Legal Provisions

19.2-84 Relationship to Other Provisions

  1. A.

    Higher Provision Controls.  If a provision of this Chapter is inconsistent with another provision of this Chapter, or with a provision found in other County codes or ordinances or state or federal laws or regulations, the provision that imposes higher restrictions or more stringent controls govern. However, if a build-to-line or maximum setback is smaller than a minimum setback, the build-to-line or maximum setback controls.

  2. B.
    Private Agreements. This Chapter does not supersede private easements, covenants, and restrictions ("private agreements").  A use or development shall comply with both this Chapter and the private agreement.  If that is not possible, the stricter provision applies.

 

19.2-85 Severability

19.2-86 Repeal of Prior Ordinances

  1. A.
    Prior Zoning Ordinances Repealed. Except as provided below, the Chesterfield County Zoning Ordinance, Chapter 19.1 of the Code of Chesterfield 1997, as amended, is hereby repealed.
  2. B.
    Pre-Existing Rights. Unless expressly provided in this Chapter, this repeal does not affect or impair any right accrued or acquired, act done, offense committed, or liability, penalty, forfeiture, or punishment incurred prior to the time the repeal takes effect. These remain in effect to the same extent as if that repeal had not occurred.

19.2-87 Effective Date

This Chapter is effective as of January 1, 2026. Any amendments to this Chapter become effective upon their adoption unless the adopting ordinance specifies a different effective date.
