ARTICLE II

ADMINISTRATION AND ENFORCEMENT

Sec. 2.1.- Intent.

The intent of this Article is to provide for suitable and proper administration and enforcement of the provisions of this chapter [appendix]; to designate the enforcing officer and to outline the proper steps to be taken by parties interested in constructing, erecting, or modifying a structure or other land use; and to set forth penalties for violation of the provisions of this chapter [appendix].

Sec. 2.2. - Land development officer.

The City Council shall appoint a Land Development Officer and it shall be his or her duty to administer, enforce, and interpret this chapter [appendix]. The Land Development Officer or their designee shall have all powers and duties authorized by statute or chapter [appendix].

Sec. 2.3. - Duties of the Land Development Officer.

The duties of the Land Development Officer shall include:

1.

Interpretation of the terms and provisions of this chapter [appendix];

2.

Approval of special exceptions if the proposed use meets the conditions set forth in this chapter [appendix];

3.

Approval of group developments provided the conditions of this chapter [appendix] are met;

4.

Administration of this chapter [appendix] by issuance of required permits and certificates including the collection of authorized fees;

5.

Processing applications for appeals to the Planning Commission from the decisions of the Land Development Officer;

6.

Processing applications for variances, and conditional uses for the Planning Commission;

7.

Maintenance of a current zoning map,

8.

Processing applications for zoning map amendments and petitions for zoning text amendments:

9.

All public records related to zoning and planning;

10.

Enforcement of this chapter [appendix], investigation and resolution of zoning complaints;

11.

Approval and issuance of sign permits as set forth in this chapter [appendix];

12.

Approval of building and occupancy permits as set forth in this chapter [appendix];

13.

Administrative assistance to the Planning Commission and City Council, when authorized; and

14.

Such other duties as may be authorized.

Sec. 2.4. - Appeals of decisions of the land development officer.

Appeals of the decisions of the Land Development Officer shall be heard by the Planning Commission as outlined in Article V [of this appendix].

Sec. 2.5. - Building official.

The City Council shall designate a Building Official and it shall be his or her duty to inspect applicable development and issue of building, and occupancy permits.

Sec. 2.5.1. - Duties of the building official.

The duties of the Building Official shall include:

1.

Inspection of development for compliance with the provisions of this chapter [appendix]

2.

Issuance of building permits

3.

Issuance of occupancy permits

4.

Such other duties as may be authorized.
