20 HIGHWAY COMMERCIAL DISTRICT HC

17.20.010 Intent.

   The intent of the highway commercial district (HC) is to provide commercial areas for those establishments which can function most satisfactorily in an area directly related to a major vehicular circulation route due to the nature of the merchandise handled and the display space required, particularly items requiring expansive display area such as motor vehicles, trailers and farm implements; the method of transportation required of the purchaser for the merchandise handled, particularly goods customarily traded in bulk such as lumber or feed requiring access for the customer to the sales area; primary dependence upon vehicular, as opposed to pedestrian, access such as drive-in facilities and all types of automotive and farm implement service; or the clientele toward which the establishment is primarily oriented, particularly travelers on the highway. 17.20.020 Permitted principal uses and structures.

   The following principal uses and structures shall be permitted in highway commercial districts (HC):
   A.   Golf driving ranges; golf courses and country clubs;
   B.   Automobile sales, machinery repair, services, and service stations;
   C.   Automobile parking;
   D.   Bus garaging and equipment maintenance;
   E.   Communication and utility uses;
   F.   Contract construction services;
   G.   Drive-in eating and drinking places;
   H.   Farm products warehousing and storage, excluding stockyards;
   I.   Funeral and crematory services;
   J.   Libraries, museums, art galleries, planetaria, aquariums, historic and monument sites, exhibition halls, penny arcades;
   K.   Athletic facilities;
   L.   Short-term rentals, motels and hotels;
   M.   Motor freight garaging, terminals and equipment maintenance;
   N.   Signs;
   O.   Parks;
   P.   Retail sales;
   Q.   Warehousing;
   R.   Financial, insurance and other professional services;
   S.   Professional services;
   T.   Cannabis dispensaries;
   U.   Townhouses, single-family dwellings, and multiple-family dwellings;
   V.   Public storage facilities.

17.20.030 Permitted accessory uses and structures.

   The following accessory uses and structures shall be permitted in highway commercial districts (HC):
   Accessory uses normally appurtenant to the permitted principal uses and structures when established in conformance within the space limits of this district. (Ord. 432 (part), 1995)

17.20.040 Permitted conditional uses.

   After the provisions of this title relating to permitted conditional uses have been fulfilled, the city council may permit as permitted conditional uses in the highway commercial district (HC):
   A.   Any use permitted in central business districts (CB);
   B.   Auditoriums, amphitheaters, stadiums, drive-in movies, arenas and field houses, race tracks, fairgrounds, amusement parks, go-cart tracks, riding stables;
   C.   Campgrounds in accordance with Section 17.20.070 of this Chapter;
   D.   Manufactured housing parks in accordance with Chapter 17.36;
   E.   Slaughtering; provided, that any killing, skinning, eviscerating or plucking be done indoors;
   F.   Veterinary hospitals and commercial kennels.

17.20.050 Prohibited uses and structures.

   All other uses and structures which are not specifically permitted or not permissible as permitted conditional uses shall be prohibited from highway commercial districts (HC). (Ord. 432 (part), 1995)

17.20.060 Restriction and requirements.

   All structures, land and uses in the highway commercial district (HC) shall be in compliance with the following restrictions and requirements:
   A.   Minimum Lot Requirements. The minimum lot area shall be seven thousand five hundred (7,500) square feet. The minimum lot width shall be fifty (50) feet.
   B.   Minimum Yard Requirements. All buildings located on lots adjacent to a residential district (R) shall be located so as to conform on the adjacent side with the side yard requirements for the adjacent residential district as outlined in Chapter 17.12.
   C.   Single-family dwellings and townhomes shall meet the setbacks outlined in Chapter 17.12.
   D.   Maximum Height. The height of all buildings and structures shall not exceed forty-five (45) feet.
   E.   Performance Standards. To be a permitted use in highway commercial districts (HC), whether as a permitted use or as a permitted conditional use, such use must meet the following performance standards:
   Physical Appearance. All repair operations shall be carried on within an enclosed building, except that new materials or equipment in operable condition may be stored in the open. Normal daily waste of an inorganic nature may be stored in containers not in a building when such containers are not visible from the street.
   F.   Off-Street Parking and Off-Street Loading as required in Section 17.04.090.
   G.   Structures. Not more than one structure, other than accessory structures, shall occupy a building site, provided all structural units comprising a motel shall be deemed to constitute one structure.
   H.   Foundations. All structures must be securely affixed to a permanent foundation.
   I.   Sewer and Water. All structures, other than accessory structures, must be served by municipal water and sewer facilities.
   J.   Accessory Structures. No private garage, carport or other accessory structure shall be located on a building site unless it is accessory to main building also located on such building site.

17.20.070 Campgrounds.

   A campground may be established in the Highway Commercial Zone District according to the procedures for granting a permitted conditional use, provided that the proposed campground meets the following requirements:
   A.   A campground shall have an area of at least ninety thousand (90,000) square feet;
   B.   Any camping unit or campground structure shall be setback at least twenty-five (25) feet from any street road, right-of-way, or other property line;
   C.   A campground shall provide minimum facilities including central sanitary sewer dump and water stations, toilets, and refuse containers. If the campground is plumbed exclusively with individual sanitary sewer connections, a central sanitary dump station is not required;
   D.   Certification of compliance with all ordinances and regulations regarding zoning, health, plumbing, electrical, building, fire prevention and suppression and all other applicable ordinances and regulations shall be a prior requirement for granting said conditional use;
   E.   Individual camping units, other than tents, shall have a lot area of not less than seven hundred fifty (750) square feet;
   F.   Individual tent camping units shall be located in separate areas designated for tent camping;
   G.   The layout of the campground shall be such that "destruction" of the natural vegetation and topography of the area is minimized;
   H.   A request for a permitted conditional use shall meet the ordinance requirements of Chapter 17.52, including but not limited to: the location and legal description of the proposed campground property, and a sketch of the proposed campground showing the dimensions, roads, parking areas, campsites, sanitary sewer dump stations, water stations, bath and shower houses, ingress and egress of the campground, and any other buildings or improvements.
