There is established the marijuana retail overlay zone as a special overlay district subject to the uses and purposes set forth herein.

The purposes for the marijuana retail overlay zone are:

(1)

To define the area where, marijuana retail or medical cannabis dispensary (as defined in CMC 21.51.020) uses may be established through a conditional use permit;

(2)

To identify the boundaries of the marijuana retail overlay zone; and

(3)

To protect the public interest by setting forth standards and procedures.

The following uses are allowed in the marijuana retail overlay zone:

(1)

All permitted, limited or conditional uses in accordance with underlying zoning district designation, which is "C-2 (general commercial)" as set forth on the city zoning map; and

(2)

Marijuana retailers and medical cannabis dispensaries as defined in CMC 21.51.020.

This chapter restricts the location of marijuana retailers and medical cannabis dispensaries solely to the area described in section 21.14.040 through a conditional use permit as set forth in 21.51.030 subject to the requirements in chapter 21.51 entitled "Recreational Marijuana," which also applies to medical marijuana dispensaries.

The boundary and area which shall contain the marijuana retail overlay zone is depicted on the City of Cheney's official zoning map, a copy of which is maintained in the city clerk's office and the Department of Community Development.
