CHAPTER 9

RESIDENTIAL DISTRICTS

6-9-1: PURPOSE:

The residential districts set forth herein are established in order to protect public health, and promote public safety, convenience, comfort, morals, prosperity and welfare. These general goals include, among others, the following specific purposes:
   (A)   To protect residential areas against fire, explosion, noxious fumes, offensive noise, smoke, vibrations, dust, odors, heat, glare and other objectionable factors.
   (B)   To protect residential areas to the extent possible and appropriate in each area against unduly heavy motor vehicle traffic, especially through-traffic and to alleviate congestion by promoting off-street parking.
   (C)   To protect residential areas against undue congestion of public streets and other public facilities by controlling the density of population through regulation of the bulk of buildings.
   (D)   To protect and promote the public health and comfort by providing for ample light and air to buildings and the windows thereof.
   (E)   To promote public comfort and welfare by providing for usable open space on the same zoning lot with residential development.
   (F)   To provide sufficient space in appropriate locations to meet the probable need for future residential expansion and to meet the need for necessary and desirable services in the vicinity of residences, which increase safety and amenity for residents and which do not exert objectionable influences.
   (G)   To promote the best use and development of residential land in accordance with a comprehensive land use plan, to promote stability of residential neighborhoods, and to protect the value of land and improvements and so strengthen the economic base of the City. (Ord. 1973, 1-6-1997)

6-9-2: RESIDENTIAL DEVELOPMENT STANDARDS OF GENERAL APPLICABILITY:

   (A)   Minimum Bulk Regulations: No structure or lot shall be developed, used, or occupied unless it meets the minimum lot area, lot width, and yard requirements and height limits set forth in this Chapter for the zoning district in which it is located.
   (B)   Impervious Surface Coverage Limitations:
      1.   In no event shall more than thirty percent (30%) of the required front yard be covered by impervious surfaces.
      2.   In no event shall more than forty percent (40%) of the required side yards combined be covered by impervious surfaces.
      3.   In no event shall more than fifty percent (50%) of the required rear yard combined be covered by impervious surfaces.
   (C)   No temporary carport shall be permitted within any District as defined in this Chapter.
   (D)   Any single family or duplex structure constructed after the effective date of this Chapter must contain an enclosed one-car private garage per dwelling unit, attached or detached from the main structure, having minimum dimensions of twelve feet (12') by twenty-two feet (22').
   (E)   No motor vehicle, trailer, camper, motor home, recreational vehicle, boat, personal watercraft, all-terrain vehicle or golf cart may be parked on any residential lot within any district as defined in this Chapter except on a paved driveway intended for parking or access to garage or carport, or other paved area intended for parking, which in no event shall exceed the limitations contained in Section 6-9-2B of this Section. Where a paved surface is required hereunder, any graveled surface existing prior to the effective date of this Chapter is permitted for such use, but no such existing graveled area may be increased in size or surface area.
      1.   With the exception of necessary points of access to the lot, or to buildings, no such paved area may be situated closer than six feet (6’) from any lateral property line, five feet (5’) from the rear property line, twenty five feet (25’) from the front lot line, or ten feet (10’) from any primary structure on an adjacent lot. Any existing gravel surface in violation of the requirements of this subsection may remain in place for a period of not more than two (2) years from the effective date of this Chapter at which point such use shall be discontinued and terminated.
      2.   Campers and recreational vehicles parked on a residential lot may be used as a temporary residence for no more than seventy two (72) hours.
      3.   Construction trailers or trailers designed for hauling only shall not be parked on any residential lot except inside of a permanent structure, unless in use incident to a valid and current building permit. Such use incident to a building permit shall be limited to a period no more than twenty four (24) hours prior to the commencement of work onsite and no more than 24 hours after completion of such work, and shall not exceed five (5) days. 6-9-3: ER ESTATE RESIDENTIAL DISTRICT:

   (A)   Purpose: The ER District is intended to promote large-lot, detached single-family residential development, to preserve the natural features of the land, such as the topography and vegetation, and to provide an alternative to the historical pattern of development within the City of Dixon. All parcels shall be served by public water and sewer. The overall density of the ER District shall not exceed two (2) dwelling units per gross buildable acre.
   (B)   Permitted Uses:
      1.   Child day care providers as defined in Section 6-2-3 of this Title.
      2.   Convents, monasteries, rectories or parish houses to be occupied by not more than ten (10) persons.
      3.   Home occupations as defined in Section 6-2-3 of this Title.
      4.   Neighborhood parks/tot lots.
      5.   One-family detached dwellings.
      6.   Planned unit developments in accordance with the regulations of Chapter 12 of this Title.
      7.   School: elementary, junior high.
      8.   Truck gardening and other horticultural uses where no building is involved and when no sale of products is conducted on the premises.
      9.   Temporary buildings and uses for construction purposes for a period not to exceed one year; provided, however, temporary carports are not permitted in an ER Estate Residential District.
   (C)   Special Uses:
      1.   Bed and breakfast inn.
      2.   Camp, not-for-profit.
      3.   Cemeteries, crematories, mausoleums, public/private.
      4.   Child care homes.
      5.   Churches, synagogues, temples, mosques, and other places of worship.
      6.   Community or regional park.
      7.   Community center, public.
      8.   Congregate housing facility.
      9.   Federal, State, County, or City administrative or public safety facilities.
      10.   Golf courses and country clubs, public/private.
      11.   Private club or lodge.
      12.   Public utility facilities: filtration plant, heat or power plant, water reservoir or pumping station.
      13.   Radio, television and/or telecommunication tower.
      14.   School - high and college, public/private.
      15.   Transformer station.
   (D)   Height Of Buildings: The maximum height of buildings permitted shall be as follows:
      1.   One-Family Detached Dwellings: Thirty-five feet (35').
      2.   Public And Religious Buildings (Including Hospitals, Schools, Churches, Synagogues, Temples And Other Places Of Worship, And Other Institutions): forty-five feet (45') for the main structure.
      3.   For height exceptions refer to Chapter 3, Section 6-3-7.
   (E)   Lot Size And Width:
Every single-family detached dwelling hereafter erected or structurally altered shall be on a lot having an area of not less than twenty thousand (20,000) square feet, and a width at the established property line of not less than one hundred feet (100').
Public and religious buildings hereafter erected or structurally altered shall be on a lot having an area of not less than forty thousand (40,000) square feet and a width at the building line of not less than two hundred feet (200').
   (F)   Required Yard Setback Areas: No building shall be erected or enlarged unless the following required yard setback areas are provided and maintained:
      1.   Front Yard:   40 feet minimum.
         Side Yard:   15 feet minimum.
         Rear Yard:   40 feet minimum.
   (G)   Lot Length/Width Ratio:
      Ratio:   4:1 maximum
   (H)   Lot Coverage; Maximum Area: Not more than twenty-five percent (25%) of the lot area of an interior lot nor more than twenty percent (20%) of the lot area of a corner lot may be covered by buildings, exclusive of accessory buildings.
   (I)   Floor Area Standards: Every one-story dwelling hereafter erected in any ER District shall have a total ground floor area of not less than 1,500 square feet measured from the outside of the exterior walls, including utility rooms, but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes. Every dwelling of more than one story hereafter erected in any ER District shall have a total floor area, measured from the outside of the exterior walls, of not less than two thousand (2,000) square feet including utility rooms, but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes, except that enclosed space intended for habitable rooms which are to be completed within a reasonable time may be considered in computing such floor areas.
   (J)   Setbacks From Major Roads: No building shall be located any closer than seventy five feet (75') from the right-of-way of any arterial road, sixty feet (60’) from the right-of-way of any major collector, or forty feet (40’) from any other right-of-way, as identified in the City of Dixon Comprehensive Plan. 6-9-4: CR COUNTRYSIDE RESIDENTIAL DISTRICT:

   (A)   Purpose: The CR District is intended to promote low to medium density single-family residences on lots where adequate public sewer and water systems exist or can be made available. The CR District serves as a transitional zone between Estate Residential districts and higher density residential areas of the City of Dixon. The overall density of the CR District shall not exceed four (4) dwelling units per gross buildable acre.
   (B)   Permitted Uses:
      1.   Child day care providers as defined in Section 6-2-3 of this Title.
      2.   Convents, monasteries, rectories or parish houses to be occupied by not more than ten (10) persons.
      3.   Home occupations as defined in Section 6-2-3 of this Title.
      4.   Neighborhood parks/tot lots.
      5.   One-family detached dwellings.
      6.   Planned unit developments in accordance with the regulations of Chapter 12 of this Title.
      7.   School: elementary, junior high.
      8.   Temporary buildings and uses for construction purposes for a period not to exceed one year; provided, however, temporary carports are not permitted in a CR Countryside Residential District.
   (C)   Special Uses:
      1.   Cemeteries, crematories, mausoleums, public/private.
      2.   Child care homes.
      3.   Churches, synagogues, temples, mosques and other places of worship.
      4.   Community or regional park.
      5.   Community center, public.
      6.   Congregate housing facility.
      7.   Federal, State, County, or City administrative or public safety facilities.
      8.   Golf courses and country clubs, public/private.
      9.   Private club or lodge.
      10.   Public utility facilities: filtration plant, heat or power plant, water reservoir or pumping station.
      11.   Radio, television and/or telecommunication tower.
      12.   School - high and college, public/private.
      13.   Transformer station.
   (D)   Height Of Buildings: The maximum height of buildings permitted shall be as follows:
      1.   One-Family Detached Dwellings: Thirty-five feet (35').
      2.   Public and Religious Buildings (including hospitals, schools, churches, synagogues, temples, mosques and other places of worship, and other institutions): forty-five feet (45') for the main structure.
      3.   For height exceptions refer to Chapter 3, Section 6-3-7.
   (E)   Lot Size And Width: Every one-family detached dwelling hereafter erected or structurally altered shall be on a lot having an area of not less than ten thousand (10,000) square feet, and a width at the established property line of not less than seventy feet (70').
Public and religious buildings hereafter erected or structurally altered shall be on a lot having an area of not less than twenty thousand (20,000) square feet and a width at the building line of not less than one hundred feet (100').
   (F)   Required Yard Setback Areas: No building shall be erected or enlarged unless the following required yard setback areas are provided and maintained:
   1.   Front Yard:   35 feet minimum.
      Side Yard:   10 feet minimum.
      Rear Yard:   35 feet minimum.
   (G)   Lot Length/Width Ratio:
      Ratio:   3:1 maximum
   (H)   Lot Coverage; Maximum Area: Not more than twenty-five percent (25%) of the lot area of an interior lot nor more than thirty percent (30%) of the lot area of a corner lot may be covered by buildings, exclusive of accessory buildings.
   (I)   Floor Area Standards: Every one-story dwelling hereafter erected in any CR District shall have a total ground floor area of not less than one thousand two hundred (1,200) square feet measured from the outside of the exterior walls, including utility rooms, but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes. Every dwelling of more than one story hereafter erected in any CR District shall have a total floor area, measured from the outside of the exterior walls, of not less than one thousand five hundred (1,500) square feet including utility rooms, but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes, except that enclosed space intended for habitable rooms which are to be completed within a reasonable time may be considered in computing such floor areas.
   (J)   Setbacks From Major Roads: No building shall be located any closer than seventy five feet (75’) from the right-of-way of any arterial road, fifty feet (50’) from the right-of-way of any major collector, or thrity five feet (35’) from any other right-of-way, as identified in the City of Dixon Comprehensive Plan. 6-9-5: R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT:

   (A)   Purpose: The R-1 District is established to protect, promote, and maintain the development of single-family detached housing and limited public and institutional uses that are compatible with the surrounding residential neighborhood. The R-1 District is intended to provide for the continued development of the historic, established pattern of single-family development in the City of Dixon, where public water and sewer utility service is or can be made available. The overall density of the R-1 District shall not exceed seven (7) dwelling units per gross buildable acre.
   (B)   Permitted Uses:
      1.   Child day care providers as defined in Section 6-2-3 of this Title.
      2.   Convents, monasteries, rectories or parish houses to be occupied by not more than ten (10) persons.
      3.   Home occupations as defined in this Title.
      4.   Neighborhood parks/tot Lots.
      5.   One-family detached dwellings.
      6.   Planned unit developments in accordance with the regulations of Chapter 12 of this Title.
      7.   Transitional Uses: Two-family dwellings, principal offices of physicians, dentists, lawyers, architects, real estate brokers, and other professional occupations, when conducted in a residential structure used primarily as a home and when located on lots having a side line adjoining a lot in a business or manufacturing district, or adjacent to a railroad right of way directly across a street or alley, provided that:
         (a)   The lot on which the transitional use is located does not extend more than seventy-five feet (75') from the adjoining business or manufacturing district, or more than one hundred twenty feet (120') in depth from the street line in cases where the lot does not adjoin, but faces a business or manufacturing district;
         (b)   There is a minimum lot area of five thousand (5,000) square feet for each two-family dwelling;
         (c)   The home occupations are conducted in conjunction with the use of a dwelling unit as a home by the occupant thereof, with not more than two (2) employees other than members of the related family, and that the residential character of the exterior of the dwelling is not changed. Medical clinics are not included or permitted.
      8.   School: elementary, junior high.
   (C)   Special Uses:
      1.   Cemeteries, crematories, mausoleum, public/private.
      2.   Child care homes.
      3.   Churches, synagogue, temples, mosques and other places of worship.
      4.   Community or regional park.
      5.   Community center, public.
      6.   Golf courses and country clubs, public/private.
      7.   Penal or correctional institution.
      8.   Private club or lodge.
      9.   Public utility facilities: Filtration plant, heat or power plant, water reservoir or pumping station.
      10.   Radio, television and/or telecommunication tower.
      11.   Transformer station.
      12.   Carpentry equipment, material storage and occasional shop work if the premises has been used as a storage building in compliance with the City Code immediately proceeding the filing of a petition for special use.
   (D)   Height of Buildings: The maximum height of buildings permitted shall be as follows:
      1.   One-Family Detached Dwellings: Twenty-five feet (25') and not over two and one-half (2 1/2) stories.
      2.   Public and Religious Buildings (including hospitals, schools, churches, synagogues, temples, mosques and other places of worship, and other institutions): forty-five feet (45') for the main structure.
      3.   For height exceptions refer to Chapter 3, Section 6-3-7.
   (E)   Lot Size and Width:
Every one-family detached dwelling hereafter erected or structurally altered shall be on a lot having an area of not less than six thousand (6,000) square feet, and a width at the established property line of not less than sixty feet (60').
Public and religious buildings hereafter erected or structurally altered shall be on a lot having an area of not less than ten thousand (10,000) square feet and a width at the building line of not less than seventy-five feet (75').
   (F)   Required Yard Setback Areas: No building shall be erected or enlarged unless the following required yard setback areas are provided and maintained:
Front Yard:   25 feet minimum. In no case shall a front yard of more than fifty feet (50') be required.
Side Yard:   On each lot upon which a dwelling is constructed, there shall be a side yard on each side of not less than five feet (5'). The combined total of the side yards for interior lots shall not be less than twelve feet (12') and the combined total of side yards for corner lots shall not be less than fifteen feet (15').
On corner lots created prior to the effective date of this Title, there shall be maintained a side yard of not less than ten feet (10') on the side adjacent to the street which intersects the street upon which the building or structure maintains frontage, and in the case of a reversed corner lot, there shall be maintained a setback from the side street of not less than fifty percent (50%) of the front yard required on the lots in the rear of such corner lots, but such setback need not exceed fifteen feet (15'). No accessory building on the reversed corner lot shall project beyond the front yard required on the adjacent lot to the rear, nor be located nearer than five feet (5') to the side lot of the adjacent lot.
On corner lots created subsequent to the effective date of this Title, there shall be maintained a corner side yard of not less than twenty-five feet (25') on the side of the lot adjacent to the street.
Rear Yard:   30 feet minimum.
   (G)   Lot Length/Width Ratio:
   Ratio:   4:1 maximum
   (H)   Lot Coverage; Maximum Area: Not more than thirty-five percent (35%) of the lot area of an interior lot nor more than thirty percent (30%) of the lot area of a corner lot may be covered by buildings, exclusive of accessory buildings.
   (I)   Floor Area Standards: Every one-story dwelling hereafter erected in any R-1 One-Family District, shall have a total ground floor area of not less than nine hundred sixty (960) square feet measured from the outside of the exterior walls, including utility rooms, but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes. Every dwelling of more than one story hereafter erected in any R-1 One-Family District shall have a total floor area, measured from the outside of the exterior walls, of not less than fourteen hundred fifty (1,450) square feet including utility rooms, but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes, except that enclosed space intended for habitable rooms which are to be completed within a reasonable time may be considered in computing such floor areas.
   (J)   Setbacks From Major Roads: No building shall be located any closer than fifty feet (50’) from the right-of-way of any arterial road, thirty five feet (35’) from the right-of-way of any major collector, or twenty five feet (25’) from any other right-of-way, as identified in the City of Dixon Comprehensive Plan. 6-9-6: R-2 TWO-FAMILY RESIDENTIAL DISTRICT:

   (A)   Purpose: The R-2 District is intended to promote and maintain the development of low density multiple-family housing and limited public and institutional uses that are compatible with the surrounding residential neighborhood. This District is intended to provide for duplex, single-family attached residences, and low rise apartments on lots where public water and sewer utilities exist or can be made available. The overall density of the R-2 District shall not exceed twelve (12) dwelling units per gross buildable acre.
   (B)   Permitted Uses:
   Any use permitted in the R-1 District.
   Two-family dwellings (including condominium dwellings).
   (C)   Special Uses:
      1.   Any special use permitted in the R-1 District.
      2.   Bed and breakfast.
      3.   Child care centers.
      4.   Child care homes.
      5.   Churches, synagogue, temples, mosques and other places of worship.
      6.   Congregate housing.
      7.   Dwelling group.
      8.   Group home.
      9.   Heliport (only in conjunction with a hospital or municipal use).
      10.   Hospitals, public or private.
      11.   Library, public.
      12.   Life care facility.
      13.   Nursing homes.
      14.   Senior citizen housing.
      15.   Single-family attached dwellings (townhomes) .
      16.   Three and four-family dwellings, as transitional use, when located on lots having a side lot line adjoining or when facing a business or manufacturing use, or railroad right of way; provided, the building is located on a lot having a width of not less than sixty feet (60') and has an area of not less than six thousand (6,000) square feet.
      17.   A commercial greenhouse, provided the premises has been used as a garden supply store for more than ten (10) years immediately preceding the filing of the Application for Special Use.
      18.   Charitable Resource Center, which is defined as a resource center owned by a charitable organization that accepts donations of clothing, furniture, furnishings, toys and related items and disburses those items to persons with need.
   (D)   Height Of Buildings: The same regulations shall apply as permitted in the R-1 Single-Family Residential District.
   (E)   Lot Size And Width: Single-Family Dwellings: The same regulations shall apply as permitted in the R-1 Single-Family Residential District.
Two-Family Dwellings: Every two-family dwelling hereafter erected or structurally altered shall be on a lot having an area of not less than seven thousand five hundred (7,500) square feet and a width at the building line of not less than seventy-five feet (75'). The minimum lot area for any individual attached single-family dwelling that shares a common wall or lot line with another attached single-family dwelling shall be three thousand five hundred (3,500) square feet, with a minimum lot width of thirty-five feet (35'). In no case shall the sum of both individual attached single-family dwellings be less in lot area and lot width than that required for a two-family dwelling herein. Each individual existing dwelling unit shall comply with the City of Dixon building codes in effect at the time of application for subdivision.
Converted Dwellings: An existing one-family dwelling located on a lot of less area than required by this Section may be converted to a two-family dwelling without increasing the lot size, provided that the building is not enlarged beyond its present outside dimensions and that all other regulations of this Title are complied with. Additions may be made to an existing building only when lot size and yard requirements of this Section can be complied with. Each individual existing dwelling unit shall comply with the City of Dixon building codes in effect at the time of application for conversion of a single-family dwelling to a two-family dwelling.
Public and Religious Buildings: The same regulations shall apply as required in the R-1 Districts.
   (F)   Required Yard Setback Areas: No building shall be erected or enlarged unless the following yards are provided and maintained in connection with such building, structure or enlargement:
Front Yard:   The same regulations shall apply as required in the R-1 Districts.
Side Yard:   Single-Family Detached Dwellings: The same regulations shall apply as required in the R-1 Districts.
Two-Family Dwellings: The same regulations shall apply as required for single-family detached dwellings. There shall be no side yard required along the lot line that is shared by two (2) individual attached single-family dwellings, each of which comply with the minimum lot area requirements of the R-2 District for individual attached single-family dwellings.
Rear Yard:   Every lot or parcel of land upon which a building is constructed shall have a rear yard of not less than thirty feet (30').
   (G)   Lot Coverage: The same regulations shall apply as required in the R-1 District.
   (H)   Setbacks From Major Roads: No building shall be located any closer than fifty feet (50’) from the right-of-way of any arterial road, thirty five feet (35’) from the right-of-way of any major collector, or twenty five feet (25’) from any other right-of-way, as identified in the City of Dixon Comprehensive Plan.
   (I)   Floor Area Standards:
      1.   Single-Family Detached Dwellings: The same regulations shall apply as required in the R-1 District.
      2.   Two-Family Dwellings: Every two-family dwelling hereafter erected in any R-2 District, shall have a total floor area of not less than nine hundred sixty (960) square feet measured from the outside of the exterior walls, including utility rooms, but excluding cellars, basements, open porches, breezeways, garages and other spaces that are not used frequently or during extended periods for living, eating or sleeping purposes, except that enclosed space intended for habitable rooms which are to be completed within a reasonable time may be considered in computing such floor areas. 6-9-7: R-3 MODERATE DENSITY MULTIPLE-FAMILY DISTRICT:

   (A)   Purpose: The R-3 District is intended to promote and maintain the development of moderate density multiple-family housing and limited public and institutional uses that are compatible with the surrounding residential neighborhood. This District is intended to provide for duplex, single-family attached residences, and low rise apartments on lots where public water and sewer utilities exist or can be made available. The overall density of the R-3 District shall not exceed 24 dwelling units per gross buildable acre.
   (B)   Permitted Uses:
Any use permitted in the R-2 District.
Multiple-Family Dwelling.
   (C)   Special Uses:
      1.   Any special use permitted in the R-2 District.
      2.   Business and professional offices (including medical).
      3.   Federal, State, County, or City administrative or public safety facilities.
      4.   Institutions for the mentally handicapped, public/private.
      5.   Mobile Home Parks.
      6.   Municipal or private recreational building.
      7.   Museum, public.
      8.   Railroad right-of-way.
      9.   Temporary emergency shelters until May 1, 2001.
   (D)   Required Yard Setback Areas:
No building shall be erected or enlarged unless the following required yard setback areas are provided and maintained:
Front Yard:   40 feet minimum, exclusive of parking areas. 45 feet minimum including parking areas.
Side Yard:   Ten feet (10') interior side yard.
For exterior side yards there shall be a side yard on each side of a main building of not less than fifteen feet (15') and a combined total of side yards of not less than twenty-five feet (25') for all multiple-family dwellings of not more than two (2) stories in height. For each additional story added above the two (2) stories, the side yard on each side of the main building shall be increased two feet (2') in width. On corner lots the exterior side yard on the intersecting street side shall not be less than fifteen feet (15'), except in the case of a reversed corner lot, where there shall be a side yard of not less than fifty percent (50%) of the established front yard setbacks on that street. No accessory building on the reversed corner lot shall project beyond the side front yard setback line, nor be located nearer than five feet (5') to the side or rear lot line.

Rear Yard:   Thirty feet (30') minimum for interior lots;
Twenty feet (20') minimum on corner lots or lots abutting adjacent business districts.
   (E)   Height Of Buildings:
      1.   No building shall hereafter be erected or structurally altered to exceed four (4) stories nor shall it exceed forth-five feet (45') in height.
      2.   Public and Religious Buildings (including hospitals, schools, churches, synagogues, temples, mosques and other places of worship, and other institutions): Sixty feet (60') for the main structure.
      3.   For height exceptions refer to Chapter 3, Section 6-3-7.
   (F)   Lot Coverage; Maximum Area:
Not more than sixty percent (60%) of the lot area of an interior lot nor more than fifty-five percent (55%) of the lot area of a corner lot may be covered by buildings, exclusive of accessory structures.
   (G)   Maximum Residential Density:
   The following lot areas are required:
Two-family dwellings hereafter established shall be on a lot having an area of not less than six thousand (6,000) square feet and a width at the building line of not less than sixty feet (60').
A multiple-family dwelling shall be erected on a lot determined on the following basis for each unit. No multiple-family dwelling shall be located on a lot of less than eight thousand (8,000) square feet:

   (I)   Setbacks From Major Roads: No building shall be located any closer than fifty feet (50’) from the right-of-way of any arterial or collector road, as identified in the City of Dixon Comprehensive Plan or forty feet (40’) from any other right-of-way. 6-9-8: R-4 HIGH DENSITY MULTIPLE-FAMILY DISTRICT:

   (A)   Purpose: The R-4 District is intended to promote and maintain the development of multiple-family housing and limited public and institutional uses adjacent to the central business district to encourage walk-in trade for downtown businesses, civic and cultural facilities and employment opportunities. The R-4 District is intended to provide for convenient and affordable housing opportunities, at densities characteristic of high-rise multiple-family residential buildings. The overall density of the R-4 District shall not exceed forty eight (48) dwelling units per gross buildable acre.
   (B)   Permitted Uses:
      1.   Any use permitted in the R-3 District, excluding child day care provider.
      2.   Boarding and lodging houses.
      3.   Multiple-family dwellings and apartments (including condominium apartments).
      4.   One-family row dwelling (party wall type) with not more than six (6) dwelling units in a building (including condominium apartments).
      5.   Tourist homes having not more than five (5) rooms for transient guests.
      6.   Transitional Uses: Principal offices of physicians, dentists, lawyers, architects, real estate brokers and other professional occupations, when conducted in a residential structure used primarily as a home and when located on lots having a side line adjoining a lot in a business or manufacturing district, or adjacent to a railroad right of way, or when facing a business or manufacturing district or a railroad right of way directly across a street or alley, provided that:
         (a)   The lot on which the transitional use is located does not extend more than seventy-five feet (75') from the adjoining business or manufacturing district, or more than one hundred twenty feet (120') in depth from the street line in cases where the lot does not adjoin, but faces a business or manufacturing district;
         (b)   The home occupations are conducted in conjunction with the use of a dwelling unit as a home by the occupant thereof, with not more than two (2) employees other than members of the related family, and that the residential character of the exterior of the dwelling is not changed. Medical clinics are not included or permitted;
   (C)   Special Uses:
      1.   Any special use permitted in the R-3 District, except for the following use which is prohibited:
         (a)   Mobile Home Parks.
   (D)   Height Of Buildings: No building shall hereafter be erected or structurally altered to exceed six (6) stories nor shall it exceed sixty-five feet (65') in height.
   (E)   Required Yard Setback Areas: No building or structure nor the enlargement of any building or structure shall be hereinafter erected or maintained unless the following yards and lot areas are provided and maintained in connection with such structure or enlargement:
Front Yard:   20 feet minimum.
Side Yard:   10 feet interior side yard. For exterior side yards there shall be a side yard on each side of a main building of not less than five feet (5') and a combined total of side yards of not less than fifteen feet (15') for all multiple-family dwellings of not more than two (2) stories in height. For each additional story added above the two (2) stories, the side yard on each side of the main building shall be increased two feet (2') in width. On corner lots the exterior side yard on the intersecting street side shall not be less than ten feet (10'), except in the case of a reversed corner lot, where there shall be a side yard of not less than fifty percent (50%) of the established front yard setbacks on that street. No accessory building on the reversed corner lot shall project beyond the side front yard setback line, nor be located nearer than five feet (5') to the side or rear lot line.

   (F)   Lot Coverage: Not more than sixty-five percent (65%) of the lot area of an interior lot nor more than sixty percent (60%) of the lot area of a corner lot may be covered by a building exclusive of accessory buildings.
