Definitions as established in Chapter 5.10 of the Custer Municipal Code shall apply to the entirety of Title 17 of this code. (Ord. 874 (part), 2022; Ord. 859 (part), 2021)

   A.   No cannabis cultivation facility may be located or operate at a location within the city's zoning jurisdiction except as provided in this title. A cannabis cultivation facility is a permitted principal use in the following zoning district: I (Industrial).

   B.   No cannabis cultivation facility may be located or operate within 1,000 feet of a public or private school. (Ord. 859 (part), 2021)

   A.   No cannabis testing facility may be located or operate at a location within the city's zoning jurisdiction except as provided in this title. A cannabis cultivation facility is a permitted principal use in the following zoning districts: HC (highway commercial), CB (central business district) and M (medical).

   B.   No cannabis testing facility may be located or operate within 1,000 feet of a public or private school. (Ord. 859 (part), 2021)

   A.   No cannabis product manufacturing facility may be located or operate at a location within the city's zoning jurisdiction except as provided in this title. A cannabis product manufacturing facility is a permitted principal use in the following zoning districts: HC (highway commercial), CB (central business district) and I (industrial).

   B.   No cannabis product manufacturing facility may be located or operate within 1,000 feet of a public or private school. (Ord. 859 (part), 2021)

   A.   No cannabis dispensary may be located or operate at a location within the city’s zoning jurisdiction except as provided in this title. A cannabis dispensary is a permitted principal use in the following zoning districts: HC (Highway Commercial), CB (Central Business), and M (Medical).

   B.   No cannabis dispensary may be located or operate within one thousand (1,000) feet of a public or private school. (Ord. 874 (part), 2022; Ord. 859 (part), 2021)

   For the purposes of required separation per this chapter, measurements shall be made in a straight line in all directions, without regard to intervening structures or objects, from the nearest point on the property line of a parcel containing a cannabis establishment to the nearest point on the property line of a parcel containing public or private school. Any public right-of-way(s) shall count toward such measurement. (Ord. 874 (part), 2022; Ord. 859 (part), 2021)

   It is unlawful to own, manage, or operate any cannabis establishment in any zoning district(s) other than the zoning district wherein such cannabis establishment is specifically permitted by the criteria of Title 17 of this code. A violation hereof is subject to the general penalty provision in Chapter 1.12 of this code. Each day of violation constitutes a separate offense. (Ord. 874 (part), 2022; Ord. 859 (part), 2021)
