47. - OFF-STREET LOADING
The purpose and intent of the provisions for off-street loading is to establish the minimum number of required off-street loading berths and minimum design requirements for off-street loading facilities associated with the use of any land, building or structure which is to be established, erected, extended or enlarged, and which require the receipt or distribution of materials or merchandise by truck or similar vehicles.

Any word or phrase contained within this chapter followed by the symbol [SR] shall be subject to the definitions and the additional interpretive requirements provided in chapter 19.90. The exclusion of such symbol shall not exempt such word or phrase from the applicable supplementary regulation.

All off-street loading facilities [SR] shall be located on the same zoning lot [SR] as the land use [SR] to be served. Loading berths for vehicles with two (2) tons of capacity or more shall be located at least fifty (50) linear feet from any residence conservation district or residence district. Approaches to off-street loading facilities shall be located at least twenty-five (25) linear feet from the nearest point of intersection of any two (2) streets.

Space allocated to any off-street loading berth shall not, while so allocated, be used to satisfy the space requirements for any off-street parking facilities [SR] or portions thereof.

No storage of any kind, nor motor vehicle repair work or service of any kind, shall be permitted within any required loading berth.

Each required off-street loading berth shall be designed with an appropriate means of vehicular access to a street [SR] or alley [SR] in a manner which will least interfere with traffic movements within the adjoining public rights-of-way and shall be subject to the approval of the city engineer and the development administrator.

Unless otherwise specified in this chapter, a required off-street loading berth shall be at least ten (10) linear feet in width by at least twenty-five (25) linear feet in length, exclusive of aisle and maneuvering space, and shall have vertical clearance of at least fourteen (14) linear feet.

All vehicle use areas [SR] associated with off-street loading facilities [SR] shall comply with the provisions of the following sections of chapter 19.45:
19.45.110. Access driveways to a public right-of-way;
19.45.150. Vehicle use area setbacks and landscape yards;
19.45.160. Parking lot perimeter curb;
19.45.170. Surfacing;
19.45.190. Stormwater control;
19.45.200. Striping and markings;
19.45.210. Traffic-control signs;
19.45.230. Site plan and construction permit;
19.45.240. Occupancy permit.

The required number of off-street loading berths shall be provided for all land uses as listed in section 19.47.100 prior to the issuance of an occupancy permit, except those land uses located within the CC1 Center City District and CC2 Center City District shall not be required to provide off-street loading berths. Where there is more than one (1) use as listed in the table located on any land or within any building, the required number of off-street loading berths shall be provided for each use.

Variations from the regulations of this chapter may be granted only in conformance with the provisions of chapter 19.70 and only in the following instance and no others. to permit a reduction in the required number of off-street loading berths.

Any requirement, determination, or interpretation associated with the administration and enforcement of the provisions of this chapter may be appealed subject to the provisions of chapter 19.75.
