This Section addresses the duties and responsibilities of a Planning Commission, hereafter referred to as "the Commission", and other officials and agencies with respect to the administration of this Code.
Section 405.190 Establishment of The Commission.

The establishment of the Commission shall be in accordance with the policies and procedures as set forth in State law. The Commission shall consist of not more than fifteen (15) or less than five (5) citizens and the Mayor. Additionally, one (1) member of the Board of Aldermen selected by the Board of Aldermen shall serve if the Board of Aldermen chooses to have a member serve on the Commission. All members are full and voting members.
Section 405.200 Terms For Members.

The term of each of the citizen members shall be for four (4) years, except that the terms of the citizen members first appointed shall be for varying periods so that succeeding terms will be staggered. The Board of Aldermen may remove any citizen member for cause stated in writing and after public hearing.

All members shall be appointed by the Mayor and approved by the legislative body of the jurisdiction served. The terms of office for the Commission members shall be staggered at annual intervals so as to provide continuity in policy and personnel. Members of the Commission shall be residents of the jurisdiction served. All citizen members of the Commission will serve without compensation. Any vacancy for the unexpired term of any member whose term is not completed shall be filled for the unexpired term by appointment. A member shall continue to serve until a successor has been appointed and approved by the legislative body of the jurisdiction.
Section 405.220 Chairperson Election and Rules Adoption.

The Commission shall elect from its own membership a Chairperson. It shall also establish and adopt rules for its organization and transaction of business and shall keep a public record of its proceedings.
Section 405.230 Commission Secretary.

A Secretary to assist the Commission shall be selected from its membership. The Secretary shall keep minutes of the Commission meetings for public record and conduct correspondence including the notification of decisions. The Secretary shall also certify records. The Secretary shall also prepare and submit the minutes of Commission meetings to the Chairperson and the Commission.
Section 405.240 Roll of the Planning and Zoning Commission.
If the Plan is adopted by the Board of Aldermen, the Commission shall make a copy of the Plan available in the Office of the County Recorder of Deeds for Lafayette County.
This Commission, pursuant to Section 89.070, RSMo., is appointed as "The Zoning Commission," tasked with all present or future State zoning enabling acts. This appointment authorizes the Commission to create a Zoning Map of the City recommending the boundaries of the various original districts and appropriate regulations to be enforced therein. Such Commission shall make a preliminary report and hold public hearings thereon before submitting its final report and such legislative body shall not hold its public hearings or take action until it has received the final report of such Commission.
The Commission deliberates each rezoning application, special use permit application, and proposed text amendment to the Zoning Code and Comprehensive Plan, through the public hearing process with the intent to obtain public opinion on each request.
The Commission utilizes the information obtained through the public hearing to adopt a resolution to the Board of Aldermen on each rezoning application, special use permit application or proposed text amendment.
It shall be the duty of the Commission to develop and recommend to the legislative body a zoning code in accordance with the guidelines of the Comprehensive Plan establishing zones within the jurisdiction. Such a code shall be made in regards to the character of each district and the most appropriate use within the jurisdiction.
The Commission shall make periodic reports and recommendations to the legislative body.
Section 405.260 Division of Land Regulations.

It shall be the duty of the Commission to develop and certify regulations governing the division of land. All divisions of land shall be in accordance with the adopted regulations.
Section 405.270 Conditional Use Permits.

It shall be the duty of the Commission to review conditional use permit applications. The application shall be accompanied by maps, drawings or other documentation in support of the request. The granting of a conditional use permit shall not exempt the applicant from compliance with other relevant provisions of related ordinances.
Section 405.280 Official Zoning Map.

The legislative body shall adopt an official Zoning Map for all area included within the jurisdiction.
Section 405.290 Appeals and Hearings.

Any person with standing aggrieved by any decisions of the Commission shall have the right to make such appeals as shall be permitted to be provided by this Code or State law. Such appeals shall be based on record.
