GENERAL PROVISIONS
§ 27-101 Short Title.

This chapter shall be known and may be cited as the "Zoning Ordinance" or the "Frazer Township Zoning Ordinance."
§ 27-102 Grant of Power.

Pursuant to the authority contained in the Pennsylvania Municipalities Code, 53 P.S. § 10101 et seq., as amended, and the Floodplain Management Act, Act 166 of 1978, as amended, and for the purpose of promoting the health, safety and general welfare of the Township, the Board of Supervisors does hereby enact this chapter to regulate and restrict height, number of stories, size and location of buildings and other structures, their construction, alteration, extension, repair, maintenance of all facilities and services in or about such buildings and structures, density of lot development, size of lots, yards, courts, and other open spaces, the density of population in relation to land use, and the location and use of buildings, structures, land, and watercourses for trade, industry, commerce, residence, public service and other purposes.
§ 27-103 Statement of Purposes; Community Development Objectives.

The provisions of this chapter are intended to achieve the following purposes:
A.
To promote the public health, safety, morals, convenience and general welfare.
B.
To encourage the most appropriate use of land throughout the Township.
C.
To preserve prime agriculture and farm land, considering topography, soil type, and classification and present use.
D.
To conserve and stabilize the value of property.
E.
To prevent overcrowding of land and buildings; to avoid undue concentration of population.
F.
To lessen congestion in the streets.
G.
To secure safety from fire, panic and other dangers.
H.
To provide adequate open spaces for light and air.
I.
To facilitate adequate provision of street and highways, water, sewerage, drainage and other public facilities.
J.
To conserve life, property and natural resources.
K.
To conserve the expenditure of funds earmarked for public improvements.
L.
To encourage new development that is well-designed, of high quality and suited to the natural conditions of this site.
M.
To encourage the coordinated growth of communities; compact, efficient, and economic patterns of development; and to avoid excessive public costs of scattered development.
N.
To prevent development which may be hazardous because of the physical character of land and to protect and preserve valued natural, historic, and cultural features of the environment.
O.
To ensure the provision of public improvements which are necessary and appropriate for the development, and which are coordinated with nearby areas.
P.
To provide flexibility in standards and requirements so that the design of development can be fitted to the character of its site and to the community in which it is located.
Q.
To prevent one or more of the following: overcrowding of land; blight; danger and congestion in travel and transportation; and loss of health, life and property from fire, panic or other dangers.
R.
To define and limit the powers and duties of the Township's administrative officers and bodies as addressed by this chapter.
S.
To implement the community goals and objectives contained in the Township Comprehensive Plan, which are incorporated herein.
§ 27-104 Application.

In interpreting and applying the provisions of this chapter, they shall be held to be the minimum requirements for the promotion of health, safety, morals and the general welfare of Frazer Township and its citizens. It is not intended by this chapter to interfere with or abrogate or annul any rules or regulations previously adopted or permits previously issued by the Township which are not in conflict with any provisions of this chapter, nor is it intended by this chapter to interfere with or abrogate or annul any easements, covenants, building restrictions, or other agreements between parties; provided, however, that where this chapter imposes a greater restriction upon the use of the buildings or premises or upon the height of the building, or requires a larger open space than is imposed or required by such ordinance, rules, regulations or permits, or by easements, covenants, building restrictions or agreements the provisions of this chapter shall control.
§ 27-105 Interpretation of Requirements.

The regulations set forth by this chapter within each zoning district shall apply uniformly to each district and shall be held as the minimum requirements for the protection of public health, safety and general welfare. Wherever the regulations of this chapter are at variance with the requirements of any other lawfully adopted rules, regulations, deed restrictions, covenants or ordinances, the most restrictive, or that imposing the higher standards, shall govern.
