44 - V VISITOR-SERVING/HIGHWAY COMMERCIAL OVERLAY DISTRICT

14.44.010 - Purpose and intent.

The purpose of the V overlay district is to provide for commercial development that will serve visitors to the city as well as local residents. The intent is to provide a mechanism for requiring adequate visitor-serving commercial uses in areas serving the beach and major highways and to insure that such uses are appropriately integrated with other commercial needs of the community.

14.44.020 - Applicability.

The requirements of the V overlay district, as set forth in this chapter, shall apply to those parcels designated for both visitor-serving highway commercial and general commercial use, as shown on the adopted coastal land use plan map.

14.44.030 - Exceptions.

Exceptions to the provisions of the V overlay district shall be governed by the following conditions:

1.

Parcels Fronting on Linden Avenue between Fifth and Eighth Streets. If it is determined that 58.40 percent of the land in this area (i.e., the percent of land area devoted to visitor-serving/highway commercial uses as of December 15, 1979) is currently maintained in such uses at the time of permit approval, the provisions of the V overlay district shall not apply.

2.

Other Parcels. The planning commission may grant an exception to the provisions of the V district for other parcels so designated if it determines:

a.

That existing visitor-serving/highway commercial uses in areas subject to the V overlay district are adequate to serve highway travelers or visitors to the city and the Carpinteria Valley at the time of permit approval and for the foreseeable future; and

b.

That there is an overriding need to provide additional commercial uses to serve local residents, business and industry; or

c.

That the proposed visitor-serving commercial use would generate a level and type of new employment and increased demand for housing in the city that would not be in balance with the existing housing supply.

14.44.040 - Processing.

Prior to the issuance of any permit for development on property zoned or to be rezoned with the V overlay, a development plan shall be submitted, processed and approved as provided in Chapter 14.68.

14.44.050 - Permitted uses subject to development plan approval.

Uses permitted in the V district subject to development plan approval are as follows:

1.

Hotel, motel, restaurant;

2.

Service and retail commercial uses normally associated with the needs of visitors and which may also serve local residents, e.g., drug stores and pharmacies, food stores, gift and apparel shops, and hardware stores, but not including such uses as office and professional buildings, appliance repair shops;

3.

Recreational facilities, including but not limited to playgrounds, biking and hiking trails, tennis courts, swimming pools, racquetball and handball courts;

4.

Uses, buildings, and structures accessory and customarily incidental to the above uses.

14.44.060 - Uses permitted with a conditional use permit.

Uses permitted with a conditional use permit shall be as follows: amusement enterprises conducted partly or entirely outside of a completely enclosed building, e.g., concession stands, bicycle or roller skate rentals.

14.44.070 - Applicability of CPD and CB districts' standards.

All of the standards of the commercial planned development (CPD) or central business (CB) district, whichever is used as the base zoning district, shall also apply to the V overlay district.
