ARTICLE XII

MOBILE HOME AND MOBILE HOME PARK REGULATIONS

Sec. 12.1.- Purpose.

The purpose of this Article is to ensure that manufactured homes are installed on a site according to applicable federal and manufacturer's requirements in order to promote the general health, safety and welfare of the citizens of Crawfordville.

Sec. 12.2.1. - Application to city council.

Prior to beginning the construction of a mobile home or travel trailer park, the developer or property owner shall first apply to the City Council for review of construction or placement plans. Said application shall include the following:

1.

A plat of the property showing the dimensions of the lot, the names of adjacent property owners, the name of the street or streets on which the lot fronts, the locations of the mobile homes on the lot (complete with distances from property lines and other mobile homes), the location of access ways and curb breaks, and other features required in Sections 12.7, 12.8 or 12.9, whichever is applicable.

2.

A letter of application accompanying the plat giving the name of the property owner, name of applicant (if different from property owner), address and telephone number of applicant and any other information as may be required by the City Council.

Sec. 12.3. - Use restrictions.

In the exercise of its approval, the City Council may impose such conditions regarding the location, character or other features of the proposed use or building as it may deem advisable and necessary to insure sound and compatible development.

Sec. 12.4. - Variances.

For variance procedures and standards please see Article V [of this appendix].

Sec. 12.5. - Prohibited uses.

The City Council may, as it deems necessary and proper, prohibit certain uses and structures where it can be shown that a permit for that use would create a situation detrimental to the public health, safety and general welfare.

Sec. 12.6. - Mobile home parks.

The following minimum standards shall apply to mobile home park development:

1.

Streets shall be privately owned, constructed and maintained and shall have a minimum pavement width of 22 feet. Paving material must meet the approval of the City Council.

2.

Park facilities shall include the following:

a.

An outdoor recreation area (at least 10% of the total park area)

b.

A refuse collection system

c.

A water supply and method of liquid waste disposal subject to the approval of the county health officer

3.

Each mobile home space shall contain ample room to insure that no mobile home will be located closer than:

a.

25 feet from the centerline of any interior park street

b.

20 feet from any other mobile home

c.

35 feet from the right-of-way line of any abutting public street

d.

15 feet from any adjoining property line

4.

Improvements to each mobile home space shall be required as follows:

a.

A minimum individual lot size of 4,500 square feet with a minimum frontage of 35 feet. 90' × 50' or equivalent.

b.

An access way not less than 12 feet wide to each mobile home stand.

c.

Two off-street parking spaces at least 9 feet × 19 feet each.

5.

Mobile home parks shall be located not closer than 300 feet of an existing residential dwelling.

6.

Mobile home parks shall contain at least Two acres. There will be a minimum of fifteen (15) mobile home spaces developed at a time.

Sec. 12.7. - Mobile homes on individual lots.

Mobile homes on individual lots may be permitted in the City of Crawfordville provided the site meets the minimum lot size, setbacks and other requirements for the zoning district in which it is intended to be located. Mobile homes on individual lots shall be provided with the following minimum improvements to the site and lot:

1.

A water supply and method of liquid waste disposal subject to the approval of the City Council.

2.

Connection to public electrical power.

3.

A mobile home shall be fully skirted and the skirting must be of a material specifically designed for that purpose.

4.

No mobile home shall be located on an individual lot, parcel or tract until the location has been approved by the City Council.

5.

A mobile home, mobile office or travel trailer may be placed on a lot occupied by a permanent building where it is necessary to provide for the preparation of a construction site or completion of a construction project. A permit authorizing temporary occupancy for the duration of construction project shall be required.

6.

Mobile homes, mobile offices or similarly prefabricated structures used for commercial or industrial purposes shall comply fully with the city's regulations.

7.

Less than five years shall have elapsed from the date of manufacture of the home to the date of its installation as determined by the date of manufacture stated on the manufacturer's certificate attached to the home. An application for exemption from this requirement may be made to the Planning Commission, the application shall include photographic evidence and an appraisal done by a certified building inspector showing the dwelling is in satisfactory condition and will not have an adverse effect on adjacent uses.

Sec. 12.8. - Travel trailer parks.

The following minimum standards shall apply to travel trailer park development:

1.

A travel trailer park shall contain at least one acre and ten travel trailer spaces.

2.

Each travel trailer space shall contain amply room to insure that no travel trailer will be located closer than:

a.

20 feet from the centerline of any interior park street

b.

20 feet from any other travel trailer

c.

35 feet from the right-of-way line of any abutting public street

d.

15 feet from any property line

3.

Park facilities shall include the following:

a.

Privately owned paved streets at least 20 feet in width. Paving material shall be subject to the approval of the city street superintendent

b.

A refuse collection system

c.

A park-wide water system

d.

At least one sanitary sewage disposal station

e.

At least one toilet and bathing facility, distinctly marked, for each sex and maintained in a sanitary condition and housed in a permanent building appropriately heated and ventilated

f.

An outdoor recreation area containing at least 8,000 square feet

4.

Improvements to each travel trailer space shall include:

a.

A trailer coach stand composed of not less than six (6) inches of compacted gravel and having a clear access way at least ten feet wide to interior park streets

b.

An individual refuse container

c.

A weatherproof electrical connection

d.

An outdoor water hydrant

Sec. 12.9.1. - Building permit required.

It shall be unlawful to commence the excavation for the construction of a mobile home or travel trailer park or the placement of a mobile home or travel trailer on a lot until a building permit authorizing such action has been properly issued. A building permit for such-purposes shall not be issued until after the City Council has approved the appropriate plans. It shall be unlawful for any electric, gas or water utility company, cooperative or individual to connect, provide or furnish service to any mobile home, re-locatable home, new building or proposed building site until a building permit has been obtained and shown to such utility company, cooperative or individual.

Sec. 12.9.2. - Permit fee schedule.

Fees for building permits shall be paid by the developer or property owner according to the following schedule:

1.

Placement of a mobile home or office on an individual lot or park space - $20.00

2.

Development of a mobile home park - $50.00 for the first section (15 spaces) and $50.00 for each additional section.

3.

Development of a travel trailer park - $50.00

Sec. 12.9.3. - Certificate of Occupancy.

After the effective date of this Article, no mobile home on an individual lot shall be occupied and no mobile homes shall be moved into a mobile home park until after the Building Official shall have issued a Certificate of Occupancy. Said Certificate of Occupancy shall be evidence that the mobile home on an individual lot and the mobile home park has complied with this Article.

Sec. 12.9.4. - Building Official.

Except as otherwise provided herein, the Building Official shall administer and enforce the provisions of this Article.

Sec. 12.9.5. - Existing mobile homes.

After the effective date of this Article, any existing mobile home on an individual lot may be continued and maintained although its location and other features may not be in conformity with this Article. No existing mobile home on an individual lot shall be relocated to another site and no mobile home placed on a site vacated by an existing mobile home unless said relocation or placement complies; with this Article.

Sec. 12.9.6. - Existing mobile home parks.

Existing mobile home parks may be continued and maintained; however, they shall not be enlarged or expanded unless said enlargement or expansion is in full compliance with this Article.
