44 - NONCONFORMING USES
Buildings, dwellings, structures and mobile homes and their use are deemed existing in nonconformity in the event that construction has progressed beyond the footing stage at the time of passage of the ordinance codified in this title.

A nonconforming structure lawfully existing at the time of passage of the ordinance codified in this title may have recurrent maintenance and remodeling performed upon it so long as no structural change is made, except as otherwise stated in this chapter.

No nonconforming structure shall be moved in whole or in part to any other location on the lot on which it is located or to any other lot at a different location, unless it is made conforming.

A structure nonconforming as to use, height, yard requirements or lot shall not be added to or enlarged in any manner unless such addition or enlargement is made to conform to the use, height, yard and area requirements of the district in which it is located.

A nonconforming mobile home may be replaced or improved upon by the owner of record at the time of passage of the ordinance codified in this title, so long as the use is continuous.

When a nonconforming mobile home changes ownership it must be relocated in conformity within thirty days from the time of change of ownership.

When a nonconforming structure is destroyed fifty percent or more by any cause it shall not be rebuilt except in conformance with the provisions of this title.

A nonconforming use in a structure may be expanded or extended into any other portion of the structure provided no structural changes are made.

When a nonconforming structure has an assessed valuation as equalized for real estate tax purposes of less than five hundred dollars at the time of passage of the ordinance codified in this title, it shall be removed, dismantled or made conforming within six months.
