ARTICLE 2

- RESIDENTIAL DISTRICT R-1

Sec. 2-0.] - Statement of intent.

This district is composed of quiet, low-density residential areas and open areas where similar residential development is planned and appears likely to occur. The regulations for this district are designed to stabilize and protect the basic characteristics and amenities of the district, to promote and encourage a suitable environment for family life where there are children, and prohibit most activities of commercial nature with the exception of home occupations. To these ends, development is limited to a relatively low concentration of dwellings and permitted uses are limited basically to single unit dwellings providing homes for the residents and certain public facilities that serve the residents of the district. Home occupations are permitted.

Sec. 2-1. - Use regulations.

Only one main building and its accessory buildings may be erected on any lot or parcel of land in residential district R-1. Structures to be erected or land to be used shall be for one or more of the following uses:

2-1-1.

Single-family dwellings.

2-1-2.

Schools.

2-1-3.

Churches.

2-1-4.

Parks and playgrounds.

2-1-5.

Off-street parking as required by this ordinance.

2-1-6.

No accessory building may be closer than 15 feet to any property line, except that if the rear property line fronts on a public alley, then it may be no closer than five feet.

2-1-7.

Public utilities: poles, lines, distributions transformers, pipes, meters, and other facilities necessary for the provision and maintenance of public utilities, including water and sewerage facilities.

2-1-8.

Real estate signs, not exceeding 12 square feet in area.

2-1-9.

Church bulletin boards and church identification signs for church activities not exceeding 12 square feet in area.

2-1-10.

Street and property identification signs, not exceeding two square feet in area.

2-1-11.

Guestrooms, not exceeding three.

2-1-12.

Hospitals, general.

2-1-13.

Home occupations conducted by the owner. A permit shall be required, subject to the conditions listed in Article 15 under the definition of "home occupation."

Sec. 2-2. - Area regulations.

The minimum lot area for permitted uses shall be 15,000 square feet, except that private schools must conform to land area requirements of the state board of education.

Sec. 2-3. - Setback regulations.

Structures shall be located 35 feet or more from any street right-of-way which is 50 feet or greater in width; or 60 feet or more from the center of any street right-of-way less than 50 feet in width. This shall be known as the "setback line."

Sec. 2-4. - Frontage regulations.

The minimum lot width at the setback line shall be 100 feet or more.

Sec. 2-5. - Yard regulations.

2-5-1.

Side. The minimum side yard for each main structure shall be 15 feet.

2-5-2.

Rear. Each main structure shall have a rear yard of 35 feet or more.

Sec. 2-6. - Height regulations.

Buildings may be erected up to 35 feet in height except that:

2-6-1.

The height limit for dwellings may be increased up to 45 feet and up to three stories provided each side yard is 30 feet plus one foot or more of side yard for each additional foot of building height over 35 feet.

2-6-2.

A public or semipublic building such as a school, church or library may be erected to a height of 60 feet from grade provided that required front, side, and rear yards shall be increased one foot for each foot in height over 35 feet.

2-6-3.

Church spires, belfries, cupolas, municipal water towers, chimneys, flues, flagpoles, television antennas, and radio aerials are exempt. Parapet walls may be up to four feet above the height of the building on which the walls rest.

2-6-4.

No accessory building which is within 20 feet of any party[property] lot line shall be more than one story high. All accessory buildings shall be less than the main building in height.

Sec. 2-7. - Special provisions for corner lots.

2-7-1.

Of the two sides of a corner lot the front shall be deemed to be the shortest of the two sides fronting on streets.

2-7-2.

The side yard on the side facing the side street shall be 35 feet or more for both main and accessory buildings except as shown otherwise on setback map.

2-7-3.

For subdivisions platted after the enactment of this ordinance, each corner lot shall have a minimum width at the setback line of 125 feet or more.
