ARTICLE XII
Heavy Industrial District
§ 255-76 Purpose.
The Heavy Industrial District is created to provide for manufacturing, fabricating, and other industrial uses in appropriate locations with appropriate standards.
§ 255-77 Permitted uses.
In the Heavy Industrial District, buildings and land may be used for any purposes except the following:
A.
Religious, educational, charitable and medical institutions.
B.
Dwellings, other than one single-family residential dwelling for the owner, proprietor, commercial tenant employee or caretaker located on the same premises as the business.
C.
Commercial uses other than those which are oriented to or derive a major portion of their business from nearby industrial uses.
D.
Uses contrary to the laws of the State of Wisconsin or ordinances developed by the Town of Delton.
E.
Uses listed in § 255-78, Conditional uses, of this district.
§ 255-78 Conditional uses.
Heavy industrial uses listed below shall be allowed in this district only upon issuance of a conditional use permit.
A.
Acid, ammonia, bleach, chlorine, or soap manufacture.
B.
Ammunition manufacture; explosives or fireworks manufacture or storage.
C.
Asphalt, coal and coal tar or coke manufacture; asphalt and cement mixing plants, Type II (see Mineral Reservation District).
D.
Cannery.
E.
Gypsum or plaster of paris manufacture.
F.
Fertilizer manufacture.
G.
Forage plant.
H.
Garbage, rubbish, offal or animal reduction or dumping.
I.
Gelatin, glue or size manufacture.
J.
Inflammable gases or liquids, refining or manufacture of overground tank farms.
K.
Mineral extraction/processing operations, Type I.
L.
Smelting.
M.
Any other industrial uses which are likely to produce noise, odor, glare, heat, radioactivity, electrical disturbances, vibration, fire and explosion hazards, air or water pollution effects which extend beyond the boundaries of the property.
N.
Residential quarters for the owner, proprietor, commercial tenant, employee or caretaker in excess of the one single-family dwelling permitted in § 255-77B.
§ 255-79 Standards.
A.
Dimensional rules and standards for all uses in this district:
(1)
Lot area. Lots or parcels shall be sufficient in size and shape to satisfy highway setback, water setback, rear and side yard setbacks, off-street parking and sanitary requirements.
(2)
Side yard. Nothing shall be built within 10 feet of any side lot line, except that nothing shall be built within 25 feet of any side lot line abutting a residential district.
(3)
Rear yard. Nothing shall be built within 10 feet of any rear lot line, except that nothing shall be built within 25 feet of any rear lot line abutting a residential district.
(4)
Height. No building shall exceed 50 feet in height.
(5)
No automobile parking lot, stockpile, waste or salvage pile, equipment storage yard or other accumulation of material or equipment in the open shall be stored or placed within any setback area, except that loading platforms may be established in a rear yard if it abuts a railroad.
(6)
Cross referenced standards:
(a)
Residential uses. Any residence in this district shall meet the dimensional rules and standards set forth in the Residential (R-1) District.
(b)
Mineral extractions/processing operations shall meet the dimensional rules and standards set forth in the Mineral Reservation District.
B.
Standards for conditional uses:
(1)
Conditional uses must be determined:
(a)
To not cause unusual public service needs.
(b)
To not adversely impact adjacent land uses.
(c)
To not produce traffic which would result in a major slowing of highway traffic, i.e., volume, ingress; egress.
(2)
Applicants shall submit plot plans showing principal and accessory structures, fencing, paving, landscaping, screening, lighting, storage areas and parking, and plans for management of surface waters. The plot plan must demonstrate that the site has sufficient and usable space for all these identified features and for vehicular and pedestrian circulation to and within the site.
(3)
Operational standards:
(a)
Air pollution. No activity shall emit any fly ash, dust, fumes, vapors, mists or gases in such quantities as to cause damage or danger to the health of persons, animals, vegetation, or other forms of property.
(b)
Fire and explosion hazards:

All activities involved in the manufacturing, utilization, processing or storage of flammable and explosive materials:
[a]
Shall be provided with adequate safety devices against the hazard of fire and explosion and adequate firefighting and fire-suppression equipment and devices that are standard in the industry.
[b]
Shall be in completely enclosed buildings.
[2]
No activity shall emit glare or heat that is visible or measurable outside its premises except activities which may emit direct or sky-reflected glare which shall not be visible outside their district. All operations producing glare or heat shall be conducted within a completely enclosed building. Exposed sources of light shall be shielded so as not to be visible outside the premises.
(c)
Odors. No activity, with the exception of agricultural activity, shall emit any odorous matter of such nature or quantity as to be offensive, obnoxious or unhealthful outside of its premises.
(d)
Radioactivity and electrical disturbances. No activity shall emit or release radioactivity or electrical disturbances outside its premises that are dangerous or would adversely affect the use of neighboring premises.
(e)
Vibration. No activity shall emit vibrations that are discernible without instruments outside its premises.
(f)
Water quality protection. No activity shall locate, store, discharge, or permit the discharge of any treated, untreated or inadequately treated liquid, gaseous or solid material of such nature, quantity, obnoxiousness, toxicity or temperature that might run off, seep, percolate or wash into surface or subsurface waters so as to contaminate, pollute or harm such waters or cause nuisances such as objectionable shore deposits, floating or submerged debris, oil or scum, color, odor, taste or unsightliness or be harmful to human, animal, plant or aquatic life.
(g)
Noise. All noise shall be so muffled or otherwise controlled as not to become objectionable due to intermittence, duration, beat frequency, impulse character, periodic character or shrillness.
