CHAPTER 17

16 CENTRAL BUSINESS DISTRICT CB

17.16.010 Intent.

   The intent of the central business district (CB) is to provide a commercial area for those establishments serving the general shopping needs of the trade area and in particular those establishments customarily oriented to the pedestrian shopper. The grouping of uses is intended to strengthen the central business area as the urban center of trade, service, governmental and cultural activities and to provide neighborhood commercial convenience areas. 17.16.020 Permitted principal uses and structures.

   The following principal uses and structures shall be permitted in the central business district (CB):
   A.   Automobile parking;
   B.   Automobile service stations;
   C.   Automobile washing; electrical repair; radio and television repair; and watch, clock and jewelry repair;
   D.   Business services;
   E.   Bus passenger terminals and taxicab transportation;
   F.   Churches, synagogues, and temples; welfare and charitable services; business associations; professional membership organizations; labor unions and similar labor organizations; and civic, social and fraternal associations;
   G.   Communication and utility uses;
   H.   Eating and drinking establishments;
   I.   Educational services;
   J.   Financial, insurance and other professional services;
   K.   Governmental services;
   L.   Short-term rentals, hotels, and motels;
   M.   Laundering, dry cleaning and dyeing services; photographic services including commercial services; beauty and barber services; apparel repair, alteration and cleaning pickup service; shoe repair services; newspaper and commercial printing
   N.   Libraries; museums; art galleries; planetaria; aquariums; historic and monument sites; motion picture theaters; auditoriums: exhibition halls; penny arcades; gymnasiums and athletic clubs; ice skating; roller skating; bowling;
   O.   Signs;
   P.   Parks;
   Q.   Public buildings and grounds;
   R.   Retail sales;
   S.   Cannabis dispensaries.

17.16.030 Permitted accessory uses and structures.

   The following accessory uses and structures shall be permitted in the central business district (CB):
   Accessory uses and structures normally appurtenant to the permitted uses and structures when established within the space limits of this district. (Ord. 432 (part), 1995)

17.16.040 Permitted conditional uses.

   After the provisions of this title relating to permitted conditional uses have been fulfilled, the city council may permit as permitted conditional uses in the central business district (CB):
   A.   Other trade and service uses which are similar to the permitted principal uses and which are in harmony with the intent of this district;
   B.   Structures containing both commercial and residential uses; provided, that the following conditions are satisfied:
   1.   The primary access to the dwelling unit is not through the area of commercial use.
   2.   The front thirty (30) feet of the building on the ground floor level is excluded from residential use.
   3.   A minimum of two off-street parking spaces are available and designated as residential parking and that these parking spaces do not reduce the required off-street parking required for the commercial use of the structure. Additional dwelling units or guest rooms within the structure shall have one additional parking space for each additional unit without reducing the required off-street parking for the other uses of the structure.
   4.   This section shall not change or reduce the requirements for building code compliance as it relates to any occupance allowed by this title. (Ord. 520, 2000: Ord. 432 (part), 1995)

17.16.050 Prohibited uses and structures.

   All other uses and structures which are not specifically permitted or not permissible as permitted conditional uses shall be prohibited from the central business district (CB). (Ord. 432 (part), 1995)

17.16.060 Restrictions and requirements.

   All structures, land and uses in the central business district (CB) shall be in compliance with the following restrictions and requirements:
   A.   Minimum Lot Requirements. The minimum lot area shall be three thousand seven hundred fifty (3,750) square feet. The minimum lot width shall be twenty-five (25) feet.
   B.   Minimum Yard Requirements. All buildings located on lots adjacent to a residential district shall be located so as to conform on the adjacent side with the side yard requirements for the adjacent residential district as outlined in Chapter 17.12.
   C.   Maximum Lot Coverage. The maximum lot coverage for all buildings shall not be more than ninety (90) percent of the total lot area.
   D.   Maximum Height. The height of all structures shall not exceed forty-five (45) feet.
   E.   Structures. Not more than one structure, other than accessory structures, shall occupy a building site, provided all structural units comprising a motel shall be deemed to constitute one structure.
   F.   Foundations. All structures must be securely affixed to a permanent foundation.
   G.   Sewer and Water. All structures, other than accessory structures, must be served by municipal water and sewer facilities.
   H.   Accessory Structures. No garden, private garage, carport or other accessory structures shall be located on a building site unless it is accessory to a main building also located on such building site.
   I.   Off-Street Parking and Loading. As required in Section 17.04.090.
