ARTICLE XV

Residential Zones

Section 405.590 Residential Zones Defined.

A. 
Allowable Residential Zone uses shall be:
1. 
Single-Family. The following uses are permitted in a Single-Family Zone:
a. 
Single-family dwellings.
b. 
Public owned and operated parks, community building, recreational centers, swimming pools and playgrounds.
c. 
Police and Fire Department stations.
d. 
Public and governmental services.
e. 
Public libraries.
f. 
Schools and colleges (excluding colleges or trade school operated for profit).
g. 
Private garages and buildings accessory to the above permitted uses (including private garages).
h. 
Churches and places of worship.
i. 
Convents, monasteries, rectories or parish houses not to be occupied by more than ten (10) residents.
The maximum amount of lot covered by building and/or paved surfaces shall not exceed thirty percent (30%) of the lot area.
2. 
Single-Family/Duplex Zone: The following uses are permitted in a Single-Family/Duplex Zone:
Any uses permitted in single-family and two-family dwelling lot with maximum of two (2) residential units per lot (duplex/lot). The maximum amount of lot covered by buildings and/or paved surfaces shall not exceed thirty-five percent (35%) of the lot.
3. 
Multiple-Family. The following uses are permitted in a Multiple-Family Zone:
All uses permitted in Single-Family/Duplex, multiple-unit dwellings, such as apartment houses, boarding houses, condominiums, congregate residences, detached single- or multi-family dwellings retained under single ownership, group care facilities and family and group day care facilities. The minimum number of units shall be based on the lot area divided by three thousand (3,000) square feet per unit. The maximum amount of lot covered by buildings and/or paved surfaces shall not exceed forty-five percent (45%) of the lot area.

Section 405.600 Bulk Regulations.

The minimum area, setbacks, density and maximum height shall be as prescribed in Table 502.1. (See Section 405.620.) Off-street parking shall be as required by Article XVIII of this Chapter.

Section 405.610 Special Use Exceptions.

A mobile home park shall be considered as a special use within the Multiple-Family Zone and shall follow the procedure outlined in Article XXI of this Chapter.

Section 405.620 Yard Variance For Corner Lots.

A. 
General. The minimum side yard setback on the street side of a corner lot shall be fifteen (15) feet or more, except where a garage, carport or similar facility is located on the end of the structure adjacent to the side street. In this case, the setback to the side entry garage, carport or similar facility from the side street shall be twenty-five (25) feet or more. A front entry garage, carport or similar facility located adjacent to the street side of the lot should be discouraged but not prohibited.
B. 
Exception. For existing lot/tracts where the frontage width is less than eighty (80) feet at the front yard setback line, the minimum side yard setback on the street side of a corner lot shall be eight (8) feet with a total side yard [two (2) sides] setback being twenty percent (20%) of the lot width or a minimum of five (5) feet on the interior side of the lot, whichever is more.

(a)
For churches or places of worship, the tower/steeple height shall not exceed seventy-five (75) feet with a maximum building height of forty-five (45) feet.
(b)
The minimum lot area per dwelling unit shall not be less than four thousand two hundred (4,200) square feet.
(c)
The minimum lot area per dwelling unit shall not be less than three thousand (3,000) square feet.
(d)
When lot backs to same zoning (Multiple-Family) or to less restrictive zoning, the minimum rear yard may be reduced to twenty (20) feet for each lot.
(e)
Refer to Section 405.620, Yard Variance for Corner Lots, for particular lot restrictions.
(f)
For lots of record before date of the adoption of this Code. Use ten percent (10%) of the lot width or five (5) feet, whichever is less.
(g)
Lots on streets that are sixty percent (60%) developed will be allowed a setback equal to the average of the existing structures.
