AMENDMENTS TO GENERAL PLAN, LAND USE ORDINANCE, AND OFFICIAL MAPS
11-6-1: POWER OF PLANNING COMMISSION AND CITY COUNCIL:
The planning commission and city council may initiate changes or modification of any section or regulation of this title, the zoning map, the general plan, or the general plan maps as necessity may arise. (Ord. 2009-22, 11-24-2009)
11-6-2: PETITION FOR CHANGE TO LAND USE ORDINANCE OR ZONING MAP:
A. Petition: Any person desiring to initiate a change in this title or the zoning map shall submit a petition to the planning and zoning administrator, who shall schedule the petition for consideration by the planning commission. The planning and zoning administrator shall review the petition to see that all information and items required by this title are included in the petition. (Ord. 2009-22, 11-24-2009)
B. Information And Items Required: The petition shall be submitted in writing on forms prepared by the city and shall contain the following information:
1. Designation of the specific section amendment or zone change desired.
2. The reason and justification for such change.
3. A draft of the proposed section amendment or a complete and accurate legal description of the area proposed to be rezoned.
4. An accurate property map showing all areas to be included in the rezoning and all properties immediately adjacent to the proposed rezone area.
5. A list of all property owners within three hundred feet (300') of the boundaries of the property to be rezoned, according to the assessment rolls of the Davis County assessor. Stamped, addressed envelopes for each property owner shall also be submitted by the applicant. The return address shall be for the city. (Ord. 2015-19, 12-8-2015)
C. Fee: The petition shall be accompanied by the appropriate fee, as specified from time to time by the city council in the fee schedule. (Ord. 2009-22, 11-24-2009)
11-6-3: REVIEW PROCEDURE FOR LAND USE ORDINANCE OR ZONING MAP:
A. Planning Commission Review: The planning commission shall review the petition for change to this title or the zoning map and certify its recommendations to the city council. The planning commission may recommend adoption of the proposed amendment when it finds that the proposed amendment is in accordance with the general plan and map, or that changed conditions make the proposed amendment necessary to fulfill the purposes of this title.
B. Public Hearings: A public hearing shall be held by the planning commission and city council to review petitions for change to this title or the zoning map.
C. Notice Requirements: Notice of the public hearing(s) to be held in connection with a petition to amend this title or the zoning map shall be provided as outlined in section 11-1-10, table 11.2, "Public Notice Requirements", of this title.
1. At least ten (10) days prior to the planning commission or city council meeting during which a petition requesting action regarding identifiable parcels of property is to be considered, the planning and zoning administrator or designated agent shall post a minimum of one sign on each frontage of the subject property stating the proposed or requested action and the date, time and location of the planning commission or city council meeting where the petition will be considered.
2. In the case of multiple properties in the same vicinity, the planning and zoning administrator shall post a minimum of one sign at a general location for all properties under consideration stating the proposed or requested action and the date, time and location of the planning commission meeting where the petition will be considered.
D. City Council Decision: Upon receipt of the planning commission's recommendation, the city council may approve, approve with conditions, or deny the petition. Amendments to this title and the zoning map are discretionary legislative actions, even if the petition otherwise conforms to the requirements of this title. (Ord. 2009-22, 11-24-2009)

B. Information And Items Required: The petition shall be submitted in writing on forms prepared by the city and shall contain the following information:
1. Designation of the specific text or map amendment desired.
2. The reason and justification for such change.
3. A draft of the proposed text or map amendment.

C. Fee: The petition for amendment shall be accompanied by the appropriate fee, as specified from time to time by the city council in the fee schedule. (Ord. 2009-22, 11-24-2009)

A. Notice Of Intent: The city shall provide notice of its intent to prepare comprehensive amendments to the general plan or general plan maps to each "affected entity" (as defined in section 11-1-10 of this title), the state's automated geographic reference center, the Wasatch front regional council, and the state planning coordinator or the Utah public notice website.
B. Planning Commission Review: The planning commission shall review the petition for change to the general plan or general plan maps and certify its recommendations to the city council in accordance with Utah code title 10, chapter 9a, as amended.
C. Public Hearing(s): Public hearing(s) shall be held by the planning commission to review petitions for change to the general plan or map. The public hearing(s) shall be held in accordance with Utah code title 10, chapter 9a, as amended.
D. Notice Requirements: Notice of the public hearing(s) to be held for a petition to amend the general plan or general plan maps shall be provided as outlined in section 11-1-10, table 11.2, "Public Notice Requirements", of this title.
E. City Council Decision: Upon receipt of the planning commission's recommendation, the city council may adopt or reject the proposed amendment to the general plan or general plan maps either as proposed by the planning commission, or after making any revision that the city council considers appropriate.
