ARTICLE 3

- RESIDENTIAL DISTRICT R-2

Sec. 3-0.] - Statement of intent.

This district is composed of medium to high density residential areas, ordinarily located near commercial areas or employment centers, and open areas where similar development is planned and/or likely to occur. The regulations for this district are designed to stabilize and protect the basic characteristics of the district, to promote and encourage insofar as compatible with the intensity of land use, a suitable environment for family life composed of an adult population with children. All residential types of structures for both permanent and transient occupancy, and including institutions, are permitted. This residential district is not completely residential as it includes public and semi-public, institutional, and other related uses. However, it is basically residential in character and, as such, should not be spotted with commercial and industrial uses.

Sec. 3-1. - Use regulations.

In residential district R-2 structures to be erected or land to be used shall be for one or more of the following uses:

3-1-1.

Single-family dwellings.

3-1-2.

Multiple-family dwellings.

3-1-3.

Roominghouses and boardinghouses.

3-1-4.

Tourist homes.

3-1-5.

Schools.

3-1-6.

Churches.

3-1-7.

Rest or convalescent homes.

3-1-8.

Nursing homes.

3-1-9.

General hospitals with conditional use permit.

3-1-10.

Lodges.

3-1-11.

Parks and playgrounds.

3-1-12.

Professional offices.

3-1-13.

Home occupation as defined, conducted by the occupant.

3-1-14.

Off-street parking as required by this ordinance.

3-1-15.

Accessory buildings permitted as defined, however, garages or other accessory structures such as carports, porches and stoops attached to the main building shall be considered part of the main building. No accessory building may be closer than five feet to any property line.

3-1-16.

Public utilities; poles, lines, distribution transformers, pipes, meters, and other facilities necessary for the provision and maintenance of public utilities, including water and sewerage facilities.

3-1-17.

Church bulletin boards and church identification signs for church activities only not to exceed 12 square feet in area.

3-1-18.

Home occupation signs not exceeding two square feet in area.

3-1-19.

Street and property identification signs not exceeding two square feet [in area].

3-1-20.

Real estate signs not exceeding 12 square feet in area.

Sec. 3-2. - Area regulations.

3-2-1.

For lots containing or intended to contain a single permitted use served by public water and sewage disposal, the minimum lot area shall be 11,250 square feet, plus 2,000 square feet for each additional dwelling unit.

3-2-2.

For lots containing or intended to contain a single-family dwelling not served by public water and sewerage systems the minimum lot area shall be 16,250 square feet. The required area for any such use shall be approved by the health official. The administrator may require a greater area if considered necessary by the health official. All other permitted uses shall be served by public water and sewerage systems.

Sec. 3-3. - Setback regulations.

Structures shall be located 30 feet or more from any street right-of-way which is 50 feet or greater in width, or 50 feet or more from the center of any street right-of-way less than 50 feet in width. This shall be known as the "setback line."

Sec. 3-4. - Frontage regulations.

For permitted uses the minimum lot width at the setback line shall be 75 feet or more, and for each additional dwelling unit or permitted use there shall be at least ten feet of additional lot width at the setback line.

Sec. 3-5. - Yard regulations.

3-5-1.

Side. The minimum side yard for each main structure shall be ten feet.

3-5-2.

Rear. Each main structure shall have a rear yard of 25 feet.

Sec. 3-6. - Height regulations.

Buildings may be erected up to 35 feet in height from grade except that:

3-6-1.

The height limit for structures may be increased up to 45 feet and up to three stories provided each side yard is ten feet, plus one foot of side yard for each additional foot of building height over 35 feet.

3-6-2.

A public or semipublic building such as a school, church, library, or hospital may be erected to the height of 60 feet from grade provided that front, side and rear yards shall be increased one foot for each foot in height over 35 feet.

3-6-3.

Church spires, belfries, cupolas, monuments, municipal water towers, chimneys, flues, flag poles, television antennae and radio aerials are exempt. Parapet walls may be up to four feet above the height of the building on which the walls rest.

Sec. 3-7. - Special provisions for corner lots.

3-7-1.

Of the two sides of a corner lot the front shall be deemed to be the shortest of the two sides fronting on streets.

3-7-2.

The side yard on the side facing the side street shall be ten feet or more for both main and accessory buildings except as otherwise shown on the setback map.
