28 PARK DISTRICT P

17.28.010 Intent.

   The intent and purpose of park districts (P) is to provide for the preservation of the natural environment and resources from destructive land uses or to preserve certain locations which have an historic value, or provide for developed public recreation. (Ord. 432 (part), 1995)

17.28.020 Permitted principal uses and structures.

   The following principal uses and structures shall be permitted in park districts (P):
   A.   On-site signs;
   B.   Public parks, recreational and athletic areas, wildlife refuges and forest preserves;
   C.   Historic sites and structures;
   D.   Utility lines within right-of-way and within ten (10) feet of public road right-of-way. (Ord. 432 (part), 1995)

17.28.030 Permitted accessory uses and structures.

   The following accessory uses and structures shall be permitted in park districts (P):
   Accessory uses and structures normally appurtenant to the permitted uses and structures when established within the space limits of this district. (Ord. 432 (part), 1995)

17.28.040 Permitted conditional uses.

   After the provisions of this title relating to permitted conditional uses have been fulfilled, the city council may permit as permitted conditional uses in park districts (P):
   A.   Commercial outdoor recreation areas that are similar to public recreation areas as related to the intent of the park district (P);
   B.   Golf courses, country clubs, golf club houses and swimming pools;
   C.   Horticulture and gardening uses. (Ord. 432 (part), 1995)

17.28.050 Prohibited uses and structures.

   All other uses and structures which are not specifically permitted or which are not permissible as permitted conditional uses shall be prohibited from park district (P). (Ord. 432 (part), 1995)

17.28.060 Restrictions and requirements.

   The use of property or the construction of any building for any purpose permitted in the park district (P) shall be subject to the following restrictions and requirements:
   A.   Drainage Ways. No land or water area shall be filled, dredged or drained nor shall any natural stream or floodway be encroached upon or polluted.
   B.   Clearing. No land shall be cleared for cultivation, or other purposes; provided, that this provision shall not prohibit the harvesting of woodland products on a sustained-yield basis.
   C.   Exceptions. Exceptions to the foregoing conditions may be authorized by the city council for navigation channels, drainage channels, roads, clearings, or other improvements necessary for the protection of existing uses or the proper development of adjacent properties; provided, that such works or improvements shall be so limited that they will not tend to destroy or materially change the natural conditions of rivers, woodlands, swamp, marsh, shallows or other wetlands.
   D.   Maximum Lot Coverage. The maximum lot coverage for all buildings shall not be more than ten (10) percent of the total lot area.
   E.   Maximum Height. The height of dwelling unit structures shall not exceed thirty-five (35) feet. (Ord. 432 (part), 1995)
