ARTICLE III

Town Planning Commission

§ 255-33 Establishment.

A Town Planning Commission is hereby created to carry out the intent of the Town of Delton's planning and zoning ordinances. The membership of the Commission and its powers and duties shall be as prescribed by § 62.23, Wis. Stats.

§ 255-34 Membership.

A. 
The Town of Delton Planning Commission shall have seven members appointed by the Town Chairperson and confirmed by the Town Board, as follows:

(1) 
Town Chairperson, who shall serve as the Planning Commission Chairperson.
(2) 
Up to four members of the Town Board.

(3) 
Up to four citizen members who are not elected Town officials may be appointed by the Town Board Chairperson.

B. 
Terms of the Town Planning Commission shall be as prescribed by § 62.23(1)(a) and (d), Wis. Stats.
C. 
At all public hearings the Secretary shall be the Town Clerk-Treasurer or an appointed deputy.
D. 
The Zoning Officer shall attend all meetings when requested by the Commission for the purpose of providing technical assistance.
E. 
Alternates.

(1) 
Any Town Board member may serve as an alternate to a Town Board member or Town Chairperson position and shall act only when a Town Board member or Town Chairperson is absent or refuses to vote because of a conflict of interest. A Town Board member may not serve as an alternate to a citizen member position.
(2) 
Two alternate citizen members may be appointed by the Town Chairperson for a term of three years and shall act only when a regular member is absent or refuses to vote because of a conflict of interest. A citizen member may not serve as an alternate for a Town Board member position.
F. 
Official oaths shall be taken by all members in accordance with § 19.01, Wis. Stats., within five days of receiving notice of this appointment.

G. 
The Town Planning Commission shall fix a reasonable time and place for a hearing and give Class 2 notice thereof. At the hearing the appellant or applicant may appear in person, by agent, or by attorney.
H. 
Vacancies shall be filled for the unexpired term in the same manner as appointments for a full term.

§ 255-35 Powers.

The Town Planning Commission shall have the following powers:
A. 
Review and act upon conditional uses as delineated in Article V of this chapter.
B. 
Review and recommend to the Town Board changes and amendments to this Chapter 255, Zoning, of the Code of the Town of Delton, following Article VI of this chapter.
C. 
Other matters as prescribed by § 62.23 of the Wisconsin Statutes.
D. 
Periodically review and amend (when necessary) this chapter and the Zoning Map.
