided in the following schedule:

§ 1284.06 MODIFICATION OF SCHEDULE.

   (A)   Variance. The Board of Zoning Appeals may grant a variance to the schedule provided in § 1284.05 in accordance with existing laws of the city.
   (B)   Land Bank. The Planning Commission may grant a conditional permit to allow selected off-street parking facilities to be maintained as a lawn until such time as such off-street parking facilities may be deemed necessary as determined by the Planning Commission or the Building Commissioner. At that time, the “land banked” parking facilities shall be brought into compliance with the regulations of this chapter and any conditions as set forth by the Planning Commission in the conditional permit.

§ 1284.07 LOCATION OF PARKING FACILITIES.

   For residential uses and all uses permitted in Class E Districts, the parking facilities shall be located upon the same lot. For institutional, charitable and public uses, the parking facilities shall be located upon the same lot or within 200 feet of a boundary line of such lot, but not across a major thoroughfare. For commercial uses, the parking facilities shall be located upon the same lot or within 400 feet of a boundary line of such lot, but not across a major thoroughfare.

§ 1284.08 ACCESS TO PARKING AREAS.

   There shall be adequate provision for ingress and egress to all parking areas. No access drives or curb cuts for driveway aisles shall be located closer than 75 feet from the right-of-way line of an intersection. In addition, where the lot or parking spaces do not provide direct access to a public street or alley, an access drive shall be provided, with a dedicated easement of access, as follows:
   (A)   For single-, two- or three-family residential dwellings, the access drive shall be a minimum of nine feet in width.
   (B)   For all other residential uses and all other uses, except for those in the Class E District, the access drive shall be a minimum of 18 feet in width.
   (C)   All parking spaces, except those required for single-, two- or three-family dwellings, shall have access to a public street or alley in such a manner that any vehicle leaving or entering the parking area from or into a public street or alley shall be traveling in a forward motion.

§ 1284.09 SURFACE IMPROVEMENTS.

   All parking areas and access driveways shall be concrete, asphalt or brick, with adequate drainage so that no injury is caused to adjacent property or water drained across a public sidewalk. Appropriate bumper guards shall be provided to define or limit the parking facilities whenever a parking lot extends to a property line in order to prevent any part of a parked vehicle from extending beyond the property line.

§ 1284.10 YARD REGULATIONS AND PROTECTION OF ADJACENT AREAS.

   Parking facilities, when adjacent to and across the street from a residential district, must be to the rear of the building setback line. When the same abuts a residential district, they shall have a rear and side yard of not less than 75 feet if in a Class C District and not less than 50 feet if in a Class E District. Parking facilities having a capacity of more than six spaces, when abutting on the rear or sides of a residential district, shall have bumper guards placed to limit the parking area, and rear or side yards landscaped with a hedge and shrubs or the facility screened by a fence at least five feet high above the finished grade.

§ 1284.11 PARKING SIGNS AND ILLUMINATION.

   All signs shall be limited to indicate the operator, the purpose of the business served, or instructions for parking. Only one sign shall be permitted for each street which abuts the area and such sign shall not exceed 20 square feet or extend over 12 feet in height or be located outside of that part of the lot used for parking or nearer than 25 feet to a lot line of a residential district. Parking facilities shall be illuminated whenever a use is conducted in the main building and the public streets are lighted, and such illumination shall be so designed and located that the same is not of excessive brightness to adjoining residential districts and streets.

§ 1284.12 OFF-STREET LOADING SPACE.

   Off-street loading and unloading space is required by this chapter as a condition precedent to the exercise of any use in a Class C or Class E District. Such space shall not be less than ten feet in width and 25 feet in length for a building less than 20,000 square feet in ground floor area. Each required loading space for a building of 20,000 square feet or more of ground floor area shall be not less than 14 feet wide by 60 feet in length. Such space shall be located to the side or rear of the building in a Class E District and only in the rear of buildings in a Class C District. Such space shall be located so that during the process of unloading and loading no part of the truck protrudes into the front yard. Each establishment shall have one such loading space for a building up to 40,000 square feet in gross floor area and two loading spaces for a building with a gross floor area of 40,000 to 100,000 square feet. Buildings with over 100,000 square feet of ground floor area require three loading spaces.

§ 1284.13 EXTERIOR LIGHTING.

   Parking and circulation area, pedestrian areas and related outdoor use areas shall be illuminated to provide safety and security for the users of these areas, to provide security for property, and to maintain privacy for adjacent residential properties. Exterior lighting shall be designed, installed and maintained according to the following standards:
   (A)   Illumination Levels.
      (1)   Except as provided to division (B) below, exterior lighting provide minimum maintained horizontal footcandle (fc) illumination as follows:

      (2)   Exterior lighting in parking and pedestrian areas may be reduced to the property security level during hours when these areas are not in use.
   (B)   Residential Parking. The minimum illumination levels in division (A) above shall not apply to residential or multiple-family parking areas with ten or fewer parking spaces. These areas shall be provided with appropriate residential-type luminaries as shown on site plans approved by the Planning Commission according to the provisions of applicable chapters of the Zoning Code.
   (C)   Uniformity Ratio. Average illumination levels shall not exceed four times the minimum level.
   (D)   Light Trespass. In order to maintain privacy, exterior lighting shall be designed and maintained to provide a maximum of one horizontal footcandle illumination at side or rear property lines which are adjacent to a residential use or zoning district.
   (E)   Luminaire Height.
      (1)   The maximum luminaire height in A-l, A-2, B-l, B-2, B-3, and B-4 shall be ten feet.
      (2)   The maximum luminaire height in other districts shall be 25 feet. However, the Planning Commission may approve greater heights upon a showing by the applicant that the additional height complies with both of the following standards:
         (a)   The additional height is necessary to efficiently illuminate outdoor areas; and
         (b)   The additional height will have no adverse effect on adjacent properties.
   (F)   Glare. Exterior lighting shall be designed and maintained so that glare is not cast on adjacent properties, regardless of use, or on adjacent streets. All luminaries over ten feet in height shall be cut-off types which include shields or other devices which eliminate all light above an angle of 85 degrees, as measured from the vertical axis of the light source. For the purpose of this division, “glare” is defined as the brightness of a light source which causes eye discomfort.
   (G)   Intermittent Light. No intermittent, flickering, moving, strobe or similar types of light, either inside or outside a building, shall be visible from the street or from adjacent properties.
   (H)   Exclusions. The standards in this section do not apply to street lighting to outdoor recreation activities lighting not being reviewed for site plan conformity shall be excluded from the provisions of division (A) of this section.
   (I)   Enforcement. Site plans submitted to the Planning Commission shall include data analyses (photometric plan), prepared by persons competent to do so, that the proposed exterior lighting system complies with the standards in this section.
