Administration
This Article establishes or describes the entities involved in zoning administration, their composition, and their authority.
The Director of Planning is established by § 7.4 of the Chesterfield County Charter, is charged with administering this Chapter, and has immediate direction and control of the Planning Department.
The Board of Supervisors renders final decisions on legislative matters such as text amendments, rezonings, and conditional uses. See County Charter Chapter 3 and County Code Chapter 2, Article II.
The Planning Commission submits recommendations on legislative actions, and makes administrative decisions where established in this Chapter. The Planning Commission and its appointment procedures, and its responsibilities are established by § 7.1-7.2 of the County Charter, Chapter 7 and Title 15.2, Article 2 of the Code of Virginia.
The Board of Zoning Appeals shall consist of five County residents. Each member shall be appointed by the Circuit Court for a term of five years. The Board of Zoning Appeals hears appeals, makes final decisions on variances and special exceptions, and may exercise other powers as provided in this Chapter. The Board of Zoning Appeals and its appointment procedures, and its responsibilities are established by § 7.3 of the County Charter and Title 15.2, Chapter 22 of the Code of Virginia.
