CHAPTER 10

BUSINESS DISTRICTS

6-10-1: PURPOSE:

The business districts set forth herein are established to protect public health, to promote public safety, comfort, morals, convenience and the general welfare, and to protect the economic base of the City and the value of property. These general purposes include, among others, the following specific objectives:
   (A)   To promote the most desirable use of land in accordance with a well considered plan so that adequate space is provided in appropriate locations for the various types of business uses, thereby protecting and strengthening the economic base of the City.
   (B)   To place in separate districts those businesses which may create noise, odors, hazards, unsightliness, or which may generate excessive traffic.
   (C)   To permit selected business uses in districts where adjacency to or inclusion in a residential area has sufficient elements of service or convenience to such areas so as to offset the disadvantage.
   (D)   To encourage the grouping in appropriate locations of compatible business uses which will tend to draw trade that is mutually interchangeable and so promote public convenience and business prosperity and contribute to the alleviation of traffic and pedestrian congestion.
   (E)   To provide for the establishment of off-street parking facilities, permitted and required, so as to alleviate traffic congestion and so promote shopping convenience and business prosperity. (Ord. 1973, 1-6-1997)

6-10-2: B-1 LIMITED NEIGHBORHOOD BUSINESS DISTRICT:

   (A)   Purpose: The B-1 District is established to maintain the scale and promote the continuation and establishment of commercial centers which provide goods and services primarily for the convenience of the residents of the surrounding neighborhood. It is not intended to permit major commercial or service establishments which would attract substantial amounts of trade from outside the neighborhood. The development standards and range of allowable uses for the B-1 District are designed to maintain a relatively small-scale, pedestrian-oriented environment.
   (B)   Permitted Uses:
      1.   Apparel shop.
      2.   Art and school supply store.
      3.   Auto accessory store.
      4.   Bakery shop, including the baking and processing of food products (when prepared for retail use on the premises only).
      5.   Banks and financial institutions.
      6.   Barber shop, beauty parlor, chiropody, massage or similar personal service shop.
      7.   Book and stationery stores.
      8.   Business office equipment sales and service.
      9.   Camera and photographic supply shops for retail sale.
      10.   Candy and ice cream shops.
      11.   Coin and philatelic stores.
      12.   Community center and house of worship.
      13.   Currency exchanges.
      14.   Custom dressmaking, millinery, tailoring or shoe repair when conducted for retail sales on the premises only.
      15.   Drug stores.
      16.   Dry cleaning and pressing up to seven hundred fifty (750) pounds of dry cleaning per day.
      17.   Dwelling units, provided they are located above the first floor and above a permitted business use. Dwelling units shall not be permitted on the ground floor of business buildings or in the rear of business establishments on the ground floor.
      18.   Electrical appliance store and repair, but not including appliance assembly or manufacturing.
      19.   Fire station.
      20.   Florist shop and conservatory for retail trade on the premises only.
      21.   Food and fruit stores.
      22.   Frozen food store.
      23.   Gift shops.
      24.   Hardware stores.
      25.   Hobby and craft stores.
      26.   Household appliance store.
      27.   Interior decorating shops, including upholstery and making of draperies, slip covers, and other similar articles, when conducted as part of the retail operations and secondary to the main use.
      28.   Jewelry store and watch repair.
      29.   Launderette and laundromat.
      30.   Leather goods and luggage store.
      31.   Meat markets.
      32.   Meeting halls, lodge halls, fraternal organizations and clubs; provided, they are located in a basement or above the first floor and above a business use permitted in this Section, or said uses may be located on the ground floor when permitted business establishment occupies street frontage except for an entranceway to the rear use.
      33.   Municipal or private recreational building.
      34.   Musical instrument sales and repair, retail trade only.
      35.   Newsstand.
      36.   Offices, business and professional, including medical clinics.
      37.   Paint and wallpaper store.
      38.   Photography studio, including the development of film and pictures when conducted as a part of the retail business on the premises.
      39.   Plumbing showroom, without shop or repair facilities.
      40.   Police station.
      41.   Optician, optometrist.
      42.   Postal substations, finance stations and contract stations.
      43.   Public utility collection offices.
      44.   Restaurants, tearoom and cafe, when the established is not of the drive-in type where food is served to occupants remaining in motor vehicles and fast-food restaurants.
      45.   Savings and loan associations.
      46.   Sewing machine sales and service.
      47.   Shoe sales and/or repair.
      48.   Sporting goods store.
      49.   Stationery store.
      50.   Tobacco shop.
      51.   Toy shop.
      52.   Travel bureau and transportation ticket office.
      53.   Variety store.
      54.   Video stores, retail.
      55.   Any other similar type retail store not specifically listed herein, and which has the economic compatibility with the established uses on adjoining properties.
      56.   All activities, except for automobile off-street parking facilities as permitted or required in this B-1 District, shall be conducted primarily within an enclosed building.
   (C)   Special Uses:
      1.   Auditorium, public.
      2.   Bar, tavern or lounge, free standing.
      3.   Cemeteries, crematories, mausoleum, public/private.
      4.   Child care centers.
      5.   Congregate housing.
      6.   Dispensing organization.
      7.   Funeral home.
      8.   Institutions for the mentally handicapped, public or private.
      9.   Life care housing facility.
      10.   Library, public.
      11.   Museum, public.
      12.   Nursing Homes.
      13.   Package liquor stores.
      14.   Parks, public or private.
      15.   Public utility facilities: filtration plant, heat or power plant, water reservoir or pumping station.
      16.   Radio/TV transmitting or antenna towers, commercial.
      17.   Railroad right-of-way.
      18.   Railroad station.
      19.   Restaurant, carry-out.
      20.   Senior citizen housing.
      21.   Telephone exchange, antenna towers.
      22.   Transformer station.
      23.   Office and storage facility for an organization qualified under Internal Revenue Code §501(c)(3) that provides housing opportunities.
      24.   Emergency shelter/mission.
   (D)   Height Of Buildings: No building or structure shall be erected to exceed a height of three (3) stories, nor shall it exceed thirty-five feet (35') in height.
   (E)   Required Yard Setback Areas: No building shall be constructed or enlarged unless the following yards are provided and maintained in connection with such building:
      1.   Front Yard: No front yard shall be required when all frontage between two (2) intersecting streets lies within this District. However, when lots within this District are adjacent to and adjoining lots in a Residential District, all of which front upon the same street between two (2) intersecting streets, there shall be established the same front yard setback for all of the frontage as has been established in the Residential District.
         (a)   Exception: When existing buildings located in this District have already established a building line at the street line or at a depth less than required herein, then all new buildings may conform to the same building line, except for the first fifty feet (50') of B-1 District frontage adjacent to the Residential District, whereupon there shall be provided a front setback of not less than ten feet (10').
      2.   Side Yard: No side yard is required, except for a corner lot which abuts upon a residential district, or upon an alley separating this District from a residential district. There shall then be provided a side yard equal to one-half (1/2) the front yard required in the abutting residential district, but in no case more than ten feet (10'). The setback shall also apply if the business building fronts the intersecting street, commonly referred to as the side street.
   Refer to Chapter 14 for Buffer Yard Requirements.
      3.   Rear Yard: There shall be a rear yard of not less than twenty feet (20') provided, however, that a one-story accessory building may be located thereon, except for the five feet (5') adjacent and parallel to the rear lot line or alley line.
         (a)   Exception: When existing buildings located in this District have an established building line providing a rear yard of less depth than required in this Section, then all new buildings built as replacement for such buildings may conform to such established building line, except for the first fifty feet (50') of a B-1 District adjacent to an R-1 District, in which case the rear yard shall conform to the requirements of this Section. 6-10-3: B-2 GENERAL BUSINESS DISTRICT:

   (A)   Purpose: The B-2 District is intended to provide for retail establishments which offer a wide range of goods and services in locations which abut or front, and have access to, either directly or via frontage roads, heavily traveled major arterial roads. The purpose is to provide for commercial activities which require large land areas, are oriented to the automobile, and do not depend upon adjoining uses for reasons of comparison shopping and pedestrian trade.
   (B)   Permitted Uses:
      1.   Any use permitted in the B-1 District.
      2.   Agricultural implement sales and services, when conducted wholly within an enclosed building, except as may be permitted in Section 6-3-12 "Accessory Uses Outside Commercial Buildings."
      3.   Antique shops.
      4.   Automobile motor repair and service shop (including automobile body repair and rebuilding, or painting of automobiles).
      5.   Automobile washing facility (including the use of mechanical conveyors, blowers and steam cleaning).
      6.   Bar, tavern or lounge.
      7.   Battery and tire service stations.
      8.   Beverage, bottling and distributing.
      9.   Bicycle sales and repair.
      10.   Boat sales and service.
      11.   Bowling alleys, billiard and pool rooms, dance halls, meeting halls, lodge halls, fraternal organizations and clubs.
      12.   Building materials sales, when conducted wholly within a building, except as may be permitted in Section 6-3-12 "Accessory Uses Outside Commercial Buildings."
      13.   Business machines and office supply stores.
      14.   Contractors' offices and shops, where no fabricating is done on the premises and where all storage of material is within a building.
      15.   Costume rental shop.
      16.   Department stores.
      17.   Dispensing organization.
      18.   Dwelling units; provided, they are located above the first floor and have a permitted business use. Dwelling units shall not be permitted on the ground floor of business buildings or in the rear of business establishments on the ground floor. Two (2) off-street parking spaces shall be provided for each dwelling unit.
      19.   Employment agency.
      20.   Feed and seed store, wholesale.
      21.   Funeral home.
      22.   Furniture store, and upholstery when conducted as part of the retail operations and secondary to the main use.
      23.   Furrier, when conducted for retail trade on the premises only.
      24.   Garden supplies and seed stores.
      25.   Hotels, including dining and meeting rooms, when business uses occupy the street frontage except for an entranceway to the hotel lobby.
      26.   Library, public.
      27.   Liquor store, package goods only.
      28.   Locksmith.
      29.   Mirror and glazing shop.
      30.   Motels.
      31.   Motor vehicle sales, new and used.
      32.   Multi-screen cinema.
      33.   Museum, public.
      34.   Orthopedic and medical appliance store, but not including the assembly or manufacture of such articles.
      35.   Pawn shop.
      36.   Pet shops, but not including animal hospitals.
      37.   Picture framing, when conducted for retail trade only on the premises.
      38.   Print shop.
      39.   Plumbing, air conditioning, electrical showroom and shop.
      40.   Printing, publishing and issuing of newspapers, periodicals, books, stationery and other reading matter.
      41.   Public auction rooms.
      42.   Physical fitness centers and tanning spas.
      43.   Restaurants, sit-down and carry-out.
      44.   Schools; music, dance, business, commercial or trade.
      45.   Secondhand stores and rummage shops.
      46.   Shopping center developed as a unified plan. Such center can be developed to allow all uses in B-1 and B-2 Districts when accommodated in a unified center having shared facilities, accesses and parking.
      47.   Taxidermists.
      48.   Theater, indoor.
      49.   Vending/merchandise distributor.
      50.   Any other similar type retail stores not specifically permitted herein and which have economic compatibility with the established uses on adjoining properties.
   (C)   Special Uses:
      1.   Any special use allowed in the B-1 District, except the following uses which shall be prohibited: Nursing homes, congregate housing, life care housing facility, and senior citizen housing.
      2.   Airport/landing field/strip (subject to FAA).
      3.   Amusement centers.
      4.   Automobile service stations.
      5.   Bakeries, wholesale.
      6.   Bar, tavern or lounge - freestanding.
      7.   Bus terminal.
      8.   Child care centers.
      9.   Fair grounds/permanent carnivals, public or private.
      10.   Food processing, packaging and distribution.
      11.   Greenhouse.
      12.   Kennel, commercial.
      13.   Penal or correctional institutions.
      14.   Processing or assembly limited to the following; provided, that space occupied in a building does not exceed six thousand (6,000) square feet of total floor and basement space, not including stairwells, or elevator shafts; and provided, such processing or assembly can be conducted without noise, vibration, odor, dust or any other condition which might be disturbing to occupants of adjacent buildings. When manufacturing operations of the same or similar products demand space exceeding six thousand (6,000) square feet, they shall then be located in the LM District:
      15.   Products from finished materials such as plastic, bone, cloth, cork, feathers, felt, fiber, paper, fur, glass, hair, horn, leather, precious or semi-precious stones, rubber, shell or yarn.
      16.   Awnings, venetian blinds and window shades.
      17.   Brushes and brooms.
      18.   Cosmetics, drugs and perfumes.
      19.   Electrical equipment appliances.
      20.   Jewelry.
      21.   Medical and dental supplies.
      22.   Optical goods and equipment.
      23.   Pattern making (e.g. for foundry molds).
      24.   Scientific and precision instruments.
      25.   Restaurants, fast food.
      26.   Stadium/arena/armory/gymnasium.
      27.   Self-service storage facility.
   (D)   Height Of Buildings: The same regulations shall apply as are required or permitted in the B-1 Limited Neighborhood Business District. Notwithstanding the foregoing, the height of a hotel (solely as defined in Section 6-2-3 as a “HOTEL OR MOTEL, TRANSIENT”) shall not exceed either six (6) stories or sixty-five feet (65').
   (E)   Required Yard Setback Areas: No building shall be constructed or enlarged unless the following yards are provided and maintained in connection with such building:
      1.   Front Yard: No front yard shall be required when all frontage between two (2) intersecting streets lies within this District. However, when lots within this District are adjacent to and adjoining lots in a residential district, all of which front upon the same street between two (2) intersecting streets, there shall be established the same front yard setback for all of the frontage as has been established in the residential district.
         (a)   Exception: When existing buildings located in this District have already established a building line at the street line or at a lesser depth than required herein, then all new buildings may conform to the same building line, except for the fifty feet (50') of B-2 General Business District frontage adjacent to the residential district, whereupon there shall be provided a front setback of not less than ten feet (10').
      2.   Side Yard: No side yard is required, except for a corner lot which abuts upon a residential district, or upon an alley separating this District from a residential district. There shall then be provided a side yard equal to one-half (1/2) the front yard required in the abutting residential district, but in no case more than ten feet (10'). The setback shall also apply if the business building fronts the intersecting street, commonly referred to as the side street.

      3.   Rear Yard: There shall be a rear yard of not less than twenty feet (20'); provided, however, that a one-story accessory building may be located thereon, except for the five feet (5') adjacent and parallel to the rear lot line or alley line. 6-10-4: CBD CENTRAL BUSINESS DISTRICT:

   (A)   Purpose: The CBD District is intended to provide for the City's highest intensity core of retail, commercial, financial, and service facilities. This area should function as the primary center of business and civic activity for the entire community. The purpose is to build upon and strengthen the core retail and municipal function of the city center as the hub for business and civic life.
   (B)   Permitted Uses: All permitted uses in the B-1 and B-2 zoning districts are permitted in the CBD District, except for those uses listed as special uses in Section 6-10-4C., below. Dispensing organizations are permitted in the CBD District.
   (C)   Special Uses: All special uses in the B-1 and B-2 zoning districts may be allowed in the CBD District as a special use. The following permitted uses allowed in the B-1 and B-2 Districts will be permitted only as a special use in the CBD District:
      1.   Agricultural implement sales.
      2.   Auto washing facility.
      3.   Battery and tire services.
      4.   Beverage bottling.
      5.   Boat sales and service.
      6.   Feed and seed store, wholesale.
      7.   Funeral home.
      8.   Motel.
      9.   Multi-screen cinema.
      10.   Plumbing, air conditioning, electrical showroom and shop.
      11.   Vending/merchandise distributor.
   (D)   Height of Buildings: No building or structure shall be erected or structurally altered to exceed a height of six (6) stories nor shall it exceed sixty-five feet (65') in height.
   (E)   Required Yard Setback Areas: No building shall be constructed or enlarged unless the following yards are provided and maintained in connection with such building:
      1.   Front Yard: No front yard shall be required when all frontage between two (2) intersecting streets lies within this District. However, when lots within this District are adjacent to and adjoining lots in any residential district, all of which front upon the same street between two (2) intersecting streets, there shall be established the same front yard setback for all of the frontage as has been established in the residential district.
         (a)   Exception: When existing buildings located in this District have already established a building line at the street line or at a lesser depth than required herein, then all new buildings may conform to the same building line, except for the fifty feet (50') of CBD District frontage adjacent to the residential district, whereupon there shall be provided a front setback of not less than ten feet (10').
      2.   Side Yard: No side yard is required, except for a corner lot which abuts upon a residential district, or upon an alley separating this District from a residential district. There shall then be provided a side yard equal to one-half (1/2) the front yard required in the abutting Residential District, but in no case less than ten feet (10'). The same setback shall apply if business buildings front the intersecting street, commonly referred to as the side street.
   Refer to Chapter 14 for Buffer Yard Requirements.
      3.   Rear Yard: A rear yard setback is not required in this District. (Ord. 1973, 1-6-1997; amd. Ord. 3178, 12-2-2019)

6-10-5: BH-X INTERCHANGE PLANNED UNIT DEVELOPMENT DISTRICT:

   (A)   Purpose: The BH-X District is intended to encourage the development of large parcels under a planned development approach for land in the vicinity of the Illinois Tollway I-88. "High-profile" retail, office, limited manufacturing and warehousing uses, which depend upon high visibility and ease of accessibility to highways, are encouraged to be developed under a unified master site plan in a well landscaped, campus setting.
   (B)   Permitted Uses: The following uses may be permitted within a BH-X District subject to the planned unit development regulations as provided in Chapter 12 of this Title:
      1.   Airport/landing field/strip (subject to FAA).
      2.   Amusement centers.
      3.   Auditorium, public.
      4.   Automobile fuel and service stations, including vehicle washing facilities.
      5.   Automobile/truck and recreational vehicle sales.
      6.   Automobile/truckstops.
      7.   Bus terminal.
      8.   Child care center.
      9.   Community center, public.
      10.   Conference or training center.
      11.   Distribution facility.
      12.   Fire, police, and rescue station.
      13.   Furniture store.
      14.   Golf courses.
      15.   Health and fitness center.
      16.   Heliport.
      17.   Hospitals, public or private.
      18.   Hotels and motels.
      19.   Institutions for the mentally handicapped.
      20.   Limited manufacture, processing, fabrication and/or assembly of products.
      21.   Municipal or private recreational building.
      22.   Offices - business, and medical offices and clinics.
      23.   Parks, public or private.
      24.   Performance arts center.
      25.    Post office, drop off and pick up.
      26.   Public utility facilities: filtration plant, heat or power plant, water reservoir or pumping station.
      27.   Railroad station.
      28.   Research facilities with experimental, testing or development activities.
      29.   Restaurants: sit-down, carry-out and fast food.
      30.   Retail uses, ancillary to the principal use.
      31.   Stadium/arena.
      32.   Theater, movie or live performances.
      33.   Utility substation.
      34.   Accessory uses, clearly secondary to the principal use of the property or building, provided they occupy in the aggregate not more than twenty eprcent (20%) of the floor area of such building.
      35.   Any other similar type use not specifically listed herein, and is compatible with the established uses on adjoining properties.
   (C)   Minimum Area: Each BH-X District shall contain a minimum of ten (10) contiguous acres of land under single or joint ownership with consent of involved landowners. Each principal use shall be located on not less than one (1) acre of land and shall have a minimum Floor Area Ratio of 0.25.
   (D)   Required Yard Setback Areas: In addition to satisfying the Planned Unit Development requirements of Chapter 12 and the landscape and buffering requirements in Chapter 14, all yard setback areas shall be determined by the Plan Commission upon review of a specific development proposal.
