As used in this chapter, the following terms shall have the meanings indicated:
ACCESSORY STRUCTURE OR USE
A use or detached structure subordinate and incidental to the principal structure or use of the premises.
BAKERY, COMMERCIAL
A bakery which mass produces goods to be transported and sold elsewhere.
BOARDINGHOUSE
A building or premises where meals are served by prearrangement for definite periods of time for compensation for five to 12 persons not open to transients, in contradiction to a hotel.
BOAT LIVERY
Establishments offering the rental of boats and other watercraft and fishing equipment.
BOATHOUSE
An accessory building, on the same lot as a principal building, designed for the protection and storage of boats, which shall not be used for either temporary or permanent dwelling purposes.
BUILDING
Any structure having a roof supported by columns or walls used or intended to be used for the shelter or enclosure of persons, animals, equipment, machinery or materials.
CAMPGROUND
A parcel or tract of land, maintained, intended or used for the purpose of supplying temporary or overnight living accommodations to the public by providing designated area for the placement of trailers, tents, buses, automobiles or sleeping bags, and may include buildings to provide services to the patrons such as restrooms, bathing, laundry and commissary facilities.
CAMPGROUND, OWNERSHIP-TYPE
A campground in which the individual sites are held by long-term lease agreements and in which the recreational vehicles may be left on the site year round.
CLINIC
An office or building in which dental, medical, paramedical or veterinary services are provided on an outpatient basis.
CONDITIONAL USE
A use of a special nature so as to make impractical its predetermination as a principal use within a district.
CONFORMING USE
Any lawful use of a building or lot which complies with the provisions of this chapter.
DISTRIBUTOR
A dealer who distributes goods to consumers and/or businesses, but whose place of business is not open to customers for retail or wholesale sales.
DISTRICT
A portion or portions of the Town of Delton for which the regulations governing the use of land and buildings are uniform.
DWELLING
A.
SINGLE-FAMILY DWELLING
A building designed for and occupied exclusively as a residence for one family.
B.
TWO-FAMILY DWELLING
A building designed to be occupied by two families living independently of each other.
C.
MULTIPLE-FAMILY DWELLING
A building designed to be occupied by three or more families living independently of each other.
FAMILY
Any number of persons related by blood, adoption or marriage, living together in one dwelling as a single housekeeping entity, including any domestic servants.

FARM
An area of land devoted to the production of field or truck crops, livestock or livestock products for sale or consumption primarily off the premises.
FLOOR AREA
The area within the outer lines of the exterior walls of a building at the top of the foundation or basement wall, provided that the floor area of a dwelling shall not include space not usable for living quarters, such as attics, utility or unfinished basement rooms, garages, breezeways or unenclosed porches, or terraces.
FUR FARM
A tract of land or buildings devoted in whole or part to the raising of fur-bearing animals for commercial purposes.
GARAGE
An attached accessory building or accessory portion of the main building, used or designed or intended to be used for the storage of private motor vehicles, including carports.

HEIGHT (BUILDING)
The vertical distance measured from the mean elevation of the finished lot grade along the street-facing side of the structure to the highest point of the structure, excluding chimneys, vents or antennas.
HOME OCCUPATION
Any occupation for gain or support conducted entirely within a residential building by resident occupants which is incidental to the residential use of the premises, does not occupy more than 20% of the floor area, does not employ on the premises more than two full-time people not residents of the premises, and does not involve the outside storage of materials or other operational activity which would create a nuisance or be otherwise incompatible with surrounding uses.
HOTEL
A building in which board and lodging are provided to the transient public for compensation.
KENNEL
The use of land, with related buildings or structures, for the commercial breeding, rearing or boarding of dogs.
LABORATORY
A place where scientific experiments and research are carried on or where drugs, chemicals or such substances are tested.
LODGING HOUSE
A building in which lodging accommodations are provided by prearrangement for definite periods of time for compensation for five to 12 persons, not open to transients.
LOT
A parcel of land having frontage on a public street, occupied or intended to be occupied by a principal structure or use and sufficient in size to meet the lot width, yards, setbacks, parking area and other open space provisions of this chapter.
LOT LINES AND AREA
The peripheral boundaries of a parcel of land and the total area lying within such boundaries, except all calculations of lot area shall be exclusive of any dedications, right-of-way easements, or reservations.
LOT WIDTH
The width of a parcel of land measured at the rear of the required street/highway setback.
MARINA
A dock or basin providing secure moorings for watercraft and often offering supply, repair and other facilities.
MINERAL EXTRACTION/PROCESSING OPERATION
Includes the excavation, mining or removal of metallic or nonmetallic minerals, clay, ceramic or refractor minerals, quarrying of dirt, sand, gravel, crushed or broken stone, but not the extraction of topsoil, when such activities are undertaken or proposed to be undertaken as a distinct land use. This also includes such mineral processing operations as aggregate or ready-mix plants, mixing of asphalt, mining services, processing of topsoil, washing, refining or processing of metallic or nonmetallic mineral materials. See Article XIII, Mineral Reservation District, for definitions of Type I and Type II operations.
MOBILE HOME
A modular unit built on a chassis with a minimum size of 750 square feet designed to be used alone as a permanent single-family dwelling, with or without a permanent foundation, when connected to required utilities.
MOBILE HOME PARK
Any premises on which are parked two or more mobile homes for temporary or permanent habitation.
MOBILE HOME STAND
That part of an individual mobile home lot which has been reserved and prepared for the placement of one mobile home unit.
MOTEL
A series of attached, semiattached or detached sleeping units for the accommodation of transient guests.
NONCONFORMING USE
Any structure, land or water lawfully used, occupied or erected at the time of the effective date of this chapter or amendments thereto, which does not conform to the regulations of the district it is located in, this chapter or amendments thereto.
OWNERSHIP-TYPE CAMPGROUND
See "campground, ownership-type."
PARKING LOT/FACILITIES
An area where automobiles are temporarily stored, primarily for the convenience of employees, residents or patrons, but not for the purpose of storing vehicles to be junked, salvaged or sold.
PERMITTED USE
A use which may be lawfully established in a particular district, provided it conforms with all requirements and regulations of such district.
PERSON
Except where otherwise indicated by the context, the word "person" shall include the plural, or a company, firm, corporation, partnership or agency.
PLOT PLAN
See "site plan."

PRINCIPAL USE
A use which is the main or primary use of land or buildings as distinguished from a subordinate or accessory use.
PROFESSIONAL OFFICE
A.
PROFESSIONAL HOME OFFICE
Residence of a doctor, dentist, clergyman, realtor, engineer, lawyer, author, musician or other recognized professional person used to conduct their office where the office is within the residence and incidental to the residential use, does not occupy more than 20% of the floor area, and does not employ on the premises more than two full-time people not residents of the premises.
B.
PROFESSIONAL OFFICE
A building in which is provided space for professional offices such as doctors, practitioners, dentists, realtors, engineers, lawyers, authors, architects, musicians and other recognized professional occupations.
PUBLIC HEARING
A public meeting whose time and place is published according to a Class 2 notice as specified in Chapter 985 of the Wisconsin Statutes.
RECREATION CAMP
An area containing one or more permanent buildings used occasionally or periodically for the accommodation of members of associations or groups for recreational purposes.
RESORT
An area containing one or more permanent buildings utilized principally for the accommodation of the public for recreational purposes.
REST HOME
A building or institution for the care of the aged, the infirm or the sick provided the same shall comply with the further definitions and regulations contained in Ch. DHS 83, Wis. Adm. Code.

ROADSIDE STAND
A structure used solely by the owner or tenant of the farm on which such structure is located for the sale of farm products produced on that farm.
SERVICE STATION
Any building or premises which sells gasoline, oil and related products for vehicles. This shall include repairs, washing and lubrication, but shall not include auto body repair or dismantling.
SETBACK
The minimum allowable horizontal distance from a given point or line of reference, such as a highway right-of-way, water line or lot line, to the nearest vertical wall or other element of a building or structure.
SITE PLAN
A plan of the are in which a proposed use is to be located, showing principal and accessory structures, parking areas, storage areas, open areas, setback distances, sewage disposal areas and general land use.

SHOOTING RANGE
An area designed and constructed for the discharge of firearms that is open for club members or public use.
SHORELINE SETBACK
The minimum required building and structure setback for lots abutting navigable waters.

SLAUGHTERHOUSE
Any building or premises used for the killing or dressing of cattle, sheep, swine, goats, horses or poultry, and the storage, freezing and curing of meat and preparation of meat products.
STRUCTURAL ALTERATIONS
Any change in the supporting members of a structure such as foundations, bearing walls, beams, columns or girders or any substantial changes in the roof and exterior wall in excess of $1,000 in value. Such change shall require a land use or conditional use permit.
STRUCTURE
Anything erected or constructed, the use of which requires a more or less permanent location on the ground or attachment of something having a permanent location on the ground, such as buildings, towers, masts, signs, decorations, carports and silos.
SUBDIVISION
The division of a lot, parcel, tract or quarter section by the owner thereof or his agent, for the purpose of transfer of ownership or building development, where the act of division creates three or more lots, or where the act of division creates three or more lots by successive division within a five-year period, or proposed, potential or actual public streets are created.

TRUCK TERMINAL
Buildings or land which are used for the storage or distribution of freight or goods by a common carrier.
UTILITIES
Public and private facilities such as water wells, water and sewage pumping stations, water storage tanks, power generating plants, electrical power substations, static transformer stations, telephone and telegraph exchanges, microwave radio relays, and gas regulation stations.
WATER SETBACK
See "shoreline setback."

YARD
An open space, on the same lot with a structure, unoccupied and unobstructed from the ground upward.
