CHAPTER 9

RESIDENTIAL ZONES

11-9A-1: PURPOSE:

The R-1-9 residential zone is established to provide low density residential neighborhoods for the encouragement and promotion of an environment for family life by providing an area for single-family detached dwellings on individual lots. Certain nonresidential uses that are compatible with residential developments are also anticipated and provided for. (Ord. 2009-26, 11-24-2009)

11-9A-2: PERMITTED USES:

The following buildings, structures, and uses of land shall be permitted in the R-1-9 residential zone upon compliance with the requirements set forth in this code:
Beekeeping.
Churches.
Daycares, residential.
Home occupations.
Parks and open space.
Preschools, residential.
Schools.
Single-family dwellings. (Ord. 2016-06, 9-27-2016)

11-9A-3: CONDITIONAL USES:

The following buildings, structures, and uses of land shall be allowed in the R-1-9 residential zone upon compliance with the requirements set forth in this code and upon obtaining a conditional use permit as specified in chapter 4 of this title:
Group homes for persons with a disability.
Group homes for the elderly.

11-9A-4: AREA AND FRONTAGE REGULATIONS:

   A.   Lot Size: The minimum lot size shall be nine thousand (9,000) square feet.
   B.   Lot Width: The minimum lot width, as measured at the front setback line shall be eighty five feet (85').
   C.   Lot Width, Corner Lots: Each corner lot shall have a minimum lot width, as measured at the front setback line, of ninety feet (90').
   D.   Lot Frontage: The minimum lot frontage shall be seventy feet (70'). (Ord. 2009-26, 11-24-2009)

11-9A-5: YARD REGULATIONS:

   A.   Front Yard: The minimum front yard setback for all main buildings shall be thirty feet (30').
   B.   Side Yard: The minimum side yard setback for all main buildings shall be eight feet (8') on each side.
   C.   Side Yard, Corner Lots: The minimum side yard setback for all main buildings on corner lots shall be twenty feet (20') on the side adjacent to a street.
   D.   Rear Yard: The minimum rear yard setback for all main buildings shall be twenty five feet (25'). (Ord. 2009-26, 11-24-2009)

11-9A-6: HEIGHT REGULATION:

No main building shall be erected to a height greater than thirty five feet (35'). No accessory building shall exceed twenty feet (20') in height or the maximum height of the main building, whichever is lower. (Ord. 2009-26, 11-24-2009)

11-9A-7: DENSITY:

Density shall not exceed 4.84 dwelling units per acre. (Ord. 2009-26, 11-24-2009)

11-9A-11: OTHER REQUIREMENTS:

   A.   Landscaping And Open Space: A minimum of ten percent (10%) of the total project area shall be provided as landscaped open space. All landscaping shall comply with the provisions of chapter 21 of this title.
   B.   Floor Area: Each dwelling unit shall have a minimum finished floor area of not less than one thousand two hundred (1,200) square feet above grade for ramblers with a full basement; all other styles shall have a minimum finished floor area of not less than one thousand five hundred (1,500) square feet above grade.
   C.   Garages: Each dwelling unit shall have an attached two car garage, which shall be a minimum of four hundred (400) square feet in size.
   D.   Development Agreement: A development agreement may be required for all new development in the R-1-9 Zone. All applications for a rezone, preliminary plat, or site plan approval shall be conditioned upon final approval of the development agreement by the City Council.
   E.   Footings And Foundation Required: All main buildings shall be constructed on a permanent footing and foundation.
   F.   Restrictions: No area needed to meet the lot width, frontage, area, setback or other requirements of this article may be divided, sold, or leased separate from such lot or building. (Ord. 2009-26, 11-24-2009; amd. Ord. 2022-06, 2-22-2022; Ord. 2022-07, 4-12-2022)

   A.   Front Yard: The minimum front yard setback for all main buildings shall be twenty feet (20').
   B.   Side Yard: The minimum side yard setback for all main buildings shall be eight feet (8') on each side.
   C.   Side Yard, Corner Lots: The minimum side yard setback for all main buildings on corner lots shall be twenty feet (20') on the side adjacent to a street.

11-9C-1: PURPOSE:

The R-1-6 Residential Zone is established to provide medium density residential neighborhoods for the encouragement and promotion of an environment for family life with houses having smaller lot areas. To provide lower housing construction costs and to encourage efficiency in construction and Municipal service, certain nonresidential uses that are compatible with residential developments are also anticipated and provided for. 11-9C-2: PERMITTED USES:

The following buildings, structures, and uses of land shall be permitted in the R-1-6 Residential Zone upon compliance with the requirements set forth in this Code:
Beekeeping.
Churches.
Daycares, residential.
Home occupations.
Parks and open space.
Preschools, residential.
Schools.

11-9C-3: CONDITIONAL USES:

   A.   Lot Size: The minimum lot size shall be six thousand (6,000) square feet.
   B.   Lot Width: The minimum lot width, as measured at the front setback line, shall be sixty feet (60').
   C.   Lot Width, Corner Lots: Each corner lot shall have a minimum lot width, as measured at the front setback line of seventy feet (70').

   A.   Front Yard: The minimum front yard setback for all main buildings shall be twenty feet (20').
   B.   Side Yard: The minimum side yard setbacks for all main buildings shall be six feet (6') on each side.

The following buildings, structures, and uses of land shall be permitted in the R-2 residential zone upon compliance with the requirements set forth in this code:
Churches.
Daycares, residential.
Group homes for persons with a disability.
Group homes for the elderly.
Home occupations.
Multiple-family dwellings.
Parks and open space.
Preschools, residential.
Schools.
Single-family dwellings.

11-9D-3: CONDITIONAL USES:

The following buildings, structures, and uses of land shall be allowed in the R-2 residential zone upon compliance with the requirements set forth in this code and upon obtaining a conditional use permit as specified in chapter 4 of this title:

11-9D-4: AREA AND FRONTAGE REGULATIONS:

   A.   Lot Size: The minimum lot size shall be six thousand five hundred (6,500) square feet for single-family dwellings and eight thousand (8,000) square feet for two-family dwellings. There shall be no minimum lot size for multiple-family dwellings. The density shall not exceed the density stated in section 11-9D-7 of this article.
   B.   Lot Width: The minimum lot width, as measured at the front setback line, shall be sixty five feet (65') for single- family dwellings and eighty feet (80') for two-family dwellings. There shall be no minimum lot width for multi- family dwellings.
   C.   Lot Width, Corner Lots: Each corner lot shall have a minimum lot width, as measured at the front setback line, of seventy five feet (75') for single-family dwellings and ninety feet (90') for two-family dwellings.
   D.   Lot Frontage: The minimum lot frontage for single-family dwellings shall be sixty feet (60') and seventy feet (70') for two-family dwellings. There shall be no minimum lot frontage for multi-family dwellings. (Ord. 2010-09, 6-22-2010)

11-9D-5: YARD REGULATIONS:

   A.   Front Yard: The minimum front yard setback for all main buildings shall be twenty five feet (25').
   B.   Side Yard: The minimum side yard setback for all main buildings shall be eight feet (8') on each side.
   C.   Side Yard, Corner Lots: The minimum side yard setback for all main buildings on corner lots shall be fifteen feet (15') on the side adjacent to a street.
   D.   Rear Yard: The minimum rear yard setback for all main buildings shall be twenty five feet (25').
   E.   Accessory Buildings: No accessory building shall be located in the required front yard area. The minimum distance between accessory buildings and main buildings or other accessory buildings shall be six feet (6') at the closest points.
      1.   Accessory buildings up to ten feet (10') in height shall be located at least two feet (2') away from any side or rear property line.
      2.   Accessory buildings between ten feet (10') and twenty feet (20') in height shall be located at least eight feet (8') from any side or rear property line.
   F.   Multiple-Family Buildings: Separate multiple-family buildings built on the same lot or parcel shall maintain a distance of thirty feet (30') at the closest points. (Ord. 2009-29, 11-24-2009)

11-9D-6: HEIGHT REGULATION:

11-9D-7: DENSITY:

11-9D-8: LOT COVERAGE:

   A.   Lot coverage by all buildings, including main and accessory buildings, shall not be more than forty five percent (45%) of the total lot or parcel area.
   B.   The combined footprint of all accessory buildings shall not exceed forty percent (40%) of the footprint of the main building(s). (Ord. 2009-29, 11-24-2009)

11-9D-9: PARKING, LOADING AND ACCESS:

11-9D-11: OTHER REQUIREMENTS:

   A.   Landscaping And Open Space: A minimum of twenty percent (20%) of the total project area shall be provided as landscaped open space. All landscaping shall comply with the provisions of chapter 21 of this title.
   B.   Floor Area: Each single-family and two-family dwelling unit shall have a minimum finished floor area of not less than one thousand two hundred (1,200) square feet above grade for ramblers with a full basement; all other styles shall have a minimum finished floor area of not less than one thousand five hundred (1,500) square feet above grade. Multiple-family dwellings shall have a minimum finished floor area of not less than one thousand sixty (1,060) square feet per dwelling unit.
   C.   Garages: Each single-family and two-family dwelling unit shall have an attached two (2) car garage, which shall be a minimum of four hundred (400) square feet in size.
   D.   Development Agreement: A development agreement may be required for all new development in the R-2 zone. All applications for a rezone, preliminary plat, or site plan approval shall be conditioned upon final approval of the development agreement by the city council.
   E.   Multiple-Family Dwelling Exterior Building Materials:
      1.   Non-Permitted exterior building materials for main buildings are vinyl siding, aluminum siding, fiber cement panels, unfinished poured concrete, rusted metal, and sheet metal.
      2.   Accessory buildings shall be built with a finished, all weather exterior material. Detached garages and carports shall be finished to match the exterior of the main building.
      3.   Any front building elevation or elevation facing a street or right of way shall include at least one (1) of the following: brick, stone, or rock.
   F.   Footings And Foundation Required: All main buildings shall be constructed on a permanent footing and foundation.
   G.   Restrictions: No area needed to meet the lot width, frontage, area, setback or other requirements of this article may be divided, sold, or leased separate from such lot or building.
   H.   Design Standards: All new site development or construction in the R-2 residential zone shall incorporate the appropriate design standards described in chapter 18 of this title. (Ord. 2009-29, 11-24-2009; amd. Ord. 2022-06, 2-22-2022; Ord. 2022-07, 4-12-2022; Ord. 2024-17, 10-18-2024)

11-9E-1: PURPOSE:

The R-3 residential zone is established to provide an attractive setting for medium and high density multiple-family residential development. Certain nonresidential uses that are compatible are also anticipated and provided for. (Ord. 2009-30, 11-24-2009)

11-9E-2: PERMITTED USES:

The following buildings, structures, and uses of land shall be permitted in the R-3 residential zone upon compliance with the requirements set forth in this code:
Churches.
Daycares, residential.
Group homes for persons with a disability.
Group homes for the elderly.
Home occupations.
Multiple-family dwellings.
Parks and open space.
Preschools, residential.
Schools.
Single-family dwellings.

11-9E-3: CONDITIONAL USES:

The following buildings, structures, and uses of land shall be allowed in the R-3 residential zone upon compliance with the requirements set forth in this code and upon obtaining a conditional use permit as specified in chapter 4 of this title:
Assisted living facilities.
Convalescent facilities.
Nursing or rest homes.

11-9E-4: AREA AND FRONTAGE REGULATIONS:

   A.   Lot Size: The minimum lot size shall be six thousand five hundred (6,500) square feet for single-family dwellings and eight thousand (8,000) square feet for two-family dwellings. There shall be no minimum lot size for multiple-family dwellings. The density shall not exceed the density stated in section 11-9E-8 of this article.
   B.   Lot Width: The minimum lot width, as measured at the front setback line, shall be sixty five feet (65') for single- family dwellings and eighty feet (80') for two-family dwellings. There shall be no minimum lot width for multi- family dwellings.
   C.   Lot Width, Corner Lots: Each corner lot shall have a minimum lot width, as measured at the front setback line, of seventy five feet (75') for single-family dwellings and ninety feet (90') for two-family dwellings.
   D.   Lot Frontage: The minimum lot frontage for single-family dwellings shall be sixty feet (60') and seventy feet (70') for two-family dwellings. There shall be no minimum lot frontage for multi-family dwellings. (Ord. 2010-09, 6-22-2010)

11-9E-5: YARD REGULATIONS:

   A.   Front Yard: The minimum front yard setback for all main buildings shall be twenty five feet (25').
   B.   Side Yard: The minimum side yard setback for single-family homes shall be eight feet (8') per side; the minimum side yard setback for two-family and multiple-family dwellings shall be ten feet (10') on each side.
   C.   Side Yard, Corner Lots: The minimum side yard setback for all main buildings on corner lots shall be fifteen feet (15') on the side adjacent to a street.
   D.   Rear Yard: The minimum rear yard setback for all main buildings shall be twenty five feet (25'), with the exception of multiple-family dwellings, which shall be thirty feet (30').
   E.   Accessory Buildings: No accessory buildings shall be located in the required front yard area. The minimum distance between accessory buildings and main buildings or other accessory buildings shall be six feet (6') at the closest points.
      1.   Accessory buildings up to ten feet (10') in height shall be located at least two feet (2') away from any side or rear property line.
      2.   Accessory buildings between ten feet (10') and twenty feet (20') in height shall be located at least eight feet (8') from any side or rear property line. (Ord. 2009-30, 11-24-2009)

11-9E-6: HEIGHT REGULATION:

11-9E-7: DISTANCE BETWEEN BUILDINGS:

Separate multiple-family buildings built on the same lot or parcel shall maintain a distance of thirty feet (30') at the closest points. (Ord. 2009-30, 11-24-2009)

11-9E-8: DENSITY:

Density shall not exceed sixteen (16) dwelling units per acre. (Ord. 2009-30, 11-24-2009)

11-9E-9: LOT COVERAGE:

   A.   Lot coverage by all buildings, including main and accessory buildings, shall not be more than forty five percent (45%) of the lot or parcel area.
   B.   The combined footprint of all accessory buildings shall not exceed forty percent (40%) of the footprint of the main building(s). (Ord. 2009-30, 11-24-2009)

11-9E-12: SITE PLAN APPROVAL:

Site plan approval shall be required for all buildings containing two (2) or more units, in accordance with the provisions of chapter 5 of this title. (Ord. 2009-30, 11-24-2009)

11-9E-13: OTHER REQUIREMENTS:

   A.   Landscaping And Open Space: A minimum of twenty-five percent (25%) of the total project area shall be provided as landscaped open space. All landscaping shall comply with the provisions of chapter 21 of this title.
   B.   Floor Area: Each single-family and two-family dwelling unit shall have a minimum finished floor area of not less than one thousand two hundred (1,200) square feet above grade for ramblers with a full basement; all other styles shall have a minimum finished floor area of not less than one thousand five hundred (1,500) square feet above grade. Multiple-family dwellings shall maintain an average finished floor area of not less than one thousand sixty (1,060) square feet per dwelling unit above grade. In no case, however, shall a multiple-family dwelling unit have a minimum finished floor area of less than seven hundred (700) square feet.
   C.   Walls And Fences: Walls or fences may be required around all multiple-family developments. The height, type, location, and materials of such walls and fences shall be approved by the planning commission as part of the site plan review.
   D.   Garages: Each single-family and two-family dwelling unit shall have an attached two (2) car garage, which shall be a minimum of four hundred (400) square feet in size.
   E.   Development Agreement: A development agreement may be required for all new development in the R-3 residential zone. All applications for a rezone, preliminary plat, or site plan approval shall be conditioned upon final approval of the development agreement by the city council.
   F.   Multiple-Family Dwelling Exterior Building Materials:

      2.   Accessory buildings shall be built with a finished, all weather exterior material. Detached garages and carports shall be finished to match the exterior of the main building.
      3.   Any front building elevation or elevation facing a street or right of way shall include at least one (1) of the following: brick, stone, or rock.
   G.   Footings And Foundation Required: All main buildings shall be constructed on a permanent footing and foundation.
   H.   Restrictions: No area needed to meet the lot width, frontage, area, setback or other requirements of this article may be divided, sold, or leased separate from such lot or building.
   I.   Design Standards: All new site development or construction in the R-3 residential zone shall incorporate the appropriate design standards described in chapter 18 of this title. (Ord. 2009-30, 11-24-2009; amd. Ord. 2022-06, 2-22-2022; Ord. 2024-17, 10-18-2024)

11-9F-1: PURPOSE:

The R-M mobile home residential zone is established to provide a residential environment within the city primarily for the accommodation of mobile homes and modular housing units, either within an established mobile home park under one ownership or within a mobile home subdivision, with lots under separate ownership. The R-M mobile home residential zone is intended to be characterized by attractively landscaped mobile homes and modular units with amenities comparable to those of any other residential development. This zone is also intended to assure a high degree of compatibility between mobile home parks and subdivisions and adjacent residential developments of other types. (Ord. 2009-31, 11-24-2009)

11-9F-2: PERMITTED USES:

The following buildings, structures, and uses of land shall be permitted in the R-M mobile home zone upon compliance with the requirements set forth in this code:
Manufactured homes.
Mobile homes.
Modular homes.
Parks and open space. (Ord. 2009-31, 11-24-2009)

11-9F-3: CONDITIONAL USES:

The following buildings, structures, and uses of land shall be allowed in the R-M mobile home zone upon compliance with the requirements set forth in this code and upon obtaining a conditional use permit as specified in chapter 4 of this title:
Group homes for persons with a disability.
Group homes for the elderly.

11-9F-4: GENERAL REQUIREMENTS:

   A.   Skirting: Skirting material shall be provided entirely around the periphery of each mobile home, manufactured home, and modular home to conceal the open area beneath the unit's frame. Said skirting shall be of durable construction, fireproof and compatible with the exterior finish of the unit.
   B.   Transient Mobile Homes: Mobile home lots or mobile home spaces within a mobile home subdivision or mobile home park shall not be used for transient trailer or transient mobile home sites. Said lots or spaces shall be occupied only by mobile homes which are placed upon piers or jacks and attached to public utilities.
   C.   Minimum Area: The minimum land area required for the development of a mobile home park or mobile home subdivision shall be five (5) acres.
   D.   Guarantees: Adequate and reasonable guarantees must be provided as determined by the planning commission through the site plan process for permanent retention of open spaces and for the provision of roadways, storage facilities, service facilities and landscaping resulting from the application of these regulations. Guarantees may be in the form of a bond or mortgage on real estate in the sum to be determined by the planning commission, which form must be approved by the city council and the city attorney. 11-9F-5: MOBILE HOME PARKS:

   A.   Space For Mobile Home: Each site or space in a mobile home park shall be a minimum of four thousand five hundred (4,500) square feet in area.
   B.   Width: Each site in a mobile home park shall have a width of not less than fifty feet (50').
   C.   Front Yard: The minimum front yard setback shall be ten feet (10'), measured from the edge of the roadway. The towing hitch may extend into this front yard area not more than five feet (5') and shall be hidden from view.
   D.   Side Yard: The minimum side yard for mobile homes shall be ten feet (10').
   E.   Side Yard, Corner Spaces: The minimum side yard for all structures on corner spaces shall be fifteen feet (15') on the side adjacent to a street, except that when the side yard is adjacent to a street not within the mobile home park, the side yard adjacent to a street shall not be used for parking.
   F.   Rear Yard: The minimum rear yard setback for all mobile homes shall be ten feet (10').
   G.   Accessory Building: No accessory building shall be located in the required front yard area. The minimum distance between accessory buildings and main buildings or other accessory buildings shall be six feet (6') at the closest points. Accessory buildings shall be located at least two feet (2') away from any side or rear property line. The maximum size of any accessory building shall be one hundred twenty (120) square feet of floor area.
   H.   Height: No building shall be erected to a height greater than fifteen feet (15').
   I.   Parking: See chapter 14 of this title. In addition, space shall be provided for the storage of boats, campers, trailers, etc.; at the amount of eighty (80) square feet of storage space for every mobile home space in the park. The designated storage area shall be hard surfaced with a material approved by the planning commission. It shall be fully enclosed by an opaque fence to screen the storage from the surrounding mobile home spaces.
   J.   Signs: See chapter 15 of this title.
   K.   Landscaping: All open areas, except for driveways, parking areas and other similar improvements, shall be landscaped with a natural material, free of weeds, which will prevent wind and water erosion. Acceptable landscaping will consist of cultivated vegetation and flower gardens, manicured shrubs, decorative rock, decorative ground cover or, as a minimum, a well groomed lawn. A combination of the listed landscaping materials is permitted.
   L.   Trash Storage: Containers for trash storage of a size, type and quantity approved by the city shall be provided in locations as to be concealed from street view, and shall be easily accessible by collection vehicles.
   M.   Walls And Fences: Walls and fences around individual spaces in a mobile home park shall not exceed six feet (6') in height. A wall or fence shall be erected around the perimeter of each mobile home park with a height and type of materials to be approved by the planning commission. A wall or fence located within the front yard of a space shall not exceed two feet (2') in height.
   N.   Street Standards: Streets constructed within a mobile home park shall be provided in such a pattern as to provide convenient traffic circulation within said park. They shall be built to the following standards:
      1.   For one-way traffic, fifteen feet (15') in width, plus extra width as necessary for maneuvering mobile homes.
      2.   For two-way traffic, thirty feet (30') in width.
      3.   For entrance roadways, minimum of thirty six feet (36') in width.
      4.   All roadways shall be hard surfaced and bordered by twenty four inch (24") rolled gutters or its equivalent.
      5.   Minimum thirty six inch (36") sidewalks shall be installed on all main roadways within the park.
   O.   Recreation Areas: A central recreation area shall be established in each mobile home park. The size of the recreation area shall be at least two hundred (200) square feet for each mobile home space. The area of the recreation space may contain community clubhouses, swimming pools, shuffleboards and other similar facilities provided exclusively for recreation purposes. The planning commission may permit decentralization of the recreation facilities, provided such areas are of adequate size to be usable and practical for group recreation. Guarantees must be provided to the city to assure that the recreation spaces will not be developed in a manner inconsistent with the approved site plan.
   P.   Administrative Office And Manager: Every mobile home park shall include a permanent building for office and administrative use. This building may include a single-family dwelling for the exclusive use of the owner or manager. A manager for the park shall be available twenty four (24) hours per day.
   Q.   Laundry: Laundry drying lines shall not be permitted on any mobile home sites.
   R.   Telephones: A mobile home park shall contain at least one public telephone for the use of park residents.
   S.   Utilities: All utility distribution facilities, including electrical service and television antenna services within a mobile home park, shall be placed underground. Transformers, terminal boxes, meter cabinets, pedestals and other necessary appurtenances to the underground facilities may be placed aboveground. All mobile home spaces must be served with water, gas, electricity, telephone and sanitary sewer.
   T.   Community Television Antenna: One single television antenna for community service may be situated within the mobile home park, which shall become part of the common facilities and shall be maintained in perpetuity in conjunction with other common open spaces and recreation areas.
   U.   Yard Lighting: A minimum of 0.2 foot-candles of light shall be required for protective yard lighting the full length of all driveways and walkways.
   V.   Storm Drainage: Storm drainage facilities shall be so constructed as to protect those that will reside in the mobile home park, as well as the property owners adjacent to the park.
   W.   Site Plan Approval: Site plan approval shall be required for all mobile home parks. In addition to the items required in chapter 5 of this title for site plan approval, the site plan shall show the items required in this article for mobile home parks. (Ord. 2009-31, 11-24-2009; amd. 11-9F-6: MOBILE HOME SUBDIVISIONS:

   A.   Lot Size: The minimum lot size shall be six thousand (6,000) square feet.
   B.   Lot Width: The minimum lot width, as measured at the front setback line, shall be sixty feet (60').
   C.   Lot Width, Corner Lots: Each corner lot shall have a minimum lot width, as measured at the front setback line, of seventy feet (70').
   D.   Front Yard: The minimum front yard setback shall be fifteen feet (15'). The towing hitch may extend into this front yard area not more than five feet (5') and shall be hidden from view.
   E.   Side Yard: The minimum side yard for mobile homes shall be ten feet (10').
   F.   Side Yard, Corner Lots: The minimum side yard on corner lots shall be twenty feet (20') on the side adjacent to a street.
   G.   Rear Yard: The minimum rear yard setback shall be ten feet (10').

   N.   Definition: For the purposes of this chapter, the term "mobile home" as used herein shall also include manufactured homes and modular housing units, as defined by chapter 3 of this title. (Ord. 2009-31, 11-24-2009)

11-9G-1: PURPOSE:

The R-1-open residential zone is established to provide low density, larger dwellings, aesthetically pleasing neighborhoods and to preserve open spaces within the neighborhoods; to provide for the development of remaining residential areas into one- family detached dwellings in a planned open space environment. Such developments are to be done in compliance with a development agreement. (Ord. 2009-32, 11-24-2009)

11-9G-2: PERMITTED USES:

The following buildings, structures, and uses of land shall be permitted in the R-1-open residential zone upon compliance with the requirements set forth in this code:
Beekeeping.
Churches.
Daycares, residential.
Home occupations.
Parks and open space.
Preschools, residential.
Schools.
Single-family dwellings. (Ord. 2016-06, 9-27-2016)

11-9G-3: CONDITIONAL USES:

The following buildings, structures, and uses of land shall be allowed in the R-1-open residential zone upon compliance with the requirements set forth in this code and upon obtaining a conditional use permit as specified in chapter 4 of this title:
Group homes for persons with a disability.
Group homes for the elderly.

11-9G-4: DENSITY:

The minimum density shall be three and five-tenths (3.5) dwellings per acre when one percent (1%) through four percent (4%) of the development is developed as open space. If five percent (5%) through nine percent (9%) is developed as open space, the density shall be four (4.0) dwellings per acre. The maximum allowed density shall be four and five-tenths (4.5) dwellings per unit when ten percent (10%) or more of the development is developed as open space. Open space does not include the landscaped areas on the residential lots or any land area with more than a thirty percent (30%) slope. (Ord. 2009-32, 11-24-2009)

11-9G-5: DEVELOPMENT AGREEMENT:

This zone requires that the developer and city negotiate a contract covering the development of the area which shall incorporate the requirements of this article and other requirements as agreed to by the parties. (Ord. 2009-32, 11-24-2009)

11-9G-6: ELEVATIONS:

Each residential unit will be built according to the elevations presented to the City during the approval process and those elevations shall be attached to the development agreement as exhibits. (Ord. 2009-32, 11-24-2009)

11-9G-7: TWO CAR GARAGE:

Each dwelling unit shall have an attached two car garage, which shall be a minimum of four hundred (400) square feet in size. (Ord. 2009-32, 11-24-2009)

11-9G-8: INFRASTRUCTURE REQUIRED:

The developer shall build the infrastructure, i.e., roads, sidewalks, sewer and water lines, trails, parks, tot lots, green spaces and other off site improvements as shown on the subdivision plat, which plat will be included in the development agreement by reference. (Ord. 2009-32, 11-24-2009)

11-9G-9: OPEN SPACE AND AMENITIES:

Open space requirements and other amenities agreed to between the City and the developer shall be included in the agreement. (Ord. 2009-32, 11-24-2009)

11-9G-10: HOMEOWNERS' ASSOCIATION:

The developer shall prepare any required homeowners' association agreements, restrictive covenants and bylaws, subject to the approval of the City. (Ord. 2009-32, 11-24-2009)

11-9G-11: SINGLE-FAMILY DWELLINGS:

All dwelling units within the development shall be single-family dwellings. (Ord. 2009-32, 11-24-2009)

11-9G-12: FINISHED FLOOR SPACE:

Each dwelling unit shall have a minimum finished floor area of not less than one thousand two hundred (1,200) square feet for ramblers with a full basement; all other styles shall have a minimum finished floor area of not less than one thousand five hundred (1,500) square feet above grade.
The numbers contained in this section are intended to be minimum requirements. The actual number shall be set forth in the development agreement. (Ord. 2009-32, 11-24-2009)

11-9G-13: FOUNDATIONS OR FOOTINGS REQUIRED:

Each dwelling shall be built upon a foundation or footings. No slab on grade construction is allowed. (Ord. 2009-32, 11-24-2009)

11-9G-14: BUILDING AREA:

Side yards, front yards, corner yards and rear yards shall be set in the development agreement. (Ord. 2009-32, 11-24-2009)

11-9G-15: RECORDING REQUIRED:

The developer shall be required at its expense to record, in the Davis County Recorder’s Office, the development agreement and covenants running with all the lots and land in the development and indicate on the subdivision plat(s) approved for each development the existence of the development agreement and the recording data. 11-9H-1: PURPOSE:

The R-3R redevelopment zone is established to provide an attractive setting for new and redeveloped high density multiple- family dwellings with upgraded design features. It is primarily intended to encourage the redevelopment of existing high density residential developments within the city. Certain nonresidential uses that are compatible with residential development are also anticipated and provided for. (Ord. 2009-33, 11-24-2009)

11-9H-2: PERMITTED USES:

Permitted uses in the R-3R zone shall be the same as those in the R-3 zone. (Ord. 2009-33, 11-24-2009)

11-9H-3: CONDITIONAL USES:

Conditional uses in the R-3R zone shall be the same as those in the R-3 zone. (Ord. 2009-33, 11-24-2009)

11-9H-4: ELIGIBILITY:

Only those properties with an existing R-3 zone designation or mobile home parks that existed at the time of enactment of this article shall be eligible to apply for a rezone to the R-3R zone. (Ord. 2009-33, 11-24-2009)

11-9H-5: DEVELOPMENT AGREEMENT APPROVAL REQUIRED:

Development in the R-3R zone may require approval of a development agreement in accordance with section 11-1-16 of this title. (Ord. 2009-33, 11-24-2009)

11-9H-6: SITE PLAN APPROVAL REQUIRED:

Development in the R-3R zone shall require approval of a site plan in accordance with chapter 5 of this title. The site plan process shall be used to determine density, minimum area, frontage, lot width, setback, lot coverage, height, landscaping, fencing, exterior building material, floor area, and other applicable regulations. The approval of a project's site plan by the planning commission shall be conditioned upon the final approval of the project's development agreement by the city council. (Ord. 2009-33, 11-24-2009)

11-9H-7: DESIGN STANDARDS:

All new site development or construction in the R-3R zone shall incorporate the appropriate design standards described in chapter 18 of this title. (Ord. 2009-33, 11-24-2009)
