CHAPTER 17

84 - ENFORCEMENT

17.84.010 - Reserved.

17.84.020 - Stop work orders.

Whenever any structure or use is found to be in violation of this title, the building inspector may order any work on such structure or any such use of land stopped by notice in writing served on any persons engaged in or causing such work or use. Such person(s) shall forthwith stop such work or use until authorized by the building inspector. Any failure to comply with the stop work order shall constitute a separate violation of this title, subject to the enforcement provisions of this chapter. The building inspector may only issue a stop work order in conjunction with an infraction or misdemeanor charge for violating the zoning code. Unless otherwise directed by the building inspector or ordered by the court, the stop work order shall remain in effect during any challenge or appeal to the infraction(s) and/or misdemeanor charge(s). If the person subject to the stop work order prevails on a challenge to the infraction(s) and/or misdemeanor charge(s), the stop work order shall no longer apply.

17.84.030 - Unlawful structures a nuisance.

Any building or structure hereafter set up, erected, built, moved or maintained or any use of property hereafter contrary to the provisions of this title, shall be and the same is declared to be unlawful and a public nuisance. The city attorney shall immediately commence action or actions, proceeding or proceedings for the abatement, removal and enjoinment thereof in the manner provided by law, and shall take such other steps and shall apply to such court or courts as may have jurisdiction to grant such relief as will abate or remove the building, structure or use and restrain and enjoin any person from setting up, erecting building moving or maintaining any such building or structure or using any property contrary to the provisions of this title.

17.84.040 - Violation, penalty.

The general penalty of Section 1.16.010 applies.

17.84.050 - Mayor may designate other city staff to serve in place of building inspector.

The mayor may designate a city staff person other than the building inspector to issue infractions or stop work orders as authorized in this chapter. If the mayor is not available to designate an alternative staff person to serve in this function and circumstances do not permit waiting for the mayor to become available, the public works director or mayor pro tem may designate an alternative staff person.
